Acceptance of Improvements, Tract 6308 (Hansen Hill, Phase II

RECOMMENDATION:
1) Adopt Resolution accepting the work completed and approving
regulatory traffic control devices installed as tract improvements.
2) Authorize Staff to accept maintenance bond
FINANCIAL STATEMENT:
A Maintenance Bond in the amount of $655,000 to guarantee against
defects has been provided to the City. Sweeping and other street
maintenance costs will be incurred by the City. The street lighting
maintenance costs shall be paid by the Citywide Street Light
Maintenance Assessment District.
DESCRIPTION: California Pacific Homes, Inc., originally subdivided the Hansen
Hill, Phase II, development and then assigned their rights and obligations to Warmington Hansen
Associates, L.P., the developer who subsequently constructed the improvements. The Hansen Hill project
consists of 180 single-family lots, of which 108 lots are contained in this final phase of the development. '
The improvements within Tract 6308 have been inspected by the City Engineer and found to be complete.
At the time the City and the developer executed the contract for the tract improvements, the developer
was required to provide a Grading and Storm Drain Bond in the amount of $1,051,500.00, a Performance
Bond in the amount of $2,620,000.00, and a Labor and Materials Bond in the amount of $1,310,000.00 to
guarantee performance of the work involved. Now that the work is complete, the bonds may be released
in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a
Maintenance Bond in an amount necessary to assure maintenance of the improvements for a one-year
period following acceptance of the work. The developer has provided a Maintenance Bond in the amount
of $655,000, which is 25% of the original Performance Bond amount, and which is sufficient to guarantee
the one-year maintenance period upon acceptance.

The following regulatory traffic improvement will be accepted and approved as a part of this development
and added to the City of Dublin Traffic Code:
Inspiration Circle is designated as a "Through Street." A through street is typically a collector
street. Other minor streets which intersect a through street are controlled by stop signs. Since
Inspiration Circle is a "Through Street," stop signs have been installed on Bloomfield Terrace, Dry
Creek Drive, Mountainrise Place, and Georgian Oaks Court at Inspiration Circle.
Staff recommends adopting the Resolution to accept the improvements associated with Tract 6308,
Hansen Hill, Phase II, and authorize Staff to accept a Maintenance Bond in the amount of $655,000.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING IMPROVEMENTS FOR TRACT 6308 (HANSEN HILL, PHASE II)
AND APPROVING REGULATORY TRAFFIC DEVICES
INSTALLED AS TRACT IMPROVEMENTS
WHEREAS, the subdivider of Tract 6308, filed June 27, 1997, in Book 233 of Maps Pages 32-39,
previously entered into a contract with the City of Dublin to improve said Tract in accordance with plans
and specifications on file with the City Engineer, said Tract identified as follows:

WHEREAS, the improvements associated with Tract 6308 are complete in accordance with said
plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer;
and
WHEREAS, the developer has installed certain traffic regulatory devices as a part of the Tract
improvements; and
WHEREAS, Condition of Approval No. 30 of City Council Resolution No. 57-95 requires the
:developer to guarantee the improvements and to maintain the completed work against defects for a period
of one year following acceptance of the improvements by the City of Dublin; and
WHEREAS, the improvements are now complete, the original Grading and Storm Drain,
Performance, and Labor and Materials Bonds can be released, in accordance with the authority contained
in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to
guarantee maintenance of the completed work for the aforesaid one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
The improvements completed within said Tract are hereby approved and accepted subject
to a one-year guarantee period; and
The traffic regulatory devices installed by the developer are hereby included in the City of
Dublin Traffic Code, said regulatory devices to include the following:
Inspiration Circle is designated as a "Through Street." (Traffic Code Chapter 6.08)

The original Grading and Storm Drain Bond iSsued by American Motorists Insurance
Company (Bond No. 3SM 888 409 00) in the amount of $1,051,500.00 be released; and
The original Performance Bond issued by American Motorists Insurance Company (Bond
No. 3SM 908 878 00) in the amount of $2,620,000.00 be released; and
o
The original Labor and Materials Bond issued by American Motorists Insurance Company
(Bond No. 3SM 908 878 00) in the amount of $1,310,000.00 be released; and

The submitted Maintenance Bond issued by Insurance Company of the West (Bond No.
1837508) in the amount of $655,000 be accepted as security for the aforesaid one-year
maintenance period, said period to commence on this date and terminate on the 7th day of
August, 2002.
