Their bid was found to be non responsive as they could not fulfill the bonding requirements of the bid proposal. The next lowest responsible bidder was Agati Furniture at $480,909. DESCRIPTION: The City Council authorized the Requests for Bids for the Civic Center Library Furniture at the July 2, 2002 Council meeting. The Library Furnishings Request fOr Bid is the first of two furniture packages for the Library. This package consists of all of the reading tables, web- pac stations, circulation desk, reference desk, seating and lounge chairs for the library's public spaces. Council requested that recycled materials be considered if possible and available. Consequently, as part of the bid requirement Staff requested a separate breakdown of cost, if any, to manufacture the furnishings in line with Green Building practices. Agati Furniture provided a break down of their current environmental manufacturing standards (Attachment 3). As the furniture that the City specified utilizes the materials outlined in Agati's standards the product the City will be receiving does fulfill the green building intent. Specifically; Agati will manufacture the furniture for the City of Dublin's Library Project using domestic /reforested / non-endangered maple solids and veneers. Core substances will be made of low formaldehyde particle material. The topcoat will utilize a VOC varnish, reducing the amount of off gassing in the finishing process. Inserts on tables and carrels will be made ofForbo Marmoleum, a naturally green product that is COPIES TO: Agati Furniture/BSA Architects/Alameda County Library made ofwoodpulp, linsead oil, and jute. The furniture will be shipped in blankets to avoid large amounts of wrapping and boxing materials, which would otherwise have to be disposed of. A protest has been lodged by the low bidder, Interra, Inc. which has been reviewed by the City Attorney.. The City Attorney has found the protest to be invalid and is recommending acceptance of the next low bidder, Agati F umiture. RECOMMENDATION: It is the recommendation of Staff that the City Council take the following action: 1. Adopt Resolution rejecting Interra Inc, as low bidder 2. Adopt Resolution Awarding the Contract to Agati Furniture RESOLUTION NO. - A REsoLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AWARDING CONTRACT NO. 02-11 CIVIC CENTER LIBRARY FURNITURE TO AGATI FURNITURE WHEREAS, the 2002-2003 Capital Improvement program includes funding for the Civic Center Library Project; and WHEREAS, the City sent out a Request for Bids and received 6 responses; and WHEREAS, Agati Furniture, prepared the lowest responsive bid and was determined to be qualified to do the work; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby award Contract No. 02-11 to the lowest responsible bidder therefor, to wit, Agati Furiture, at a base bid of Four Hundred Eighty Thousand Nine Hundred and Nine Dollars ($480,909.00) the particulars of which bid are on file in the office of the City Engineer. PASSED, APPROVED AND ADOPTED, this 6th day of August, 2002. AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk ATTACHMENT 1 RESOLUTION NO.- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN CONTRACT NO. 02-11 CIVIC CENTER LIBRARY FURNITURE REJECTION OF INTERRA, INC. BID AS NON RESPONSIVE WHEREAS, On July 2, 2002, thc City Council authorized the Civic Center Library Furniture to be advertised for bids; WHEREAs, thc project was advertised as required by state law for bids; and WHEREAS, Thc City received five bids prior to the ctosc of bids on July 26, 2002; and WHEREAS, Thc lowest bid received was $462,778 from Interra, Inc.; and WHEREAS, upon staff completing it's evaluation of the bid it was found that Intcrra, Inc was unable to meet thc bonding requirements of thc bid proposal; and NOW, THEREFORE, BE IT RESOLVED that thc City Council of the City of Dublin accepts thc staffrecommcndation to reject thc low bidder and consents to finding Intcrra Inc. non responsive of it's bid dated July 6, 2002, for the Civic Center Library Furniture. In light of global concerns about the environment, developing industry environmental regulations, and the manufacturers' role in environmental and consumer protection, Agati will continue to research viable opportunities for increasingly green production. Currently: · Our Maple, Cherry, Oak, and Beech wood furniture is made from domestic non-endangered wood stock. · Many of our lounge chairs incorporate solid 0SB frames, which are constructed from a high percentage of recycled materials. · Many of our table, carrel and service area designs incorporate Forbo Marmoleum inserts. This excellent natural linoleum product is made of cork, linseed oil, and jute. · Our specifiers often request Pionite Laminate products when incorporating laminate into our furniture designs. Pionite is a leader in developing a green operations policy. · We deliver and install our own projects, which affords Agati greater control over shipment waste. When delivering and installing projects, Agati blanket wraps as much of the furniture as possible. This practice greatly reduces the amount of cardboard and foam packing materials needed, and minimizes the burden of local refuse retrieval at the project site. The shipping blankets are re-used project after project. When cardboard and foam packing materials are needed, they are made of recycled materials, and are re-used whenever possible. · We manufacture our product on a project only JITM basis. We therefore do not produce or warehouse an inventory of unneeded products and materials. I have checked the status of Agatis contractors bond, currently Agatis does not hold a valid state contractors license, consequently their bid will have to be rejected as well. Any bidder must hold the valid contractors license issued in the of the bidder at the time of bidding At this time it may be in the best interest of the City of Dublin to reject all bids and re-bid. This based on the fact that the mandatory job walk was changed from being a mandatory to advisable after the date of the mandatory job walk It is of course not possible to reverse what was stipulated as mandatory after the fact. We hereby officially protest the executing of the bid 02-11 and demand the re-bid. The reasons for your protest dated July 29, 2002 do not invalidate the bid submitted by Agati. For instance, this procurement relates to the purchase of library furniture. It is not a public works project as defined by the Public Contract Code. As such, a contractor's license is not required under Cal. Business & Prof. Code Section 7052. Moreover, the City properly issued a bid addenda advising all bidders that the walk through was no longer mandatory. The addenda was issued well in advance of the bid-opening date. Frankly, we do not see how the City's modification of a walk through requirement served to provide an unfair advantage'to the apparent low bidder. Based on the foregoing, we will abide by our decision to recommend award of the contract for Bid 02-11 to Agatl, who is the apparent lowest responsive bidder.
