DESCRIPTION:
Philip L. Smith, representing Dublin Town and Country Associates, has
submitted a letter requesting to purchase an approximately 2,600 square foot
piece of property at the southwest corner of San Ramon Road and Amador Valley
Boulevard between the existing property line of the shopping center and the
bike path, as shown on Exhibit 2 attached. An application has been received
by the City's Planning Department to include refacing the existing buildings
in the center, as well as adding a 2,100 square foot retail building on the
southwest corner of San Ramon Road and Amador Valley Boulevard. The new
building will need an additional piece of property in order to meet setback
requirements, as the earthquake fault setback confines the building envelope
on the west.
Section 54222 of the Government Code requires that the City offer this
property to any housing authorities, redevelopment agencies, park and
recreation departments, and the State resources agency before committing to
sell to a private party.
If the property is declared to be surplus and Staff is authorized to enter
into negotiations with the applicant, these agencies will be notified in
writing and will have 60 days to respond. If all agencies decline to purchase
the property or do not respond after 60 days, a resolution of intent to sell
may be adopted, and a public hearing may be held subsequently for final action
(Government Code Sections 37421 et. seq.). This process would only go forward
if the Conditional Use Permit and Site Development Review are approved for the
new building.
In addition, Staff would need to contact utility companies to determine
whether or not any facilities exist which would require easements.
Staff recommends that the City Council authorize Staff to enter into
negotiations for the sale of the property and adopt the resolution declaring
the property to be surplus subject to the approval of the new building.

Dear Lee:
Enclosed are dimensioned plans for the rehab of the above center.
Included is the parcel of land we wish to purchase from the City
as outlined in red. The parcel acquisition is required in order
to continue to meet the setback requirements for this zone. Our
intention is to build a new 2,100 square foot building on the
corner.
Please let me know anything else you need from us in order to
proceed. Once our application for the second phase of
redevelopment is approved, we are prepared to close escrow. We
feel the value established by the City in the past is probably
still accurate even though this center has never done well.
We hope this rehab will make this project revenue generating for
both the City and ourselves.

RESOLUTION NO. -90
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ESTABLISHING SURPLUS PROPERTY
AND DIRECTING STAFF TO NOTIFY APPROPRIATE AGENCIES
WHEREAS, Philip L. Smith representing Dublin Town and Country
Associates has requested the City to enter into negotiations to sell
approximately 2,800 square feet of City property adjacent to San Ramon Road
south of Amador Valley Boulevard in conjunction with development of a new
building adjacent to the subject property; and
WHEREAS, the City Council has authorized Staff to enter into
negotiations for the sale of City property;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Dublin finds that approximately 2,600 square feet of vacant right-of-way
along San Ramon Road south of Amador Valley Boulevard as illustrated in the
attached Exhibit A is surplus land and determined to be no longer necessary
for the City's use.
BE IT FURTHER RESOLVED that the City Council directs Staff to
notify the appropriate agencies of the City's offer to sell the property.
PASSED, APPROVED, AND ADOPTED this llth day of June, 1990.
