AGENDA STATEMENT

SUBJECT: Approval of Freeway Maintenance Agreement with Caltrans for
Improvement of I-580/San Ramon Road/Foothill Road Interchange

FINANCIAL STPiTEMENT: Under this maintenance agreement, Dublin will maintain the new
landscaping included in the 1-580/San Ramon Road/Foothill Road
interchange improvement project. In addition, Dublin will equally
share the maintenance and energy costs of the proposed traffic
signal system and safety lighting. Following is a breakdown of
the estimated annual maintenance costs:
Landscaping and Irrigation: $3,000
Traffic signal/safety lighting (Dublin's share): $1,250
Approximate annual maintenance cost: $4,250
The cost of landscape maintenance will be paid out of the General
Fund budget. The safety lighting costs will be paid out of the street
light maintenance assessment district, and traffic signal maintenance
costs are paid from Gas Tax traffic safety funds.
DESCRIPTION: The preparation of contract documents for the 1-580/San Ramon
Road/Foothill Road Interchange improvement project is nearing completion. Included in this interchange
project is a reconfiguration of the westbound off-ramp at San Ramon Road; removal of the existing
westbound 1-580 to northbound loop off-ramp; signalization of the westbound 1-580 ramp with San
Ramon Road; landscaping of the San Ramon Road median between the new off-ramp and Dublin
Boulevard and of the northeast corner of the new off-ramp intersection; and the overlay of San Ramon
Road between 1-580 and Dublin Boulevard.
Prior to Caltrans' issuance of the encroachment permit to construct the project, the City is required to
enter into a maintenance agreement with Caltrans to identify maintenance responsibilities of the proposed
improvements.

Under the proposed maintenance agreement with C~ltrans, the City will agree to maintain any new
landscaping installed with the interchange project, including a portion that lies within the Pleasanton City
limits north of the freeway. Landscaping of this portion is desirable to enhance the area approaching San
Ramon Road from the new westbound off-ramp of the freeway. Pleasanton staff has agreed to Dublin
maintaining this area, and Dublin Staff will procure formal authorization from Pleasanton in the near
future.
Dublin also agrees to share equally with Caltrans in the total maintenance and energy costs of the new
traffic signal and safety lighting proposed at the intersection of the new westbound off-ramp and San
Ramon Road.
Staff recommends that the City Council adopt the resolution approving the freeway maintenance
agreement with Caltrans for the 1-580/Foothill Road/San Ramon Road Interchange improvement project.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
APPROVING FREEWAY MAINTENANCE AGREEMENT WITH THE
STATE DEPARTMENT OF TRANSPORTATION (CALTRANS)
FOR THE IMPROVEMENT OF THE
1-580/SAN RAMON ROAD/FOOTHILL ROAD INTERCHANGE
WHEREAS, the 1-580/San Ramon Road/Foothill Road Interchange Improvement project proposes
to modify the interchange to eliminate weaving problems and improve traffic operations; and
WHEREAS, it is the City of Dublin's intent to fund this project with Th-Valley Transportation
Development Fee - 20% funds, as indicated in the City's Five-Year Capital Improvement Program; and
WHEREAS, City Staff has been working cooperatively with Caltrans on the design and
environmental documentation of the interchange improvement project; and
WHEREAS, it is necessary to enter into a freeway maintenance agreement with Caltrans to
identify maintenance responsibilities of the proposed improvements;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin approves
the freeway maintenance agreement with Caltrans for the improvement of the 1-580/San Ramon
Road/Foothill Road Interchange.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute the agreement.

