FINANCIAL STATEMENT:
Costs to construct the road~.~o~%.d~_depend on the financing mechanism selected
for this project. A separate action would be required by the City Council to
authorize funding of the construction.
DESCRIPTION:
This ordinance was int~oduqed at.~a public hearing on May 14, 1990. No
protests were made.
A two lane access road has been proposed from the Southern Pacif{c Railroad
right-of-way east to Tassajara Road. The r.oadwpu%~ ~f. aci!~i~b~_ppening of
the Hacienda Road interchange, expedite additional access from the downtown
areas of Dublin to Tassajara Road, provide access to the East Dublin BART
station and improve safety vehicle access to the Santa Rita Jail property.
The right-of-way line for the road is described in Exhibits 2 and 3.
Exhibit 4 depicts the proposed cross section of the parallel road.
Preliminary evaluation of the road calls~fortwp~raffi~l~ne~y%tb~.~ paved
section of forty feet within a fifty-five foot right-of-way.
The fifty-five foot right-of-way will be able to accommodate approximately
17,500 average daily trips (ADT).
ORDINANCE NO. 90
AN ORDINANCE OF THE CITY OF DUBLIN
ESTABLISHING RIGHT-OF-WAY LINES FOR THE TWO LANE ACCESS ROAD
CONNECTING TO THE HACIENDA INTERCHANGE AND PARALLEL TO INTERSTATE 580
The City Council of the City of Dublin does ordain as follows:
WHEREAS, the City Council adopted a Resolution calling for a public
hearing to consider future right-of-way lines for the two lane access road
connecting the Hacienda interchange and parallel to Interstate 580 (Resolution
No. 50-90) and set a public hearing for May 14, 1990 at 7:30 p.m. to hear
objections to the establishment of said right-of-way lines; and
WHEREAS, proper notice of said public hearing was duly given; and
WHEREAS, no protests were made either in writing or orally to the
establishment of said right-of-way lines.
NOW, THEREFORE, the City Council finds and ordains that:
Section 1. Right-of-way lines are hereby established for the two lane
access road connecting the Hacienda interchange and parallel to Interstate 580
as follows:
Ail that certain real property situate in City of Dublin, State of
California, described as follows:
A strip of land of the uniform width of 110 feet
measured at right angles, and lying 65 feet southerly
of, and 45 feet northerly of the following described
line:
Commencing at the southeasterly corner of Tract 4978,
as said Tract was recorded June 5, 1984, in Book 144
of Maps, at Pages 3 through 5, Office of the Recorder,
County of Alameda, said point also being on the
southwesterly right-of-way line of a 50 foot strip
belonging to Southern Pacific Transportation Company,
thence northwesterly along the southwesterly side line
of said 50 foot stri~p, and the easterly line of said
Tract 4978, North 46~29' 26" west, 49.77 feet; to the
True Point of Beginning; thence, leaving said
sidelines, South 88°~ · 47' 37" East, at 74.29 past the
northeasterly right~of-way line of said 50 foot strip,
also being the southwesterly line of that certain
parcel of land described as Parcel No. 3 in the deed
from Southern Pacific Transportation Company, a
Delaware Corporation, to the County of Alameda, !n a
deed dated November 27, 1985 and recorded December 12,
1985, Series No. 85-264889, official Records of
Alameda County, continuing through said Parcel No. 3,
a total distance of 148.58 feet terminating on the
northeasterly sideline of said Parcel No. 3.

thence, North 52° 44' 52" East, 156.32 feet to a tangent
curve to the right; thence along the arc of said curve,

Section 2. The effect of said right-of-way lines shall be governed by
the provisions of Dublin Ordinance No. 44-87.
Section 3. EFFECTIVE DATE AND POSTING OF ORDINANCE. This Ordinance
shall take effect and be in force thirty (30) days from and after the date of
its passage. The City Clerk of the City of Dublin shall cause this Ordinance
to be posted in at least three (3) public places in the City of Dublin in
accordance with Section 36933 of the Government Code and the State of
California.
