Thompson, Public Works Director ATTACHMENTS: 1) Resolution 2) Vicinity Map RECOMMENDATION: Adopt Resolution accepting the improvements for the widening of Amador Valley Boulevard and approving the traffic control devices  installed as part of the Armstrong Garden Center project FINANCIAL STATEMENT: Armstrong Garden Centers has provided a Maintenance Bond in the amount of $69,750.00 to guarantee against any defects in the improvements to Amador Valley Court. Once these improvements have been accepted, the City will incur maintenance costs for City street improvements. The comer landscape feature will be owned and maintained by Armstrong Garden Centers via an Agreement for Long Term Encroachment approved on December 18, 2002. DESCRIPTION: The Armstrong Garden Center project is a retail garden center located at the northwest comer of Amador Valley Boulevard and San Ramon Road. The project included widening the north side of Amador Valley Boulevard and installing landscaping along the project frontage. In addition to the road widening and frontage landscaping, the developer also installed a comer landscape feature that included a fountain, seat wall, and accent paving in the public right-of-way at the comer of Amador Valley Boulevard and San Ramon Road. The comer landscape feature will be owned and maintained by Armstrong Garden Centers pursuant to an Agreement for Long Term Encroachments approved via City Council Resolution No. 16-03 on February 4, 2003. All required street improvements have been constructed pursuant to the Improvement Agreement and to the satisfaction of the Director of Public Works, and it is now appropriate for these improvements to be accepted by the City for permanent maintenance. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: COPIES TO: Monte Enright, Armstrong Garden Centers ITEM NO. G:~DEVELOP\Armstrong Garden\agstacpt imp.doc 'i "No Parking" restriction has been installed along the north side of Amador Valley Boulevard from' San Ramon Road to the westerly property line. Armstrong Garden Centers provided a Performance Bond and a Labor and Materials Bond, each in the amount of $279,000.00, to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond in the amount necessary to guarantee the work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the amount of $69,750.00, which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the Council adopt the resolution accepting the improvements on Amador Valley Boulevard and approving the regulatory traffic control devices installed as part of the Armstrong Garden Center project. Page 2 ~-~ RESOLUTION NO. - 03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTANCE OF IMPROVEMENTS FOR AMADOR VALLEY BOULEVARD (ARMSTRONG GARDEN CENTERS, INC.) AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the additional public right-of-way for Amador Valley Boulevard, in the incorporated territory of the City of Dublin, State of California, to serve the proposed Armstrong Garden Center has been irrevocably dedicated to the public by separate instrument and recorded as Series No. 2003-163331, all in accordance with the Conditions of Approval for a Conditional Use Permit and Site Development Review, City Co(tncil Resolution 166-02 (P.A. 02-009); and WHEREAS, the developer, Armstrong Garden Centers, Inc, a California Corporation, previously entered into an Improvement Agreement with the City of Dublin to construct improvements for the widening of Amador Valley Boulevard in accordance with plans and specifications on file with the City Engineer, said improvements identified as follows: a) Subdivider: Armstrong Garden Centers, Inc., a California Corporation b) Project Location: 7360 San Ramon Road c) Project Size: 30,810 S.F. Retail Garden Center d) Resolution Approving Agreement: 15-03, City of Dublin City Council e) City Streets Affected: Amador Valley Boulevard WHEREAS, the improvements associated with the widening of Amador Valley Boulevard are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the developer has installed certain regulatory traffic control devices as a part of the project improvements; and WHEREAS, the original Performance Bond and Labor and Materials Bond can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance. NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed with said project are hereby approved and accepted subject to a one-year guarantee period; and 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) "No parking" restriction along the north side of Amador Valley Boulevard between San Ramon Road and the westerly proiect boundary. 3. The original Performance Bond issued by Gulf Insurance Company (Bond No. BE2625007) in the amount of $279,000.00 be released; and 4. The original Labor and Materials Bond issued by Gulf Insurance Company (Bond No. BE2625007) in the amount of $279,000.00 be released; and 5. The submitted Maintenance Bond issued by Gulf Insurance Company (Bond No. BE2625007) in the amount of $69,750.00 be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 5th day of August, 2004. PASSED, APPROVED AND ADOPTED this 5th day of August, 2003.
