HomeMy WebLinkAboutItem 4.11 Accept Improvements The Woodlands (2) x CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: February 12, 1990 SUBJECT: Acceptance of Improvements Tract 5780 "The Woodlands" Village VII Standard Pacific Corporation (Report by Public Works Director Lee Thompson) EXHIBITS ATTACHED: 1) Resolution 2) Location Map RECOMMENDATION: 1) Adopt Resolution to accept the work completed. 2) Authorize Staff to accept maintenance bond at a future date. FINANCIAL STATEMENT: A maintenance bond in the amount of $97,699.25 to guarantee against defects will be provided to the City. Streets within this Tract are private and will incur no future sweeping or maintenance costs. The open space "Parcel A" will incur maintenance costs in the form of weed abatement and firebreaks. DESCRIPTION: The Final Map for Tract 5780 was approved by the City Council on January 11, 1988. Tract 5780, "The Woodlands" is a 139-unit townhouse condominium development located along the south side of the terminus of Shady Creek Road. The developer is Standard-Pacific Corporation. The streets within Tract 5780 are private, and the City will not incur any future maintenance costs. "Parcel A" of this tract, which was dedicated to the City as open space, is part of the Dougherty Hills Open Space and will be maintained by the City from the standpoint of weed abatement or firebreaks. At the time the City and Standard-Pacific executed the contract for the Tract improvements, the subdivider was required to provide a performance bond in the amount of $390,797.00 to provide the necessary security for the performance of work involved. As the work is now completed, the performance security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code, to an amount necessary to guarantee maintenance of the work for.a one-year period following acceptance of the work. The sanitary sewer and domestic water services have been covered by a separate maintenance bond issued to DSRSD. Staff recommends that the City Council adopt the resolution accepting improvements and authorize Staff to accept the maintenance bond at a future date. ---------------------------------------------------------------------------- ITEM NO. RESOLUTION NO -90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------- FOR THE ACCEPTANCE OF IMPROVEMENTS, TRACT 5780 (VILLAGE VII OF THE VILLAGES AT WILLOW CREEK) WHEREAS, the owner-subdivider of the aforesaid Tract previously entered into a contract with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the City Engineer, said Tract identified as follows: a) Subdivider: Standard-Pacific Corporation b) Location: Southerly of the terminus of Shady Creek Drive c) Tract Size: 139 Units d) Resolution Approving Final Map: 3-88 e) City Streets Affected: None (private streets) WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of the City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, the subdivider is required to guarantee the improvements and to maintain the completed work for a period of one year following acceptance of the work by the said City of Dublin; and WHEREAS, as the improvements are now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract be, and they are hereby approved and accepted subject to the aforesaid one-year guarantee; and 2. The aforesaid original performance bond security requirement be reduced from the amount of $390,797 to a revised security requirement in the amount of $97,699.25, upon acceptance by Staff of the replacement maintenance bond in the said amount of $97,699.25 as security for the aforesaid one-year guarantee period, and the Mayor of this City Council be, and he is hereby authorized and directed to execute the said bond on behalf of the said City of Dublin; and 3. The said original performance bond in the'-amount of $390,797 posted in connection with the work involved in the construction of said Tract,be hereby released upon 'acceptance of said maintenance bond. PASSED, APPROVED, AND ADOPTED this 12th day of February, 1990.
