Adopt Resolution (Attachment 1) approving notification to developers of pending Non- Residential Affordable Housing fee for the City of Dublin FINANCIAL STATEMENT: None at this time DESCRIPTION: On August 21, 2001, the City Council adopted a Resolution approving a contract with Cotton/Bridges consultants to prepare a Non-Residential Affordable Housing Fee for the City of Dublin that would be used for the retention and creation of affordable housing. This report includes a public notice and public hearing for consideration of a Resolution of intent to adopt a Non-residential Affordable Housing Fee. It will put developers on notice that the City Council intends to adopt an ordinance imposing this fee. By notifying developers, applications for discretionary approvals submitted after the adoption of this resolution, but before adoption of the fee, will be subject to the Non-Residential Affordable Housing Fee. Notices of this hearing have been sent out to developers with potential future commercial projects, major commercial property owners and the Chamber of Commerce. RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ************************************** EXPRESSING THE CITY'S INTENT TO ADOPT DEVELOPMENT FEE TO MITIGATE THE IMPACTS OF NONRESIDENTIAL DEVELOPMENT ON THE AFFORDABILITY OF HOUSING IN THE CITY OF DUBLIN RECITALS WHEREAS, the Council has authorized but not yet adopted a fee to mitigate the impacts of nonresidential development on the affordability of housing in the City of Dublin (the "Fee"); and WHEREAS, the City has engaged a consultant, Cotton/Bridges Associates, to prepare a study that will examine the need for affordable housing in Dublin and impact of nonresidential development on the affordability of housing in Dublin; and NOW THEREFORE, be it resolved that the City intends to adopt an affordable housing development impact fee that would be imposed on nonresidential development. The City has engaged a consultant, Cotton/Bridges Associates, to prepare a study that will examine the need for affordable housing (for moderate, low and very low incomes) in Dublin and impact of nonresidential development on the affordability of housing in Dublin. Should the consultant find a need for affordable housing and an impact from nonresidential development, the consultant will recommend a fee structure to mitigate the impact on the affordability of housing in Dublin. The City anticipates that the fee structure will be based on the fee upheld in Commercial Builders of Northern Calif. v. City of Sacramento (1991) 941 F.2d 872. In that case, the fee study demonstrated that non-residential development has an impact on the' affordability of housing, by (a) creating new jobs in the city and (b) thereby creating additional demand for housing, particularly affordable housing. The fee amount was based on the number of jobs created for Iow-income persons by development and the amount of money in addition to that earned by the low-income persons that would be required to provide such persons with housing. The fee would be allocated among the various types of non-residential development (e.g., office, retail, and industrial) consistent with the number of low-income jobs created by the development type.
