RECOMMENDATION: Deny the Claim and Direct Staff to Notify the Claimant.
FINANCIAL STATEMENT: Claimant alleges damages in excess of $70.
DESCRIPTION: The City received a claim from Don Rogers which alleges
that his car was covered with white paint after driving through the
intersection of Amador Valley Boulevard and Village Parkway.
The paint appears to be an off white water based paint. The City and
Police Department have no record of the spill being reported prior to a
contact from the claimant. At that time, the paint was already dry. The
paint was not being used by City Staff or any City Contractor. It appears
to have been spilled by an unknown party. Therefore, there appears to be
no City liability.
The City's insurance provider recommends that the City Council deny the
claim and direct Staff to notify the claimant.

Note: A Claim relating to a cause of action for death or for Injury to person or to personal property _
or growing of crops shall be presented not later than six (6)months after the cause of action. A claim
relating to any other cause of action shall be presented not later than one (1) year after the accrual of
the cause of action. (Government Code Section 91 1.2) If the date of occurrence was prior to January 1,
1988, different filing deadlines would apply.
When a claim is required to be presented not later than six (6) months after the accrual of the cause of
action, is not presented within such time: a written application may be made to the City Council for
leave to present such claim, The application shall be presented within a reasonable time not to exceed
one (1)year after the accrual of the cause of action and shall state the reason for the delay in
presenting the claim. The proposed claim shall be attached to the application.
