FINANCIAL STATEMENT: Undetermined. DESCRIPTION: The City has received a letter from Congressman Pete Stark indicating that Congressman Stark is interested in introducing some legislation to close Camp Parks Reserve Forces Training Area and to make the land available for local public purposes. Congressman Stark's office has drafted some very rough draft legislation which the Congressman has asked local agencies to review and comment. Congressman Stark has requested that the City respond in comment to his office by May 1 , 1990. Congressman Stark's draft legislation provides for the closure and relocation of Camp Parks Reserve Forces Training Area to an area in the hills to the north or east of its present location. The land then would be conveyed for public purposes only to the City of Dublin, City of San Ramon, County of Alameda, County of Contra Costa, East Bay Regional Parks District, the State of California, and other agencies of the Federal Government. This conveyance would not only include real property but all improvements on the property. The exact amount and location of the acreage of the real property to be conveyed to each of these entities would be determined by a Committee made up of the representatives of each of those entities and representatives of areawide agencies and other units of government that have an interest in such a conveyance. The draft legislation also suggests some possible public uses for the property including 1 ) park lands for East Bay Regional Parks District, 2) improve buffer zones around Federal and County prisons, 3) campus area for the Alameda and Contra Costa Community Colleges, 4) a regional government complex for Alameda County neighboring Cities and the State of California, 5) libraries and schools, 6) sewer treatment plants isolated from residential areas, 7) mass transit parking spaces and support services, 8) Department of Veteran's Affairs National Cemetery, 9) armory and classroom facilities for the Department of Army or National Guard for the State of California or both. The draft legislation also indicates that should any of the property be used for private purposes in any manner, that such interest in that property would revert to the United States. Of the 2, 268 acres indicated in the draft legislation, approximately 75% of that acreage is located in the City of Dublin with the remaining acreage located in Contra Costa County. ---------------------------------------------------------------------- COPIES TO: ITEM NO. '� In addition to the uses identified in the draft legislation, City Staff has identified the following possible public uses for Council consideration. 1 . Fire Training Facility 2. Public Safety Vehicle Off-road Training Course 3. Regional Performing Arts Center 4. Municipal Golf Course 5. Open Space Park (Steeper Slope Areas) 6. Large Community Park including Gymnasium, Amphitheater, Teen Center, Sports Park 7. Senior and Affordable Housing In addition to considering public uses, it is Staff's position that the legislation should also provide for use of a portion of land for private purposes. The East Dublin BART Station is located at the southerly end of the Camp Parks property. It is generally recognized that it is beneficial for land uses to be intensified and compliment transit uses in the vicinity of BART stations. In order to maximize the East Dublin BART Station potential, land immediately adjacent to the BART Station should be developed privately. Since nearly three- quarters of the Camp Parks facility is located within the City of Dublin, the location of only public uses which require municipal services may place a drain on the City financially. If Camp Parks is to be closed in the future, Staff would strongly recommend that a mixture of public and private uses for the Camp Parks property be considered. Private uses would generate the tax revenue needed to serve not only private land uses but also public land uses where required. FORTNEY H. Enclosed is a very, very rough draft of legislation I am considering introducing to close Camp Parks and make the land available for local public purposes. I am writing to ask for your ideas and suggestions on (1) whether I should proceed with this legislation, and ( 2) what changes should be made in it. A key question is whether we will be able to get the Camp Parks land free or at a reduced price for public purposes. Given the Federal government ' s severe budget problems, and the need to maintain a Reserve Forces Training facility in Northern California, we may need to offer the Army a large quantity of less valuable State or County land somewhere in Northern California in swap for the Camp Parks land. The introduction of legislation could help focus various groups on working toward a resolution of this problem. It has always been my policy to stay out of local zoning and land use issues, and I would only want to proceed with disposal legislation if local groups are agreed on it and have a mutually agreed plan on how the land should be used for the public. I offer this idea to see if there is local interest and an ability to reach an agreement . Attached is a list of people to whom this letter has been sent . I do not want to leave any interested party unconsulted and would appreciate it if you could share this letter with others you think should be involved. I will round-robin any responses I receive by May 1, and we can get a feeling of whether to proceed, and if so, what types of amendments people want to see to the draft bill, etc. Thank you for your help and consideration. SHORT TITLE. 