Thompson, Public Works Director ATTACHMENTS: 1) Resolution 2) Vicinity Map RECOMMENDATION:~f/~ r~ Adopt Resolution accepting improvements for Parcel Map 7580, Wilcox Development Services - Dublin, LLC (Sybase Dublin  / \c/,-, Headquarters) FINANCIAL STATEMENT: Wilcox Development Services - Dublin, LLC, has provided a Maintenance Bond in the mnount of $454,436 to guarantee the improvements against defects for one year. Once the improvements have been accepted, the City will incur maintenance and street sweeping costs for City street improvements on Central Parkway, Dublin Boulevard and Hacienda Drive. The cost of street light maintenance will be paid by Citywide Street Light Maintenance Assessment District 83-1. Landscaping improvements fronting Dublin Boulevard, Central Parkway, and Hacienda Drive will be maintained by the City via Landscape Maintenance Assessment District 97-1. DESCRIPTION: The Sybase Dublin Headquarters (Parcel 2 of Parcel Map 7580) are bordered by Arnold Road on the west, Central Park~vay on the north, Dublin Boulevard on the south and Hacienda Drive on the east. The project included two large office buildings totaling 420,000 square feet. Improvements consisted of roadway widening and frontage landscaping on Central Parkway, Dublin Boulevard and Hacienda Drive. The project also included traffic signals at the Sybase entrance driveway on Dublin Boulevard, at Central Parkway/Arnold Road, at Central Parkway/Hibernia Drive, and at Hacienda Drive/Gleason Drive. In addition, the project modified pavement markings on Arnold Road between Central Parkway and Dublin Boulevard. These improvements have been constructed pursuant to the Tract Developer Agreement and to the satisfaction of the City Engineer, and should now be accepted by the City for permanent maintenance. At the time the City and Wilcox Development Services - Dublin, LLC, executed the agreement for improvements, the developer's agent, DPR Construction, Inc., provided a Performance Bond in the amount of $1,817,744 and a Labor and Materials Bond in the amount of $908,872 to guarantee COPIES TO: Kim Sutton, Wilcox Development ITEM NO. 4_~ G:\DEVELOP\Sybase~Agstacpt_7580.doc performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond in an amount necessary to guarantee against defects for a one-year period following acceptance of the work. DPR Construction, Inc., has provided a Maintenance Bond in the amount of $454,436, which is 25% of the original Performance Bond amount, and is sufficient to guarantee the improvements for one year from the date of acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements installed for Parcel Map 7580, Wilcox Development Services - Dublin, LLC (Sybase Dublin Headquarters). Page 2 7_ FO ~- RESOLUTION NO. - 03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTANCE OF IMPROVEMENTS FOR ARNOLD ROAD, CENTRAL PARKWAY, DUBLIN BOULEVARD AND HACIENDA DRIVE, AND REQUIRED ON-SITE IMPROVEMENTS FOR SYBASE DUBLIN HEADQUARTERS, PARCEL MAP 7580 (WILCOX DEVELOPMENT SERVICES-DUBLIN, LLC) WHEREAS, the subdivider of Parcel Map 7580, filed on September 12, 2000, Recorder Series No. 2000274074 in Book 252 of Parcel Maps at Pages 90 - 95, previously entered into an agreement with the City of Dublin to install public improvements in accordance with plans and specifications on file with the City Engineer, said project identified as follows: a) Subdivider: Wilcox Development Services, LLC, a Limited Liability Company b) Parcel Map Location: Bordered by Arnold Road, Central Parkway, Dublin Boulevard and Hacienda Drive c) Parcel Map Size: 25.730 acres total (Parcel l(Vacant): 11.363 acres, Parcel 2 (Sybase): 14.367 acres) d) Resolution Approving Agreement: 158-00, City of Dublin City Council e) City Streets Affected: Arnold Road, Central Parkway, Dublin Boulevard and Hacienda Drive; and WHEREAS, the improvements associated with Parcel Map 7580 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the original Performance Bond and Labor and Materials Bond can be released in accordance with the authority contained in §66499.7 of the Government Code of the State of California and replaced with a Maintenance Bond to guarantee maintenance of the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed on Arnold Road, Central Parkway, Dublin Boulevard and Hacienda Drive and within said Parcel Map are hereby approved and accepted subject to a one-year guarantee period. 2. The original Faithful Performance Bond issued by United States Fidelity and Guaranty Company (Bond No. SC0029) in the amount of $1,817,744.00 be released. 3. The original Labor and Materials Bond issued by United States Fidelity and Guaranty Company (Bond No. SC0029) in the amount of $908,872.00 be released. 1 4. The submitted Maintenance Bond issued by United States Fidelity and Guaranty Company (Bond No. SC0029) in the amount of $454,436.00 be accepted as security for the aforesaid one-year guarantee period, said period to commence on this date and terminate on 18th day of March, 2004.
