DESCRIPTION: Trumark Companies is requesting initiation of a General Plan Amendment Study for an approximate 19- acre parcel located on the abandoned railroad right-of-way and on County of Alameda lands adjacent to the Iron Horse Trail (Attachment 2). This land is currently part of a designated circulation corridor in the City of Dublin's General Plan Land Map (Attachment 3). G :\Agcndas\2002\Trumark I COPIES TO: iTEM NO. Applicants In-House Distribution The proposal is to amend the General Plan to allow for a residential development on the 19 acres. The proposed General Plan Designation is for Medium High Density Residential. This would allow for a residential development between 268 units to 475 units. Nearby uses include Dublin High School and residential development. Issues Relating to Proposed Project: There are several substantive issues that Staff has identified on this project. Prior to the City Council authorizing Staff to add this project to their work program, these issues should be explored further by the Applicant and viable solutions identified. These issues are: Access: At present there is one point of access for the site. This would result in a cul-de-sac type of development serving between 268 and 475 units. Public safety regulations and experience in disasters requires that there be at least two public or private access roads for any development exceeding 75 units. Staff has discussed this issue with the Applicant. Trmnark has indicated that they are addressing this issue and are exploring several viable alternatives. However, no proposal has been presented with Trumark's current request. In the City of Dublin, the only access that would be possible would involve removing houses from an existing neighborhood to provide a roadway connection or providing access through Stagecoach Park. In the alternative, the Applicant could secure access through the City of San Ramon. If this alternative was secured, studies would have to be performed relating to response times for public safety access to determine if this would be in accordance with City standards. Staff recommends that the Applicant include a viable solution to this issue prior to the City Council authorizing staff to work on the Study. ° Parks: If the City wants to consider the approval of infill housing sites such as this project and others that are currently contemplated, the impact of this housing on the existing park acreage will need to be considered. Although the City has a public facilities impact fee, adequate park sites to serve the residents of this project as well as the surrounding area must be provided. The City is currently preparing a major update to its Park Master Plan. The site proposed for this Study will also be evaluated by the Park Master Plan to determine its suitability for a park adjacent the Iron Horse Trail with a connection to the Stagecoach Park. Additionally, the City Attorney has reviewed the letters submitted by Alameda County Public Works in support of Trumark's proposal and has opined that State law requires that the County offer the land to the City for park purposes prior to entering into contracts with private entities. Staff has prepared a letter to Alameda County addressing this issue (Attachment 6). This issue will need to be discussed with Alameda County and should occur prior to the City authorizing work on a General Plan Amendment Study to change the property to a residential designation. Staff recommends that the Park Master Plan be completed and discussions with Alameda County occur on the land acquisition issue prior to the City Council authorizing the City to authorize work on this Study. It is anticipated that the Park Master Plan will be completed by the end of this year. Location of Major Infrastructure Lines: There are several existing and planned major infrastructure lines under the two properties. Along the Southern Pacific right-of-way is a major fiber optics line. This fiber optics line would have to be relocated on to the County property in order to build the housing units. In the County property there is an existing high-pressure jet fuel line and a planned recycled water pipeline for the Dublin San Ramon Services District and East Bay Mud Recycled Water Authority (DERWA) San Ramon Valley Project. The location of these infrastructure lines will have an impact on the street layout and lot configuration. The most costly line to move is the high-pressure jet fuel line. If the developer were to keep the line at its present location, it would set the street location behind the existing homes on Stagecoach, Turquoise and North Lake. Land Use Compatibility: Should this change in General Plan Land Use Designation be ultimately approved, the proposal would add a significantly denser development adjacent to existing single- family residential development. It is likely that the housing units will be a variety of single story, two-story and three-story detached and attached units. The location of the new housing units would likely result in a change in the feel and privacy of the rear yards of existing residences. Additionally, if the street were to run along the rear property lines of the existing homes along Stagecoach, Turquoise, and North Lake, this would create "through lots." These are lots that have street frontages along the front and rear of the property. This type of street configuration results in more noise, dust and creates a "back-door" look to the new street, i.e. a view of fences from the street. Generally, city planning principles encourage cities to avoid this type of lot configuration for the reasons mentioned above. General Plan Conformity: State law requires that the County ask for a General Plan Conformity determination from the City prior to selling or developing any surplus property. The City has not yet received proper notice of the sale or the request for a general plan conformity determination (see Attachment 5). Prior to the City authorizing the initiation of a General Plan Study on this property, the appropriate information should be given to the City from the County and the Planning Commission should take action on the General Plan Conformity determination. Allocation of Staff Time: The