Receive staff presentation and public testimony Question staff and the public Issue a Statement that the City will not authorize initiation of a General Plan Amendment Study for any use other than a public use FINANCIAL STATEMENT: None at this time. DESCRIPTION: At the October 1, 2002, City Council meeting an item had been placed on the agenda by Trumark Companies, requesting the City Council to authorize Staff to begin work on a General Plan Amendment Study to enable residential uses to develop on the 19-acre site currently owned by Alameda County and Southern Pacific Railroad (See Attachment 1 for location). Prior to the City Council hearing that matter, however, Trumark Companies withdrew their application. During the public comment period at the October 1, 2002, meeting, there was testimony from various citizens regarding the future use of the transportation corridor adjacent to the Iron Horse Trail, north of Amador Valley Boulevard (Attachment 1, General Plan Location Map). The City has continued to receive questions from surrounding citizens regarding the development process and how land use changes could occur on the 19-acre site. Due to the inquiries from the public regarding this site, staff has placed this item on the agenda to review the (1) ownership of the 19-acre site; (2) the current land use designation for the sites; and (3) how land uses can be changed; and (4) recommendations regarding the future land use designation for the site. Ownership of the Site: The 19- acre transportation corridor is owned by two entities, Alameda County and Southern Pacific Railroad. In September 2002, the City sent a letter to Alameda County Public Works regarding the legal ------------------------------------------------------------------------------------------------------------- COPIES TO: In-House Distribution 8.~ /4Y ITEM NO. requirements relating to the sale of County property. To date, the City has not had a response from that letter. Current Land Use Designations for the Site: The 19 acre site is currently designated Transportation Corridor in the City of Dublin General Plan. Any change from this designation would require a General Plan Amendment. How Land Uses Can be Changed: City of Dublin policy requires that prior to any change from one General Plan Land Use Designation to another; the City Council shall initiate a study of a possible General Plan Amendment. Requests to initiate a study to change the General Plan may be made by an applicant or may be initiated by the City Council for the public good. At the conclusion of the General Plan Amendment Study, public hearings are held by the Planning Commission and City Council on the findings of the Study. Following the public hearings and appropriate environmental review, the City Council makes a determination on the General Plan Amendment. . Future Land Use Designationfor the 19-Acre Site Adjacent the Iron Horse Trail: The City of Dublin has not received an application for a change in land use for the 19-acre site (Attachment 1) since the withdrawal of the Trumark application. Although there is no request pending for a General Plan Amendment cUrrently on file with the City, there are other uses that are being considered for the 19-acre area as follows: . City Staff and Dublin San Ramon Services District (DSRSD) have been working on the location for the future recycled water pipeline for the Dublin San Ramon Services District and East Bay Mud Recycled Water Authority (DERWA) San Ramon Valley Project. Siting the pipeline along this transportation corridor would be the least disruptive to existing City businesses and residences. . Designation of the 19-acre site as a possible recreation or open space use in conjunction with the Iron Horse Trail. This possible use is being evaluated in the updated Park Master Plan. All uses that are being considered for the site by the City are public uses. PUBLIC HEARING WEED AND COMBUSTIBLE REFUSE ASSESSMENT ORDER (540-50) Mayor Lockhart announced that Item 8.1 has been withdrawn. TRUMARK COMPANIES GENERAL PLAN AMENDMENT (GPA) STUDY REQUEST FOR mE 19-ACRE SOUfHERN PACIFIC RAILROAD AND ALAMEDA COUN1Y PARCELS ALONG TIIE IRON HORSE TRAIL (420-30) Laura Moore, addressed the Council and stated residents met last night, and they have some exciting ideas regarding the land around the Iron Horse Trail. They wished to relay some of their thoughts and to submit a petition with over 200 signatures that are opposed to housing being built on this land. She introduced Steve Westlund, Association President of Heritage Commons. Steve Westlund, Conestoga Lane, stated they wished to share concerns. They are concerned that this is being withdrawn at this time so the applicant can submit a future proposal. No amount of discussion will change their minds about keeping the trail free of housing. They requested that the City Council direct staff to place on agenda at next meeting a GP A study to consider park or open space use on this site in order to give people an opportunity to provide their input. He asked that those present supporting their position to stand. No houses behind Stagecoach. Save our wild life andopen space. 77 Glen Walder, Knollwood Place, stated it is unfortunate that a presentation of this kind is required to present what everyone takes this open space for granted. He is a 27 -year resident, has been a teacher for 10 years at Dublin High School and is a running coach. He talked about activities that occur on the Iron Horse Trail, one starting at 6 a.m., which he calls critical mass. That open space is the only way for many of them to deal with the stress of life. This trail is very heavily used and a dramatic testimony to this community to have this type of parkland. The nearby residents are not the only ones impacted. The wildlife in this area is very unique; as is the bird life and mammal life, etc. Mayor Lockhart read a statement submitted by Peter Verga, Brookdale Court, I would like this issue placed on agenda for next meeting - to declare it oven space in general plan. 7~ Mayor Lockhart read a statement submitted by Carol Hines, Corinth Court, ''I would like Iron Horse Trail from Amador Valley Blvd to Alcosta. Mayor Lockhart corrected erroneous information and advised that the Council did not pull this item, but rather the developer did. On September 30, 2002, a letter was submitted to the City stating, "Trumark would like to officially withdraw our application for tl General Plan Study on the railroad site. We will spend some more time with the local neighborhood and see if an application in the future would be appropriate. 77 Denise Oxman -Morgan, Turquoise Street, stated she is a newer resident and she is a teacher. Our children seem to have been forgotten in all of this. The impacts on our schools should be considered. To think about park space, look past the revenue the city would have and think about the children. Mayor Lockhart read a statement submitted by Nancy Blair, Stagecoach Road, "I am totally against the development of the land surrounding the Iron horse trail and behind my home. We need to stop developing Dublin and focus on what we have and improve on it. Please protect our open land! Do not re-zone the land for homes. Lefs develop that area as tl parkland for all of Dublin to enjoy. 77 Mayor Lockhart read a statement submitted by Randy Frazier P.E., Amador Valley Boulevard, "I am opposed to any development in this beautiful open area. This space is an asset to the community as it is - attracting people to the area and making the town desireable! This area is already part of the master plan. Cm. Zika stated currentl/this is zoned as a transportation corridor. Mayor Lockhart clarified that this will be addressed as part of the plan. She assured the public that nothing will happen without the public having an opportunity to be a part of the discussion. Scott Mason, Stagecoach Road, stated what Trumark did was say they were going to withdraw this and submit it later. He just bought his house in June and would feel very uncomfortable not telling a potential buyer that someone wants to develop this land. Mayor Lockhart clarified they've withdrawn everything they've submitted to the City. They have literally withdrawn their request. Steve Klopfer, Sapphire Street asked if the city has the first option to purchase this land from Southern Pacific? / Mayor Lockhart replied that staff is researching this at the present time. Part of it is County owned and part is SP. Mr. Klopfer stated it has been 3 months since the 7Eleven went up. Did anyone receive a letter about this? He has only been here 5 years.
