SUBJECT: Acceptance of Improvements, Tract 7022,
Tassajara Meadows II, (Mission Peak Homes, Inc.)

FINANCIAL STATEMENT: Mission Peak Homes, Inc. has provided Maintenance Bonds in
the mount ~of ~;273,008 for onsite improvements and $533,095 for
Gleason Drive and Tassajara Road improvements for a total amount
of $806,103 to guarantee against defects for one year. Once these
improvements have been accepted, the City will incur maintenance
and street sweeping costs for Tassajara Road and Gleason Drive.
The City will also incur costs for maintaining the median island
landscaping on Gleason Drive between Creekview Drive and
Tassajara Road. Street light maintenance costs shall be paid by
the Citywide Street Light Maintenance Assessment District 83-1.
DESCRIPTION: The Tassajara Meadows II (Tract 7022) development, located at the
northwest comer of Gleason Drive and Tassajara Road, included 95 single-family residential units with
private streets and courts. Improvements consisted of project fi'ontage improvements on Tassajara Road,
on Gleason Drive from the west side of Tassajara Creek to Tassajara Road, and internal private streets,
including streetlights, sidewalk, utilities, signing, striping, soundwall, curb, gutter, drainage and
landscaping improvements. This project also installed public landscaping, in the median island on
Gleason Drive: These improvements have been constructed pursuant to the Tract Developer Agreement
and to the satisfaction of Director of Public Works.
The following regulatory traffic devices will be accepted and approved as part of this project and added to
the City of Dublin Traffic Code:

A. Arellano Court, Borica Court, Cermenho Court, Escudo Court, Font Court, Gallaup Court,
Gambon Court, Heceta Court, Kino Court, Magellan Court, Martinez Court, Ordaz Court,
Preciado Drive, Sal Court, Salvatierra Court, San Viciente Loop and San Viciente Terrace are
designated as "Private Streets."
B. Gleason Drive is designated as a "Through Street." (Traffic Code Chapter 6.08),
C. No Parking Restriction on Tassajara Road betweenGleason Drive and the northerly tract
boundary, and on Gleason Drive between Tassajara Creek Bridge and Tassajara Road (Traffic
Code Section 6.28.010).
At the time the City and Mission Peak Homes, Inc., executed the contract for tract improvements, the
subdivider provided a Performance Bond in the amount of $1,092,030 and a Labor and Materials Bond
in the amount of $546,015 to guarantee the onsite improvements, and a Performance Bond in the amount
of $2,132,380 and a Labor and Materials Bond in the amount of $1,066,190 to guarantee the Gleason
Drive/Tassajara Road improvements. Now that the work is complete, the bonds may be released in
accordance with authority contained in §66499.7 of the Government Code, and replaced with
Maintenance Bonds in the amount necessary to guarantee against defects for a one-year period following
acceptance of the work. The developer has provided Maintenance Bonds in the amount of $273,008 for
onsite improvements and $533,095 for the Gleason Drive/Tassajara Road improvements for a total of
$806,103, which is 25% of the original Performance Bond amounts, and which is sufficient to guarantee
the one-year period upon acceptance.
Staffrecommends that the City Council adopt the resolution accepting improvements and approving
regulatory traffic control devices installed for Tract 7022, Tassajara Meadows II.
RESOLUTION NO. - 02
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF IMPROVEMENTS, TRACT 7022
(TASSAJARA MEADOWS II, MISSION PEAK HOMES, INC.)
AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES
WHEREAS, the subdivider of Tract 7022, filed on September 21, 1999 in Book 248 of Maps at
Pages 18 - 22, previously entered into an agreement with the City of Dublin to improve said Tract in
accordance with plans and specifications on file with the City Engineer, said Tract identified as follows:
a) Subdivider: Mission Peak Homes, Inc.
b) Tract Location: Northwest comer of Tassajara Road and
Gleason Drive
c) Tract Size: 95 Single-Family Lots
d) Resolution Approving FinaI Map: No. 163-99, City Council of Dublin
e) City Streets Affected: Tassajara Road, Gleason Drive
WHEREAS, said improvements associated with Tract 7022 are complete in accordance with said
plans and specifications, and any approved modifications thereof, to the satisfaction of said City Engineer;
and
WHEREAS, the developer has installed certain traffic regulatory devices as a part of the Tract
improvements; and
WHEREAS, the original Performance Bonds and Labor and Materials Bonds can be released, in
accordance with the authority contained in §66499.7 of the Government Code of the State of California,
and replaced with Maintenance Bonds to guarantee the completed work for a one-year period following
acceptance.
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed on Gleason Drive, Tassajara Road and within said Tract are
hereby approved and accepted subject to a one-year guarantee period; and
2. The traffic regulatory devices installed by the developer are hereby included in the City of
Dublin Traffic Code; said regulatory devices to include the following:
a) Arellano Court, Borica Court, Cermenho Court, Escudo Court, Font Court,
Gallaup Court, Gambon Court, Heceta Court, Kino Court, Magellan Court,
Martinez Court, Ordaz Court, Preciado Drive, Sal Court, Salvatierra Court, San
Viciente Loop and San Viciente Terrace are designated as "Private Streets."
b) "No Parking Anytime" restriction on the west side of Tassajara Road, between
Gleason Drive and the northerly boundary of the Tract,

c) "No Parking Anytime" restriction on the north side of Gleason Drive between
Tassajara Creek Bridge and Tassajara Road; and
3. The original Performance Bonds issued by Insurance Company of the West in th~ amount
of $1,092,030.00 (Bond No. 1674497) and in the amount of $2,132,380.00 (Bond No.
1238759) be released; and
4. The original Labor and Materials Bonds issued by Insurance Company of the West in the
amount of $546,015.00 (Bond No. 1674497) and in the amount of $1,066,190.00 (Bond
No. 1238759) be released; and
5. The submitted Maintenance Bonds issued by Insurance Company of the West in the
amount of $273,008.00 (Bond No. 1846667) and in the amount of $533,095.00 (Bond No.
1846669) be accepted as security for the aforesaid one-year guarantee period, said period to
commence on this date and terminate on the 3rd day of December, 2003.
PASSED, APPROVED AND ADOPTED this 3rd day of December, 2002.
