(d.b.a. Home Finishes) Report Prepared by: Lee S. Thompson, Public Works Director ATTACI-IMENTS: 1) Resolution 2) Vicinity Map RECOMMENDATION: _ t,~ Adopt the Resolution accepting the improvements for Parcel Map S~TE 6985 and accepting a Maintenance Bond in the amount of $30,538. FIt~ANCIAL MENT: Perfect Service Builders, Inc, (d.b.a. Home Finishes) has provided a Maintenance Bond in the amount of $30,538 to guarantee against defects for one year. Once these improvements have been accepted, the City will incur maintenance costs for sweeping, street lighting and other street maintenance. DESCRIPTION: Parcel Map 6985 project is located at the west end of Hansen Drive, and consists of 3 custom home residential lots. The improvements included construction of a new cul-de- sac bulb, underground utilities, a streetlight and a fire hydrant. These improvements have been constructed pursuant to the Tract Developer Agreement and to the satisfaction of the Director of Public Works. At the time the City and Perfect Service Builders, Inc. executed the contract for the tract improvements, the developer provided a Performance Bond in the amount of $122,150 and a Labor and Materials Bond in the amount of $55,825 to guarantee performance of the work. Now that the work is complete, the bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond in the amount necessary to assure maintenance of the improvements for one-year period following acceptance of work. The developer has provided a Maintenance Bond in the amount of $30,538, which is 25% of the original Performance Bond amount, and which is sufficient to guarantee the one-year maintenance period upon acceptance. Staff recommends that the City Council adopt the Resolution to accept the improvements associated with Parcel Map 6985. Builders, COPIES TO: Darryl Phelps of Perfect Service ITEM NO. G:\DEVELOP\Canessa_PSBIXAgstacpt_6985.doc RESOLUTION NO. - 02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING IMPROVEMENTS FOR PARCEL MAP 6985 (CANESSA PROPERTY) WHEREAS, the subdivider of Parcel Map 6985, filed on October 14, 1998 in Book 243 of Parcel Maps at Pages 3 - 4, previously entered into an agreement with the City of Dublin to improve said subdivision in accordance with plans and specifications on file with the City Engineer, said subdivision identified as follows: a) Subdivider: Perfect Service Builders, Inc. (d.b.a. Home Finishes) b) Subdivision Location: West End of Hansen Drive c) Subdivision Size: 3 Custom Home Residential Lots d) Resolution Approving Agreement: 124-98, City of Dublin City Council e) City Streets Affected: Hansen Drive WHEREAS, the improvements associated with Parcel Map 6985 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the original Performance Bond and Labor and Materials Bond can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced Witha Maintenance Bond to guarantee maintenance of the completed work for the aforesaid one-year period. NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements comPleted within said Parcel Map are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Performance Bond issued by Insurance Company of the West (Bond No. 1374508) in the amount of $122,150.00 be released; and 3. The original Labor and Materials Bond issued by Insurance Company of the West (Bond No. 1374508) in the amount of $55,825.00 be released; and 4. The submitted Maintenance Bond issued by Insurance Company of the West (Bond No. 137508-1) in the amount of $30,538.00 be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on 5th day of November, 2003.
