FINANCIAL STATEMENT: No cost associated with this revision.
DESCRIPTION:
In April of 1989, the City Council adopted Resolution No. 52-89, which amended
the policy for advertising banners in the public right-of-way (San Ramon Road
banner poles) to charge an encroachment permit fee and to allow the event to
be held outside the City Limits as long as Dublin residents benefited from the
event. The revised policy still required all banners to be approved by the
City Council.
Since that time, five requests for use of the banner poles have been received,
all of which were within policy guidelines and were subsequently approved by
the City Council.
Since the number of banner requests seems to be increasing, rather than
continuing to take up the City Council's time for approval on each and every
banner request, Staff recommends that the Public Works Director be the
approving entity when the banner request falls within the guidelines of the
policy. The policy would still require that the applicant be a nonprofit
organization holding an event that would benefit Dublin residents and would
require payment of the encroachment permit fee and provision of an insurance
certificate.
If a request cannot clearly be approved within the adopted policy, the
application would then be submitted to the City Council for a determination.
Staff recommends that the City Council adopt the resolution amending the
policy regarding advertising banners within the public right-of-way.

REGARDING INSTALLATION OF ADVERTISING BANNERS
WITHIN THE PUBLIC RIGHT-OF-WAY
INTENT: This policy is to regulate the installation, materials, scheduling,
removal, insurance, and other items related to banners placed within the City
of Dublin public right-of-way.
ELIGIBILITY: Nonprofit organizations advertising activities which benefit
City of Dublin residents may apply for a permit to erect and maintain a
banner.
APPROVING AGENCY: The City Council shall be the approving body, with the
Public Works Director issuing an encroachment permit. The banner shall be
installed by the City of Dublin maintenance department.
FEES: The applicant shall be charged an encroachment permit fee for usage of
the banner poles. There shall be no possibility of waiver of the fee.
TIME LIMITS: The application for banner installation shall be submitted not
later than one month in advance of the desired installation of the banner, and
no sooner than one year in advance of the proposed installation.
Any one agency may not erect a banner any more frequently than four times in
any one calendar year.
No banner, for any event, may be erected for longer than two weeks and no more
than one banner erected for any one event.
LOCATION: The banner shall be erected and displayed at a location approved by ,
the City Council.
MATERIALS: The banner shall be designed and made by a company whose business
it is to design and construct banners. The design shall be sufficient to
handle wind loads as specified in the latest adopted Uniform Building Code.
INSURANCE: The applicant shall carry liability insurance in an amount not
less than $1,000,000 and shall provide a certificate of insurance which names
the City, its agents and employees, as additional insureds.
OTHER REQUIREMENTS: The City Council and/or the Public Works Director may
impose additional conditions as necessary to control banner installation,
maintenance, and removal.
The City Council may waive or change any of the guidelines within this policy
as conditions may dictate on any installation; except that the encroachment
permit fee shall not be waived in any case.

RESOLUTION NO. -90
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
AMENDING RESOLUTION NO. 52-89
POLICY FOR THE INSTALLATION OF ADVERTISING BANNERS
WITHIN PUBLIC RIGHTS OF WAY
WHEREAS, on December 12, 1983, the City Council of the City of
Dublin adopted Resolution No. 73-83 approving a policy for the installation of
advertising banners within the public right-of-way; and
WHEREAS, on April 24, 1989, the City Council adopted Resolution
No. 52-89 amending the policy to allow advertising of events which benefit
Dublin residents and which are held outside the City Limits, and to charge an
encroachment permit fee for installation of the banner; and
WHEREAS, the City Council wishes to modify the policy so that the
Public Works Director is the approving entity for applications that fall
strictly within the policy guidelines, while the City Council is approving
entity for exceptions;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of. Dublin does hereby amend Resolution No. 52-89 to provide that the Public
Works Director of the City of Dublin may approve applications for placement of
advertising banners- in the public right-of-way insofar as the policy
guidelines attached hereto as "Exhibit A" are strictly met, and that the City
Council must approve applications which are exceptions to the policy
guidelines "Exhibit A" above.