2 This Act may be cited as the "Closure of Camp Parks 3 Regional Forces Training Area and Conveyance of Land for 4 Public Purposes Act of 1990 ' ' . 5 SEC. 2. FINDINGS AND PURPOSE. 6 (a) FINDINGS. --The Congress finds that-- 7 (1) the closure and realignment of military 8 installations will increase the country 's need for well- 9 trained and combat-ready Reserves of the Armed Forces ; 10 ( 2) there exists a need for a place reasonably near 11 the San Francisco Bay Area in California where Reservists 12 can train; 13 ( 3 ) the existing location of the Camp Parks Regional 14 Forces Training Area in the midst of a dense suburban 15 population and at the major transportation center of a 16 rapidly growing area severely limits the use of heavy 17 equipment, weaponry, and air support training operations , 18 thereby resulting in inadequate field and combat 19 preparation; and 20 (4) the closure and relocation of Camp Parks Regional 21 Forces Training Area to an area in the hills to the north 22 or east of its present location would allow for effective 23 and necessary combat-preparedness training in a suitable 24 location. 25 (b) PURPOSE. --The purpose of this Act , therefore, is to STARK033 3 1 convey the real property on which the Camp Parks Regional 2 Forces Training Area is located to local interests so that it 3 may be used only for public purposes . 4 SEC. 3. LAND CONVEYANCE, CAMP PARKS REGIONAL FORCES TRAINING 5 AREA, CALIFORNIA. 6 (a) IN GENERAL . --Subject to subsections ( b) through (d) , 7 the Secretary of the Army shall convey all right , title , and 8 interest of the United States in and to the real property, 9 including all improvements thereon, described in subsection 10 (b) ( 1) to the entities described in subsection (c) . 11 (b) DESCRIPTION OF REAL PROPERTY . -- ( 1) The real property 12 referred to in subsection ( a ) is approximately 2 , 268 acres of 13 real property in both Alameda and Contra Costa Counties , 14 California, known as the Camp Parks Regional Forces Training 15 Area. 16 ( 2) The exact acreage and legal description of such 17 property shall be determined by surveys satisfactory to the 18 Secretary. 19 (c) RECIPIENTS OF REAL PROPERTY.--The Secretary shall 20 convey such real property to the following entities in 21 amounts determined under subsection (d) : 22 ( 1) The City of Dublin, California. 23 ( 2) The City of San Ramon, California. 24 ( 3) The County of Alameda, California . 25 ( 4) The County of Contra Costa, California. STARK033 4 1 ( 5) The East Bay Regional Park District , California . 2 ( 6) The State of California. 3 ( 7 ) Other agencies of the Federal Government . 4 (d) CONDITIONS OF CONVEYANCE . --( 1) The exact amount and 5 location of the acreage of the real property to be conveyed 6 to each of the entities referred to in subsection (c) is to 7 be determined by a committee made up of the following: 8 (A) Representatives of each of the entities described 9 in paragraphs ( 1) through . ( 7 ) of subsection (c) . 10 (B) Representatives of area-wide agencies and other 11 units of government that have an interest in such 12 conveyance, as determined by the entities described in 13 paragraphs ( 1 ) through ( 7 ) of subsection (c) . 14 ( 2) The property conveyed under subsection (a) shall be 15 used by the entities described in subsection (c) for public 16 purposes only, as determined by the committee described in 17 paragraph ( 1 ) . Such purposes may include the following: 18 (A) Park lands for the East Bay Regional Park 19 District , California. 20 (B) Improved buffer zones around Federal and county 21 prisons. 22 (C) Campus area for the Alameda and Contra Costa 23 community colleges . 24 (D) A regional government complex for Alameda County, 25 neighboring cities, and the State of California. STARK033 5 1 (E) Libraries and schools . 2 (F) Sewer treatment plants isolated from residential 3 areas. 4 (G) Mass transit parking spaces and support services . 5 (H) A Department of Veterans Affairs national 6 cemetery. 7 ( I ) Armory and classroom facilities for the 8 Department of the Army or the National Guard of the State 9 of California, or both. 10 ( 3 ) If any portion of the real property, or any 11 improvement thereon, conveyed under this section is conveyed 12 or leased to any entity Qndis used for 13 private purposes in any manner , all right, title, and 14 interest in and to such portion of the property and T- 15 improvements thereon shall revert to the United States, and 16 the United States shall have the right of immediate entry 17 thereon.
