Thompson, Public V~orks Director ATTACHMENTS: 1) Resolution 2) Vicinity Map RECOMMENDATION: Adopt the Resolution accepting improvements and approving the /~ traffic control devices installed for Tract 6956 "Chantemar", Dublin AT Ranch Neighborhood L-1 FINANCIAL EMENT: Brookfield Chantemar, Inc., has provided a Maintenance Bond in the amount of $244,511 to guarantee against defects for one year. Once these improvements have been accepted, the City will incur maintenance and street sweeping costs for City street improvements. Street light maintenance costs will be paid by the Street Lighting Maintenance Assessment District 99-1. Maintenance of landscaping along the side yards of the lots on Oak Buff Lane, within the open space areas at the end of Sugarloaf Court, behind Lot 91, between Lots 65 and 66, and between the sidewalk and back-of-curb along the frontage of North Dublin Ranch Drive, will be performed by a Community Homeowner's Association. DESCRIPTION: The Dublin Ranch Neighborhood L-1 (Tract 6956) is located in the Eastern Dublin Specific Plan area, generally bounded by North Dublin Ranch Drive, Oak Bluff Lane and the Dublin Ranch Golf Course. Tract 6956 consists of 91 residential lots, as well as three parcels for open space and access to the gravel maintenance road along the boundary of the Golf Course. The subdivision improvements have been constructed pursuant to the Tract Developer Agreement and to the satisfaction of the Director of Public Works, and should now be accepted by the City for permanent maintenance. The following regulatory traffic Control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. Newfields Lane and Penwood Lane are designated as "Through Streets." Stop signs have been installed on the southerly approach of Newfields Lane at Oak Bluff Lane, on the westerly approach of Oak Bluff Lane at North Dublin Ranch Drive, and on the southerly approach of Sugarloaf Court at Oak Bluff Lane (Traffic Code Section 6.16.020). At the time the City and Brookfield Chantemar, Inc., executed the contract for tract improvements, the developer provided a Faithful Performance Bond in the amount of $978,043 and a Labor and Materials Bond in the amount of $489,022 to guarantee performance of the work. Now that the work is complete, the bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond in the amount necessary to guarantee for a one-year period following acceptance of the work. The developer has provided a Maintenance Bond in the amount of $244,511, which is 25% of the original Performance Bond amount, and which is sufficient to guarantee the one-year period upon acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements and approving the regulatory traffic control devices installed for Tract 6956 "Chantemar", Dublin Ranch Neighborhood L-1. Page 2 ~-f,,~-- RESOLUTION NO. - 02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTANCE OF IMPROVEMENTS FOR TRACT 6956 (DUBLIN RANCH NEIGHBORHOOD L-l) AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the subdivider of Tract 6956, filed on June 21, 2000 in Book 251 of Maps at Pages 48 - 53, previously entered into an agreement with the City of Dublin to improve said Tract in accordance with plans and spec ifications on file with the City Engineer, said Tract identified as follows: a) Subdivider: Brookfield Chantemar, LLC, a California Corporation (Brookfield Homes) b) Tract Location: Northeast comer of North Dublin Ranch Drive and Oak Bluff Lane c) Tract Size: 91 Single-Family Lots d) Resolution Approving Agreement: 66-00, City of Dublin City Council e) City Streets Affected: Milbridge Court, Newfields Lane, Penwood Lane and Sugarloaf Court WHEREAS, improvements associated with Tract 6956 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the developer has installed certain regulatory traffic control devices as a part of the Tract improvements; and WHEREAS, the original Performance Bond and Labor and Materials Bond can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee maintenance of the completed work for a one-year period following acceptance. NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) Newfields Lane, and Penwood Lane are designated as "Through Streets" b) Stop control device installed at the southbound approach of Newfields Lane at Oak Bluff Lane c) Stop control device installed at the southbound approach of Sugarloaf Court at Oak Bluff Lane d) Stop control device installed at the westbound approach of Oak Bluff Lane at North Dublin Ranch Drive I. i~r'ljo:z., 4-. 2.. ..... ~ ............... ~" 3. The original Faithful Performance Bond issued by American Home Assurance Company (Bond No. 219010) in the amount of $978,043.00 be released; and 4. The original Labor and Materials Bond issued by American Home Assurance Company (Bond No. 219010) in the amount of $489,022.00 be released; and 5. The submitted Maintenance Bond issued by American Home Assurance Company (Bond NO. 219010) in the amount of $244,511.00 be accepted as security for the aforesaid one- year maintenance period, said period to commence on this date and terminate on the 17th day of December, 2003..
