The City currently has a $407,010 surity bond which will be relinquished when the maintenance bond is received. Creek maintenance costs will be incurred by the City. Sufficient funds are available in Fiscal Year 2001-02 to assume the maintenance of these improvements. DESCRIPTION: The dedication of the Creek area Parcel to the City together with improvements was conditioned as part of the approval of Dublin Ranch Tract Map 6960. The improvements were further outlined in September 2000, in the City Council approved Improvement Developer Agreement between the City and MSSH Dublin Development, LLC (developer) to construct the Creek in the Dublin Ranch Phase I Development adjacent to Ted Fairfield Park. The improvements include the landscaping of a "stream corridor" that was part of a larger development mitigation project. This corridor fronts two sides of the Ted Fairfield Park to the north and east. The Developer has constructed the creek improvements which include; irrigation, slope stabilization, creek bed flow control elements such as check dams to resist erosion, and planting to the satisfaction of City Staff. The improvements are now complete. The City presently holds a performance bond in the amount of $407,010 to provide the necessary security for the performance of the work involved. As the work is now completed, the performance security requirement can be reduced, in accordance with authority contained in Section 66499.7 of the Government Code, to an amount necessary to guarantee warranty of the work for a one-year period following acceptance of the work. The Developer may provide a new maintenance bond in the amount of $101,753 COPIES TO: Shea Homes, Inc. H:\ConniekFirfield creek acceptance .doc ITEM NO. which is 25% of the original bond required, and which is sufficient to cover the one-year guarantee period, or may leave the performance bond in place. RECOMENDATIONS: Staff recommends that Council adopt the Resolution to accept the dedication of land and improvements completed in the creek associated with the Dublin Ranch Development, and authOrize Staff to accept a maintenance bond in the amount of $101,753 at a future date. -2- RESOLUTION NO. - 02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING CREEK IMPROVEMENTS AND DEDICATION OF PARCEL "C", TRACT 6960 WITHIN DUBLIN RANCH PHASE 1 .WHEREAS, the owner-subdivider of Tract 6960 previously entered into a contract with the City of Dublin to improve the section of creek fronting Ted Fairfield Park in accordance with plans and specifications on file with the City Engineer and dedicate 1.97 acres of Creek parcel, Parcel "C" of said Tract 6960 identified as follows: a) Subdivider: b) Parcel Location: c) Resolution Approving Final Map: d) City Streets Affected by this Parcel: MSSH Dublin Development LLC Northeast comer of North Dublin RanCh Drive and Antone Way No. 40-99, City Council of Dublin None WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the ' City of Dublin; and WHEREAS, as a condition of said contract, subdivider is required to guarantee the improvementg for a period of one year following acceptance of the work by the said City of Dublin; and WHEREAS, as improvements are now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, to an mount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period; and WHEREAS, the Final Map for Tract No. 6960, in the incorporated territory of the City of Dublin, County of Alameda, State of California, was accepted by the City Council on March 16, 1999, all in accordance with the provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, MSSH Dublin Development LLC, has made an offer of dedication to the City of Dublin Parcel "C" of Tract 6960, which encompass the Creek area adjacent to the Ted Fairfield Park; NOW, THEREFORE, BE IT RESOLVED that: The improvements completed within the said Creek parcel be, and they are hereby approved and accepted subject to the aforesaid one-year guarantee; and Attachment 1 1 o ATTEST: The aforesaid original performance bond security requirement may be reduced from the amount of $407,010 to an amount of $101,753, upon acceptance by Staffofthe rePlacement maintenance bond as security for the aforesaid one-year maintenance period; and The said original performance bond in the amount of $407,010 posted in connection with the work involved in the construction of said Tract be hereby released upon acceptance of said maintenance bond. The said Parcel "C" of Tract 6960 as offered to the public is hereby accepted; and that the Clerk of this City Council be and is hereby directed to transmit a certified copy of this resolution to the County Recorder for filing.