following table outlines the ambitious Community Development Department Staff Work Program for FY 2002/2003. This list also includes major current planning projects that require a substantive amount of staff time to process. In addition to the items listed on the Work Program, it should be noted that the City Council has also authorized the following General Plan Amendment Studies: Valley Christian Center GPA Ikea GPA, SPA, PD, SDR Community Facilities Study Dublin Ranch Area F The Bancor Alcosta Project Site 15A The Bancor Pak &Sav Project The addition of more items to Staff's Work Program will likely delay other projects that are high priorities of the City Council. Based on the analysis above, there are many issues that could be resolved prior to authorizing Staff to work on this Study. Public Notice: Staff identified more than 900 residential dwelling unitS that may be impacted by this development. Although this item is not a public hearing, Staff sent notice to all properties within 300 feet of the project site. Conclusion: Staff is recommending that this item be either continued to a date uncertain when many of these issues are worked out or the request be denied. However, if the City Council approves the initiation of the proposed General Plan Amendment Study, Staff would work with the Applicant on the issues identified above, as well as: Evaluate the provision of services, police, fire, parks, etc. for new residents in this area; Investigate other agency plans for possible use of the abandoned right-of-way; Provision of adequate infrastructure; and Prepare an environmental document Staff has included both approval and denial resolutions for the City Council's evaluation. Recommendation Staff recommends that the City Council receive the staff presentation and public testimony; question staff and the public and either: a) continue item to a date uncertain; b) adopt a Resolution denying request; or c) adopt a Resolution approving request. July 31, 2002 To: Honorable Mayor Janet Lockhart and Members of City Council 100 Civic Plaza Dublin, California 94568 Re: General Plan Amendment Study Request Union Pacific Railroad and County of Alameda Parcels Approximately 19 Acres Dear Honorable Mayor Janet Lockhart Md Members of City Council, Trumark Companies ("Trumark"), kindly requests consideration of amending the Dublin General Plan in order to accommodate residential and circulation uses within currently designated 'Unclassified' City land use. The subject property is comprised of abandoned railroad right-of-way and County of Alameda lands adjacent to the iron Horse Trail at the extreme North edge of the Dublin City Limits as shown on the attached Site Context Aerial. The property is four parcels - two on the North side of Amador Valley Boulevard (approx. 16.5 acres), and two on the South of Amador Valley Boulevard (approx. 2.5 acres). Union Pacific Railroad Company owns the two largest parcels on the north m~d south side of Amador Valley Boulevard and the County of Alameda owns two smaller parcels, immediately adjacent and on the east side of the Union Pacific Railroad Company parcels. Proposal: Trumark proposes to create a series of residential neighborhOods compatible with existing adjacent residential and regional trail uses as shown on the attached conceptual land-use and circulation diagram. Please note that the land-use and circulation diagram is conceptual and that Trumark's goal is to work with the City and neighbors to ultimately create an appropriate, high-quality, living environment. Additional goals are to provide three housing types, all of an affordable character and value to promote high-density, transit-oriented household development due to the adjacency of the Iron Horse regional trail that provides a direct link to the Dublin BART station. Project Benefits: Medium to High-Density residential development will displace vacant, abandoned railroad right-of-way and appropriately utilize existing unused land by providing needed affordable and moderately affordable households to Dublin. Furthermore, new residential households will raise existing home values in this sector of Dublin. Public pedestrian and bike connections from adjacent neighborhoods will provide easier and safer access across the subject property to the Iron Horse Trail, Dublin High School, and near-by services. Residential use of the property will provide 24-hour surveillance to the currently isolated and difficult to patrol Iron Horse Trail. Furthermore, the vacant parcels are continued weed, fire, litter, and dumping grounds, and are conducive to loitering and safety concerns. Imminent utility projects, such as a reclaimed water line, sewer line and existing petroleum pipeline can be designed, built and coordinated cooperatively to provide protection of existing facilities and ease of maintenance access. Furthermore, development of the property will dramatically improve surface and subsurface drainage patterns due to the uneven nature of the existing abandoned railroad grounds. Current Issues: Access: Currently the site is split by Amador Valley Boulevard, which offers the only existing public right-of-way access opportunity. Trumark is actively working with adjacent landowners, Home-Owners Associations and the City of San Ramon to determine the most appropriate access configuration and to create a secondary full-time access that will allow the Northern project area to be appropriately served at the North end of the property. Similarly, for the property on the south side of Amador Valley Boulevard, Trumark is working with the adjacent Townhome Association to create an Emergency Vehicle Only access. 