Proposed artwork location -main entrance to shopping center RECOMMENDATION: eview the Condition of Approval related to the provision of public art in the Safeway retail development project and provide direction to Staff on implementation of the Condition. FINANCIAL STATEMENT: Safeway budgeted $50,000 for public art. DESCRIPTION: At the March 6 meeting, the City Council considered Site Development Review for the Safeway Inc. retail development on Dublin Boulevard and Amador Plaza Road. The original Conditions of Approval did not include a provision to install public art. After discussion, the Council concurred that Safeway should provide public art in the development. The resulting condition text added to the SDR follows`. Public Art. The applicant/developer shall provide the following public art: (1) a clock tower at the corner of Dublin Boulevard and Amador Plaza Road with public art integrated into the design of the clock tower; and (2) a public art piece at the main project entrance along Dublin Boulevard (and as identified as location for "future public art location" on the approved site plan, labeled Attachment 1) The final design and precise location of the above items shall be subject to the recommendation by the Heritage and Cultural Arts Commission with final approval by a majority vote of the City Council (Attachment 1). In keeping with the artwork selection process established with the Archstone Iron Horse Trail development and the Shops at Waterford, Art Consultant Lynne Baer and City Staff met with Safeway personnel for an initial discussion of the artwork requirements. The text of the condition was reviewed and discussed. At that meeting, Safeway personnel indicated that the total budget for artwork for the project would be $50,000. In Ms. Baer's opinion, a quality clock tower created by an artist of the size most appropriate for the site. could cost $50,000. In order to create a work that was visually exciting and commanding, Safeway concurred with Ms. Baer's opinion and decided to commit the funds to providing a COPIES TO: Lynne Baer Heritage & Cultural Arts Cornxnission Safeway ITEM NO. Attachments 2 and 3-A is a photograph of the proposed clock tower location at the corner of Dublin Boulevard and Amador Plaza Road. As the photograph indicates, the location provides a commanding view from the intersection into the shopping center. Because the site is flanked by tall light standards, a substantial piece of artwork would be needed. At a subsequent meeting with Safeway personnel and Staff, Ms. Baer presented seven artists who work in a variety of media and styles from traditional to contemporary. Safeway personnel unanimously selected one artist whose work embodies the aesthetic qualities that represent Safeway's corporate design objectives as well as the contemporary and future oriented philosophy of the community of Dublin. In developing the design of the clock tower, the selected artist met with City Planning Staff and reviewed the proposed downtown improvements, met with the artists for the Freeway Underpass Art Project to discuss their design and studied the Safeway building and landscape plans. The artist incorporated aspects of each project into the proposed clock tower. Safeway corporate personnel reviewed and approved the artist's preliminary design. The artist is currently working on a model of the proposed design. Due to the fact that the proposed artwork project is not in keeping with the conditions of the SDR, i.e. only the clock tower is being proposed, .Staff requests that the City Council clarify the condition before Safeway confirms a contract with the artist and the design is brought before the Heritage and Cultural Arts Commission and the City Council for review and approval. A secondary work of art at the main entrance was identified in the SDR. The site identified as a location for future public art on the approved site plan is illustrated in Attachments 3 and 4-B. Due to adjustments in the field which allowed for the relocation of the monument sign from the`corner to the main entrance, the Art Consultant identified the 9 foot in diameter circle situated at the confluence of the City sidewalk along Dublin Boulevard and the walkway leading to the store as a probable location of the secondary work of art (Attachments 3 and 4-C). To the left of the circle is the 6-foot high monument sign..for the shopping center and to the right adjacent to the'circle is a flagpole. In the opinion of the City's Art Consultant, the most appropriate artwork for this location would be one that could be imbedded flat into the concrete circle using media such as tile, terrazzo stone or brass. The budget for. such a work could be in the $10,000 to $15,000 range not including .demolition of the existing concrete if necessary. According to Ms._Baer, if a tall vertical work were selected, stainless steel, painted steel or aluminum would be the most likely medium. The budget for such a vertical work would be in the $20,000 to $25,000 range.. This would include engineering and installation requirements. The cost of a secondary work was not included in the total $50,000 Safeway art budget. Approval. Approval of the Site Development Review is valid PL BP for one (1) year, until March 6, 2002. If construction has not commenced by that time, this approval shall be null and void. The approval period maybe extended for six (6} additional months by submitting a written request for extension prior to the expiration date to the Community Development Director. Any extension will be based on a determination that the conditions of approval remain adequate to assure that the stated fin ' sofa royal will continue to be met 2. Building Permits. To apply for building permits, B Issuance of Standard ' Applicant/Developer shall submit twelve (12) sets of Building Permits construction plans to the Building Department for plan check. Each set of plans shall have attached an annotated copy of these Conditions of Approval. The notations shall clearly indicate how all Conditions of Approval will or have been complied with. Construction plans will not be accepted without annotated resolutions attached to each set of plans. Applicant/Developer will be responsible for obtaining the approvals of all participating non-City agencies prior to issuance of buildin ermits. 3. Public Art. The applicant/developer shall provide the City Issuance of Misc. following the public art: (1) a clock tower at the corner of Council Building Permits Dublin Blvd. and Amador Plaza Rd., with public art integrated into the design of the clock tower; and {2) a public art piece at the main project entrance along Dublin Blvd.. (and as identified as location for `future public art location' on the approved site plan, labeled Attachment 1). The final design and precise location of the above items shall be subject to recommendation by the Heritage and Cultural Arts Commission with final approval subject to approval by a ma'ori vote of the Ci Council. 4. Standard Public Works Conditions of Approval. PW Approval of Standard Applicant/Developer shall comply with all applicable City of Improvement Dublin Standard Public Works Conditions of Approval . Plans through (Attachment A). In the event of a conflict between the completion Standard Public Works Conditions of Approval and these Conditions, these Conditions shall revail.
