BOARD MEETING DATE: February 26, 1990
SUBJECT: Notice of Completion of Civic Center Project

RECOMMENDATION: a ‘A thorize Secretary to execute Notice
FINANCIAL STATEMENT: Upon completion of punch list items and
outstanding issues, a complete financial
report will be prepared.
DESCRIPTION: Pursuant to State Law, the City is required to
record with the County Clerk a Notice of Completion. This establishes
the time frame for subcontractors to submit any stop notices due to
non-payment of funds. The City Attorney's Office has prepared the
Notice in accordance with the requirements of State Law and
recommended that DII, as owner of the project, also execute the Notice
of Completion.
The filing of the Notice of Completion has been undertaken in order to
finalize the project and final payments to the Contractor and
subcontractors. The Notice will be conditional upon completion of the
final punch list items. Further, it shall be subject to the City
withholding adequate retention for stop notices, punch list work
remaining, and any other issues associated with the agreement. It is
anticipated that the Contractor will have all punch list items
complete within the next 30 days and the City and Contractor will
enter into a final agreement which will reflect a full and complete
resolution of all issues related to the Civic Center agreement.
Staff recommends that the Board of Directors authorize the Secretary
to execute the Notice of Completion and have the Notice recorded with
the County Clerk.

To Whom It May Concern:
You are hereby notified as follows:
1. The date of final completion of the work or improvements
hereinafter described is February 26, 1990.
2 . The work was "substantially" completed prior to January 1,
1990 in accordance with the Agency Agreement and plans and
specifications, the Dublin Civic Center Project.
3 . The owner of the work or improvements is Dublin Information,
Inc. (DII) , 100 Civic Plaza, Dublin, California 94568.
4 . The City of Dublin, 100 Civic Plaza, Dublin, CA 94568, as
agent of DII under an Agency Agreement, was responsible to complete
the construction of the Dublin Civic Center.
5. The nature of the City's interest or estate is a leasehold,
the Lessor being Dublin Information, Inc.
6. The work or improvements is located at 100 Civic Plaza,
Dublin, California and is particularly described as follows:
Dublin Civic Center Project No. 87-9
The construction of a facility consisting of approximately 53,000
square feet, including parking and landscape improvements and all
appurtenant work as shown in the plans, specifications, special
provisions and other contract documents.
7. The name of the contractor for the work or improvements is
Dickman-Nourse Inc. , located at 120 Pioneer Way, Mountain View,
California 94039.