4 Affordable Housing: Trumark understands the current ordinance and intends to work with the City of Dublin to most effectively fulfill this requirement. Park Land: Due to the long, narrow, and linear nature of this property, Trumark believes active, usable park elements are not physically compatible. Therefore, in Trumark's opinion, the best scenario would be to develop this parcel, as residential, and possibly allow Trumark's fair-share of park dedication value to be credited for the development of park facilities in the adjacent Dougherty Hills (undeveloped) City Park. The ultimate design will promote connectivity from adjacent neighborhoods and public park facilities to the highly used Iron Horse Trail. Neighbors: As indicative of Tmmark's philosophy and of all in-fill developments, Trumark will work to build consensus among all adjacent neighbors by identification and gaining an understanding of all issues and concerns with the objective of creating an appropriate, coordinated, and safe development. Tmmark looks forward to working with the City of Dublin to create a win-win development scenario for this abandoned land. Fenstermacher Chief, Real Estate Division County of Alameda Public Works Agency 399 Elmhurst Street Hayward, CA 94544-1395 Re: Proposed Sale of County-Owned Property in the City of Dublin General Plan Conformity Request Dear Mr. Fenstermacher, On August 15, 2002, Garret Hinds of the Trumark Companies faxed the City a copy of a letter from you to the Dublin Planning Commission, dated June 12, 2002, concerning the County's proposed sale of property along the former Southern Pacific right-of-way within the City of Dublin. The letter requests that your office be advised, pursuant to Government Code section 65402, within 40 days whether or not a proposed sale is in conformity with the City's general plan. The City has no record of receiving your June 12, 2002 letter. None of the Planning Commissioners recall receiving the letter, and my staff and I had not seen the letter before August 15, 2002. Thus, the County did not "submit" general-plan conformance question to the Planning Commission as required by Government Code section 65402(b). In addition, even assuming the letter was submitted to the Planning Commission sometime in June, the letter did not provide the City with sufficient detail to make the general-plan conformity determination. Govemment Code section 65402 requires the County to submit to the Planning Commission "the location, purpose and extent" of the County's proposed disposition of real property. Your June 12 letter did not specify the purpose for which the property would be used and the purpose for which the property was being disposed. Thus, the County did not "submit" the proposed sale to the Planning Commission as required by Government Code section 65402(b). Thus, since the issue was not properly presented to the Planning Commission, the County must resubmit to the Planning Commission the location, purpose and extent of the proposed sale for a determination of conformity of the proposed sale with the City's general plan. The property in question is along the former Southern Pacific dght of way in the City of Dublin. The County proposes to sell the surplus property to the Trumark Companies. As you will recall, the letter gave the consent of the County, as the property owner, to a general plan amendment study that Trumark has requested the City perform. The purpose of this letter is to advise the County of the requirements of Government Code section 54222. That section provides generally that public agencies, including the County, are required, prior to disposing of surplus land, to send a written offer to sell or lease the surplus property for specific purposes to various agencies that might use the property for such purposes. These purposes include the development of Iow- and moderate- income housing; park and recreational purposes; school facilities construction or use by a school distdct for open space purposes; and several other purposes related to economic development. (Govemment Code sect. 54222.) If an agency receiving such notice wishes to pumhase the surplus property for any of these purposes, the agency must notify the disposing agency within 60 days of the offer of its intent to purchase the property. The parties must then enter into good-faith negotiations to attempt to determine a satisfactory sales price. The City may be interested in purchasing the County's surplus property for park and recreational purposes. As the City is one of the parks and recreation agencies to which section 54222 requires that offers be given, the County should, prior to disposing of the property, provide the City with an offer to sell the property for park and recreational purposes pursuant to section 54222. NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Dublin does hereby deny the initiation request for a General Plan Amendment Study for the 19-acre site adjacent the Iron Horse Trail. PASSED, APPROVED, AND ADOPTED BY the City Council of the City of Dublin on this 1 st day of October 2002, by the following votes: AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk G:\AgendasX2002\ccTrumarkreso2.doc ATTACHMENT 7 RESOLUTION NO. - 02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING THE INTIATION OF A GENERAL PLAN AMENDMENT STUDY FOR THE 19 ACRE SITE DESIGNATED TRANSPORTATION CORRIDOR ON THE ABANDONED RAILROAD RIGHT-OF-WAY AND ALAMEDA COUNTY LAND WHEREAS, a General Plan Amendment Study has been requested by Trumark Companies and Alameda County for the 19-acre site designated Transportation Corridor located along the Iron Horse Trail from the Contra Costa County boundary until approximately 500 feet south of Amador Valley Boulevard; and WHEREAS, a General Plan Amendment to allow a change in land uses would be required to allow the change from transportation corridor to a high density residential land use; and WHEREAS, additional entitlements including zoning, site development review and other associated permits would need to be processed before development could occur; and WHEREAS, the initiation request has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15306, Class 6 of the State CEQA Guidelines; and WHEREAS, the staff report submitted one recommendation that the City Council approve the initiation of a General Plan Amendment Study for the proposal; and WHEREAS, the City Council did hear and consider all such reports, recommendations, and testimony hereinabove set forth and supports the initiation of a General Plan Amendment Study for the 19-acre site. NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Dublin does hereby approve the initiation request for a General Plan Amendment Study for the 19-acre site adjacent the Iron Horse Trail.