FREEWAY MAINTENANCE AGREEMENT
THIS AGREEMENT, made and entered into in duplicate, effective this
_, day of ., 20 , is by and between the State of
California, acting by and through the Department of Transportation, hereinafter referred to as
"STATE," and the City of Dublin, hereinafter referred to as "CITY".
WITNESSETH:
WHEREAS, under STATE Cooperative Agreement No. 1834-C between STATE and
CITY, CITY will construct improvements to State Highway Route 580, a freeway within the
limits of CITY, at the San Rarnon Road/Foothill Road Interchange, and
WHEREAS, portions of improvements under said Cooperative Agreement are within the
corporate limits of the City of Pleasanton, hereinatter PLEASANTON, and
WHEREAS, the parties hereto mutually desire to clarify the division of maintenance
responsibility, upon completion of improvements and acceptance by STATE, under said
Cooperative Agreement, as to separation structures, and local CITY streets and roads, or portions
thereof, and landscaped areas lying within or outside the freeway limits.
NOW THEREFORE, IT IS AGREED:
1. When a planned future improvement has been constructed and/or a minor revision has
been effected within the limits of the freeway herein described, which affects the
parties division of maintenance responsibility as described herein, STATE will
provide a new dated and revised Exhibit "A" which will be made a part hereof by an
amendment to this Agreement when executed by both parties, which will thereafter
supersede the attached original Exhibit "A" and which will then become part of this
Agreement.
2. LANDSCAPED AREAS ADJACENT TO CROSSING STRUCTURES
Any plantings or other types of roadside development lying outside of the area
reserved for exclusive freeway use shall be maintained by CITY at CITY expense.
CITY shall also maintain, at CITY expense, landscaping within and outside the area
reserved for exclusive freeway use as shown in Exhibit "A." CITY shall only access
to and from said area shown in Exhibit "A" from the local road and not the freeway
ramp unless a separate authorization in the form of an encroachment permit is
obtained from STATE.

3. INTERCHANGE OPERATION
It is STATE's responsibility to provide efficient operation of freeway interchanges,
including ramp connections to local streets and road. The maintenance and energy
costs of safety lighting, traffic signals or other necessary electrically operated traffic
control devices placed at ramp connections to CITY streets and roads shall be shared
between STATE and CITY. Timing sequence of traffic signals shall be determined
after consultation with CITY; however, the decision of STATE shall be final.
4. FACILITIES WITHIN THE CORPORATE LIMITS OF PLEASANTON
CITY shall procure and maintain in force a separate authorization from
PLEASANTON to perform CITY's responsibilities assumed under this Agreement
which are located within the corporate limits of PLEASANTON.
Should CITY fail to maintain said authorization from PLEASANTON in force,
CITY, at CITY expense, shall remove the landscaping within the corporate limits of
PLEASANTON subject to maintenance under this Agreement to the satisfaction of
STATE. Thereafter CITY shall no longer perform the work, including traffic signal
system and lighting maintenance, if any, within the corporate limits of
PLEASANTON subject to this Agreement.
5. LEGAL RELATIONS AND RESPONSIBILITIES:
A. Nothing in the provisions of this Agreement is intended to create duties or
obligations to or rights in third parties not parties to this contract or affect the
legal liability of either party to the contract by imposing any standard of care with
respect to the maintenance of STATE highways different from the standard of
care imposed by law.
B. It is understood and agreed that neither STATE nor any officer or employee
thereof is responsible for any damage or liability occurring by reason of anything
done or omitted to be done by CITY under or in connection with any work
authority or jurisdiction delegated to CITY under this Agreement. It is
understood and agreed that, pursuant to Government Code section 895.4, CITY
shall defend, indem14fy and save harmless STATE and all of its officers and
employees from all claims, suits or actions of every name, kind and description
brought for or on account of injuries to or death of any person or damage to
property resulting from anything done or omitted to be done by CITY under or in
connection with any work, authority or jurisdiction delegated to CITY under this
Agreement.
C. It is understood and agreed that neither CITY nor any officer or employee thereof
is responsible for any damage or liability occurring by reason of anything done or
omitted to be done by STATE under or in connection with any work, authority or
jurisdiction delegated to STATE under this Agreement. It is understood and
agreed that, pursuant to Government Code section 895.4, STATE shall defend,
indemnify and save harmless CITY and all of its officers and employees from all
claims, suits or actions of every name, kind and description brought for or on
account of injuries to or death of any person or damage to property resulting from
anything done or omitted to be done by STATE under or in connection with any
work, authority or jurisdiction delegated to STATE under this Agreement.
6. EFFECTIVE DATE
This Agreement shall be effective upon the date appearing on its face, it being
understood and agreed, however, that the execution of this Freeway Maintenance
Agreement shall not affect any pre-existing obligations of CITY to maintain
designated areas pursuant to prior written notice from STATE that work in such
areas, which CITY has agreed to maintain pursuant to the terms of the Freeway
Agreement, has been completed.
