Thompson, Public Works Director ATTACHMENTS: l) 2) Resolution Approving Parcel Map 7395, and authorizing the Mayor to execute the Owner' s Statement on behalf of the City of Dublin, a Municipal Corporation Vicinity Map RECOMMENDATION: Adopt Resolution approving Parcel Map 7395, and authorizing the Mayor to execute the Owner' s Statement on behalf of the City of Dublin, a Municipal Corporation FINANCIAL STATEMENT: The Surplus Authority of Alameda County provided performance and labor and materials bonds to guarantee construction of the Dublin Boulevard Extension, and will pay the cost of the associated construction inspection. Once improvements have been constructed and accepted, the City will incur maintenance costs for City- maintained improvements. DESCRIPTION: The Surplus Property Authority of Alameda County is proposing to subdivide three parcels south of Dublin Boulevard, east of the Southern Pacific railroad right-of-way, and west of Arnold Road into four parcels totaling approximately 61.7 acres, plus roadway right-of-way dedications totaling approximately 7.0 acres, and an additional parcel of approximately 15.0 acres to be conveyed to the Bay Area Rapid Transit District (BART). The purpose of the subdivision is to permit the dedication and improvement of Dublin Boulevard in the precise alignment adopted by the City Council in 1996, the dedication of Iron Horse Parkway and DeMarcus Boulevard to the public for street purposes, and the conveyance of the land identified as "Parcel A" containing the Dublin/Pleasanton BART station and noah parking lot from Alameda County to BART. The Mayor' s signature is required as owner on the Map because Parcels "B" and "C", representing the original alignment of Dublin Boulevard, are currently owned in fee title by the City. After this Map is COPIES TO: Adolph Martinelli, Alameda County Thomas Blalock, BART ITEM NO. -ff~ ,, 7 G:\develop\BART\agst prn 7395 recorded, and upon acceptance of the improvements for the Dublin Boulevard extension between Iron Horse Parkway and Hacienda Drive, Parcel "C" will be quit claimed to Alameda County, and the County will then convey Parcel "D" to the City. This separate instrument transaction will thus formally grant the new street right-of-way to the City for Dublin Boulevard, and will allow the abandoned Parcel "C" to be merged with Parcel "3" to create a developable resultant parcel. The proposed subdivision is consistent with the General Plan, and will facilitate the implementation of the adjacent Eastern Dublin Specific Plan by permitting the westerly extension of Dublin Boulevard. The improvements for Dublin Boulevard extension, for DeMarcus Boulevard, and for Iron Horse Parkway are consistent with City standards, and will be accepted for permanent maintenance once all improvements are complete. Staff recommends that the City Council adopt the Resolution approving Parcel Map 7395, and authorize the Mayor to sign the Map on behalf of the City. Page 2 RESOLUTION NO. - 00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING PARCEL MAP 7395 (Alameda County Surplus Property Authority, Bay Area Rapid Transit District, and City of Dublin) WHEREAS, the Final Map for Parcel Map 7395, in the incorporated territory of the City of Dublin, State of California, has been presented to this City Council for approval and for the Mayor's signature, all in accordance with the provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, the Surplus Property Authority of Alameda County previously executed and filed with the City of Dublin a contract to extend Dublin Boulevard along the alignment shown as Parcels "B" and "D" of said map per improvement plans and specifications attached thereto; and WHEREAS, said contract is secured by bonds, conditioned upon faithful performance of said contract, and conditioned upon payment for labor performed or material furnished under the terms of said contract. NOW, THEREFORE, BE IT RESOLVED that the Final Map for Parcel Map 7395 be and the same is hereby approved; and that rights to areas marked as Arnold Road, Iron Horse Parkway, DeMarcus Boulevard, and those strips of lands marked Public Service Easement (P.S.E.), Sidewalk Easement (S .W.E.), 20'-wide Storm Drain Easement (20' S.D.E.), and Public Access Easement (P.A.E.), Traffic Signal Easement (T.S.E.), and Landscape Easement (L.E.) as offered for dedication to public use in conformity with the terms of dedication be, and they are hereby accepted, subject to improvement, that the 30'-wide Storm Drain Easement (30' S.D.E.) as offered for dedication is hereby rejected, and that the Mayor is hereby authorized on behalf of the City of Dublin to execute the map, and that the Clerk of this City Council be and is hereby directed to transmit said executed Map to the County Recorder for filing.
