Thomigson, Public V~orks Director ATTACHMENTS: 1) Resolution 2) Vicinity Map RECOMMENDATION: Adopt the Resolution accepting the storm drain through the golf /~ j ,~course and upgrades to existing Fallon Road associated ~with Tract <~ ~ ~l./~' - 7135, Dublin Ranch, Area A FINANCIAL STATEMENT: No Maintenance Bond is necessary for these improvements as the improvements have been operational and available for public use for more than one year. Once these improvements have been accepted, the City will incur on-going maintenance costs for the storm drain through the golf course and for existing Fallon Road. DESCRIPTION: On July 17, 2001, the City Council authorized the Mayor via Resolution No. 126-01 to execute seven separate Tract Developer Agreements with Toll CA II, L.P., for improvements associated with Dublin Ranch, Area A (Tract 7135), to govern the following: 1) Bulk grading for Phase I, Tract 7135 2) Storm drain through the golf course 3) Street improvements for Fallon Road and Bent Tree Drive 4) Traffic signals on Fallon Road 5) Upgrades to existing Fallon Road 6) Landscaping 7) Rough grading and erosion control for Neighborhoods A-6 (Tract 7141) and A-7 (Tract 7142) Of these seven agreements, the developer has completed work governed by four agreements: the bulk grading for Phase I, the rough grading and erosion control for Dublin Ranch :Areas A-6 and A-7, the storm drain through the golf course, and upgrades to existing Fallon Road. The bulk grading work for Phase I and the rough grading and erosion control work for A-6 and A-7 were accepted by the City Council via Resolution No. 85-03 on May 20, 2003. The storm drain through the golf course and the upgrades to existing Fallon Road are now ready for acceptance by the City. The work governed by the remaining three agreements is currently underway and nearing completion. COPIES TO: H. One easement extends across Parcel C of Tract 7135, a parcel subsequently subdivided to create land for the 11th, 12th and 13th golf course fairways. This new storm drain captures the rainwater that historically flowed off the Fallon Enterprises, Inc., property just east of Tract 7135 and conveys it to a storm pipe network in Bent Tree Drive. The other easement extends across Parcel E of Tract 7253 and conveys storm water from future Neighborhood A-3 (Tract 7138) through a pipe beneath the 15th and 16th fairways to Fallon Road. The upgrades to existing Fallon Road included widening of the pavement and new pavement markings between Neighborhood A-7 and Interstate 580. Prior to these upgrades, Fallon Road was a narrow two- lane County road serving several agricultural home sites north of the freeway. The road now provides direct freeway access to all of the neighborhoods currently occupied or under construction in Dublin Ranch, Area A. The storm drain through the golf course, and the upgrades to existing Fallon Road have been constructed pursuant to the two applicable Tract Developer Agreements and to the satisfaction of the City Engineer. Said work should now be accepted by the City for permanent maintenance. The remaining work associated with Tract 7135 will continue to be governed by the pertinent three Tract Developer Agreements until said work is deemed complete and accepted. At the time that the City and Toll CA II, L.P., executed the two separate Tract Developer Agreements governing the storm drain through the golf course and the upgrades to existing Fallon Road, the developer provided bonds as follows: a Performance Bond in the amount of $239,570 and a Labor and Materials Bond in the amount of$119,785 for storm drain through the golf course, and a Performance Bond in the amount of $453,460 and a Labor and Materials Bond in the amount of $226,730 for upgrades to existing Fallon Road to guarantee performance of the ~vork. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code. Staff recommends that the City Council adopt the Resolution accepting the storm drain through the golf course and the upgrades to existing Fallon Road associated with Tract 7135, Dublin Ranch, Area A. RESOLUTION NO. - 03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTANCE OF STORM DRAIN THROUGH THE GOLF COURSE AND UPGRADES TO EXISTING FALLON ROAD FOR TRACT 7135 (DUBLIN RANCH, AREA A) WHEREAS, the subdivider of Tract 7135, filed on August 10, 2001, in Book 259 of Maps at Pages 57 - 63, previously entered into seven Tract Developer Agreements with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the City Engineer, said Tract identified as follows: a) Subdivider: Toll CA II, L. P. b) Tract Location: Fallon Road c) Tract Size: 202 Single-Family Lots, Golf Course, Open Space d) Resolution Approving Agreement: No. 126-01, City of Dublin City Council e) City Streets Affected: None WHEREAS, the Bulk Grading for Phase I of Tract 7135, and the Rough Grading and Erosion Control improvements for Neighborhoods A-6 and A-7, as governed by two of the seven Tract Developer Agreements, were completed and accepted by the City Council via Resolution No. 85-03 on May 20, 2003; and WHEREAS, the storm drain through the golf course and the upgrades to existing Fallon Road governed by two of the remaining five Tract Developer Agreements for Tract 7315 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the work governed by the remaining three Tract Developer Agreements is currently underway and nearing completion; and WHEREAS, the original Performance Bonds and Labor and Materials Bonds associated with the storm drain through the golf course and the upgrades to existing Fallon Road can be released in accordance with the authority contained in §66499.7 of the Government Code of the State of California; NOW, THEREFORE, BE IT RESOLVED that: 1. The storm drain through the golf course and the upgrades to existing Fallon Road completed within said Tract are hereby approved and accepted; and 2. The original storm drain Performance Bond issued by The Continental Insurance Company (Bond No. 929200649) in the amount of $239,570.00 be released; and 3. The original storm drain Labor and Materials Bond issued by The Continental Insurance Company (Bond No. 9292000649) in the amount of $119,785.00 be released; and 4. The original Fallon Road Performance Bond issued by The Continental Insurance Company (Bond No. 929178472) in the amount of $453,460.00 be released; and 5. The original Fallon Road Labor and Materials Bond issued by The Continental Insurance Company (Bond No. 929178472) in the amount of $226,730.00 be released.
