FINANCIAL STATEMENT:
Cost of preparation of Engineer's Report and other proceedings are
to be paid by the developer. The proposed assessment for the
upcoming Fiscal Year is yet to be calculated and will be presented to
the City Council at the time that approval of the preliminary
Engineer's Report is requested.
DESCRIPTION: Taylor Woodrow Homes, the developer of the Clifden Parc 17-lot
subdivision (formerly called "Gleason Property") in the western hills, requested that the City allow
decorative lighting in lieu of the standard "cobra head" street lighting. Staff.agreed to allow use of the
decorative lighting that is installed in the Dublin Ranch development, with the condition that the
subdivision be annexed into the separate street light maintenance assessment district that was formed for
Dublin Ranch. The City Attorney has recommended that the Clifden Parc subdivision be a second "zone"
of the assessment district and that the 17 lots support the cost of maintaining the 13 lights that have been
installed.
It is proposed that the costs for Zone II be included in the Engineer's Report for the existing assessment
district 99-1 and be subject to the same stipulations; i.e., formulated to include future escalation of costs
based on inflationary increases in labor and material costs, as well as the cost of energy. The cost per
single-family lot in Tract 7067 will be somewhat higher than the cost per lot for Dublin Ranch, as the ratio
of lights to lots is higher.

It is further proposed that the Homeowner's Association agree to establish a fund for major repairs or
knockdowns through the CC&R's, as the amortization of major costs would make the assessment per
individual homeowner too high. The incidence of major repairs is generally low and may not occur every
year, but the funds must be budgeted as a contingency.
The proposed assessment for the upcoming Fiscal Year will depend on the estimated date that the City
would assume maintenance of the lights. The proposed assessment will be presented to the City Council at
the time that the Preliminary Engineer's Report is brought back for approval.
The schedule for formation of this assessment district provides that Staff will return to the City Council at
the June 6th meeting with a resolution of intention for formation of the District. This process requires a
45-day public hearing notice, which means that the first opportunity for a public hearing would be the
August 1st meeting. This is consistent with the timing for the annual assessment district hearings.
Staff recommends that the City Council adopt the resolution initiating proceedings for annexation of Zone
II of Landscaping and Lighting Assessment District No. 99-1.

INITIATING PROCEEDINGS FOR ANNEXATION TO
LIGHTING AND LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 99-1
(STREET LIGHTING MAINTENANCE - CLIFDEN PARC, TRACT 7067)
WHEREAS, the City Council of the City of Dublin proposes to form an assessment district
pursuant to the Landscaping and Lighting Act of 1972 (Section 22500 and following, Streets and
Highways Code) for the following improvements (hereinaRer "Improvements"):
The operation, maintenance, and repair of street lighting facilities within the development area
known as Clifden Parc, Tract 7067, as identified on the boundary map Exhibit A attached hereto.
WHEREAS, the proposed assessment district shall be designated Lighting and Landscape
Maintenance District No. 99-1, Zone II, Dublin, Alameda County, California, and shall include the land
shown on the map designated "Assessment Diagram, Lighting and Landscape Maintenance District No.
99-1, Zone 2, City of Dublin, Alameda County, California," which map is on file with the City Clerk and is
hereby approved.
NOW, THEREFORE, BE IT RESOLVED that the City Engineer is hereby designated Engineer
for the purpose of these formation proceedings and that the City Council hereby directs the Engineer to
prepare and file with the City Clerk a report in accordance with Article 4 of Chapter 1 of the Landscaping
and Lighting Act of 1972.

FORMATION OF MAINTENANCE DISTRICT
LIGHTING AND LANDSCAPE MAINTENANCE DISTRICT
NO. 99-1 ZONE II TRACT 7067
(Pursuant to the Landscaping and Lighting Act of 1972)
The undersigned are the owners of the lands as shown in Exhibit A
attached hereto and made a part hereof.
The undersigned hereby requests and consents to the formation of a
maintenance district pursuant to the Landscaping and Lighting Act of 1972
(Sections 22500 and following, California Streets and Highways Code) for
the purpose of providing the following improvements:
The operation, maintenance, and repair of street lights within the affected
boundary as shown on the attached Exhibit A.
The undersigned hereby understand that:
The cost and expenses of the annual servicing, operation and/or
maintenance will be charged to the land, which benefits therefrom,
including our land.
An engineer's report will be prepared for the project which will
contain a description of the services proposed to be financed
through the levy of assessments, a cost estimate for the services to
be provided, a description of each lot or parcel of property
proposed to be subject to the landscaping and lighting assessment,
the amount of the proposed assessment of reach lot or parcel, and
the basis and schedule of the assessment.
The cost of the engineering, legal, and other incidental fees and
expense will be included in the project cost to be shown in the
above report.

e. improvements referenced herein, the same to be set annually by the
City Council by resolution or ordinance.
That you assess the cost of the annual servicing, operation and
maintenance of said public improvements, together with the incidental
expenses of said proceedings, upon the district benefited thereby, the
exterior boundaries of which are described as the exterior boundaries
of the composite and consolidated area of all parcels of property more
particularly shown on a map attached as Exhibit a.
The undersigned hereby waive the notice of public hearing otherwise
required by the Landscaping and Lighting Act of 1972 for the formation of
the maintenance district.
That in the event of the termination of these proceedings after they have
been instituted but prior to their completion, the undersigned will
reimburse you for any sums incurred or advanced by you up to said time
for any costs incurred in the conduct of said proceedings including, without
limitation, costs for engineering, legal or other services, or pay said items
directly to the parties furnishing the same.
