Acceptance of Street Improvements for Fallon Road and Bent Tree
Drive Associated with Tract 7135, Dublin Ranch, Area A (Toll CA
II, LP, a California Limited Partnership)

FINANCIAL STATEMENT:
Adopt Resolution accepting the street improvements for Fallon
Road and Bent Tree Drive associated with Tract 7135, Dublin
/~Ar~ Ranch, Area A, and approving the traffic control devices
Toll CA II has provided a Maintenance Bond in the amount of
$422,653 to replace the Performance and Labor and Materials
Bonds that guaranteed the street improvements. Said Maintenance
Bond will guarantee against defects for one year. Once these
improvements have been accepted, the City will incur street
maintenance costs. The street light maintenance co~ts will be paid
by the Street Lighting Maintenance Assessment District 1999-1.
DESCRIPTION: On July 17, 2001, the City Council authorized the Mayor, via
Resolution No. 126-01, to execute seven separate Tract Developer Agreements with Toll CA II, LP, for
improvements associated with Dublin Ranch, Area A (Tract 7135), to govern the following:
1) Bulk grading for Phase I, Tract 7135
2) Storm drain through the golf course
3) street improvements for Fallon Road and Bent Tree Drive
4) Traffic signals on Fallon Road
5) Upgrades to existing Fallon Road
6) Landscaping
7) Rough grading and erosion control for Neighborhoods A-6 (Tract 7141) and A-7 (Tract 7142)
Of these seven agreements, the developer has completed work governed by six agreements: the bulk
grading for Phase I, the rough grading and erosion control for Dublin Ranch Areas A-6 and A-7, the
storm drain through the golf course, upgrades to existing Fallon Road, traffic signals on Fallon Road,
and street improvements for Fallon Road and Bent Tree Drive. The bulk grading work for Phase I and

the rough grading and erosion control work for Neighborhoods A-6 and A-7 were accepted by the City
Council Via Resolution No. 85-03 on May 20, 2003. The storm drain through the golf course and the
upgrades to existing Fallon Road were accepted by the City Council via Resolution No. 109-03 on June 3,
2003. The two traffic signals at the intersections of Antone Way/Fallon Road and Bent Tree Drive/Fallon
Road were accepted by the City Council via Resolution No. 182-03 on September 2, 2003. The street
improvements for Fallon Road and Bent Tree Drive are now ready for acceptance by the City. The work
governed by the remaining agreement ~for landscaping is currently underway and nearing completion.
The street improvements for Fallon Road from existing Fallon Road to Antone Way, and for Bent
Tree Drive from Fallon Road to the northerly boundary of Tract 7141 (Neighborhood A-6) have been
constructed pursuant to the applicable Tract Developer Agreement and to the satisfaction of the City
Engineer, and should now be accepted by the City for permanent maintenance. The remaining landscape
work associated with Tract 7135 will continue to be governed by the remaining Tract Developer
Agreement until said work is deemed comPlete and accepted.
The following regulatory traffic control devices will be accepted and approved as part of this project and
added to the City of Dublin Traffic Code:
A. Bent Tree Drive and Fallon Road are each designated as a "Through Street" (Traffic Code
Chapter 6.08).
"No Parking Anytime" restriction has been installed on both sides of Fallon Road'between Antone
Way and existing Fallon Road, and on both sides of Bent Tree Drive between Fallon Road and the
northerly boundary of Tract 7141 (Neighborhood A-6) (Traffic Code Chapter 6.04.250).
At the time that the City and Toll CA II executed the separate Tract Developer Agreement governing the
street improvements for Fallon Road and Bent Tree Drive, the developer provided a Performance Bond
in the amount of $1,690,610 and a Labor and Materials Bond in the amount of $845,305 for the street
improvements to guarantee performance of the work. Now that the work is complete, these bonds may
be released in accordance with the authority contained in §66499.7 of the Government Code. The
developer has provided a Maintenance Bond in the amount of $422,563, which is sufficient to guarantee
the improvements for a one-year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting the improvements for Fallon Road
and Bent Tree Drive associated with Tract 7135, Dublin Ranch, Area Al and approving the regulatory
traffic control devices.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF STREET IMPROVEMENTS FOR FALLON ROAD
AND BENT TREE DRIVE FOR TRACT 7135 (DUBLIN RANCH, AREA A)
AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES
WHEREAS, the subdivider of Tract 7135, filed on August 10, 2001, in Book 259 of Maps at
Pages 57 - 63, previously entered into seven (7) Tract Developer Agreements with the City of Dublin to
improve said Tract in accordance with plans and specificatiOns on file with the City Engineer, said Tract
identified as follows:

WHEREAS, the Bulk Grading for Phase I of Tract 7135 and the Rough Grading and Erosion
Control improvements for Neighborhoods A-6 and A-7, as governed by two of the seven Tract Developer
Agreements, were completed and accepted by the City Council via Resolution No. 85-03 on May 20,
2003; and
WHEREAS, the Storm Drain through the Golf Course and the Upgrades to Existing Fallon Road,
as governed by two of the remaining five Tract Developer Agreements for Tract 7135, were completed
and accepted by the City Council via Resolution No. 109-03 on June 3, 2003; and
WHEREAS, the Traffic Signals at the intersections of Fall°n Road/Bent Tree DriVe and Fallon
Road/Antone Way, as governed by one of the remaining three Tract Developer Agreements for Tract
7135, were completed and accepted by the City Council via Resolution No. 182-03 on September 2, 2003;
and
WHEREAS, the Street Improvements for Fallon Road and Bent Tree Drive governed by one of
the remaining two Tract Developer Agreements for Tract 7135 are complete in accordance with said plans
and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and
WHEREAS, the work governed by the remaining Tract Developer Agreement for landscaping is
currently underway and nearing completion; and
WHEREAS, the-original Performance Bond and Labor and Materials Bond associated With the
street improvements for Fallon Road and Bent Tree Drive can be released in accordance with the authority
contained in §66499.7 of the Government Code of the State of California;

THEREFORE, BE IT RESOLVED that:
The Street Improvements for Fallon Road and Bent Tree Drive completed within said Tract
are hereby approved and accepted; and .
The traffic regulatory devices installed by the developer are hereby included in the City of
Dublin Traffic Code, said regulatory devices to include the following:
a) Bent Tree Drive and Fallon Road are each designated as a "Through Street".
b) "No Parking Anytime" restriction on both sides of Bent Tree Drive between Fallon
Road and Tract 7141 (Neighborhood A-6) northerly boundary.
c) "No Parking Anytime" restriction on both sides of Fallon Road between Antone Way
and existing Fallon Road.
The original Performance Bond issued by The Continental Insurance Company (Bond No.
929200646) in the amount of $1,690,610.00 be released; and
The original Labor and Materials Bond issued by The Continental Insurance Company
(Bond No. 929200646) in the amount of $845,305.00 be released; and
The submitted Maintenance Bond issued by National Fire Insurance Company of Hartford
in the amount of $422,653.00 (Bond No. 929280215) be accepted as security for the
aforesaid one-year warranty period, said period to commence on this date and terminate on
the 18th day of November, 2004.
