FINANCIAL STATEMENT:
Minimal administrative costs associated with
the issuance of the permit
DESCRIPTION: Mr. Richard Heller, on behalf of residents along
Burton Street, has requested permission to close the street on July 4,
1990, for a block party. The closure would affect the entire street
which runs between Tamarack Drive and Amador Valley Boulevard.
The residents of Burton Street have made a similar request each year
for the past several years. Based on records from previous years, it
appears that this is their 10th Annual Fourth of July event. Staff
has prepared recommended Conditions based primarily on those approved
for the 1989 street closure. The one substantive change is that the
group is requesting the closure between 11:00 a.m., and 11:00 p.m. In
the past, the permit was issued until 10:00 p.m. Mr. Heller has
explained to Staff that the additional hour was being requested to
allow them additional time to clear debris from the street. Staff has
modified the condition establishing the time of the event to coincide
with the applicant's request. The applicant has concurred with all of
the conditions. In the past, the City Council has waived the cost of
the issuance of an encroachment permit.
The City currently offers as a service an insurance program which
meets the $1 million requirement for encroachment permits. The
applicant reimburses the City for the premium and the City absorbs
administrative and surcharge costs. Mr. Heller has purchased an
insurance certificate covering this event.
Staff recommends that the City Council authorize the city Engineer to
issue a permit including the proposed conditions and that the permit
fee be waived.

Issuance Subject to Approval by the City Council at their meeting
on June 11, 1990.
Prosecution of Work: All work authorized by Ihe permit shall be performed in a workmanlike, diligent, and expeditious manner, and must be com-
pleted to the satisfaction of the Director of Public Works.
Liability and Damages: The permitlee shall be responsible for all liabilily imposed by law for personal injury or property damage which may arise
our of the work permitted and done by permittee under this permit, or which may arise out of the lailure on the part of the permittee to perform
his obligafions under said permit in respect to maintenance and encroachment. The permittee shall protect and indemnify the City of Dublin, its
officers and employees, and save them harmless in every way from all action at law for damage or injury to persons or property that may arise out
of or be occasioned in any way because of his operations as provided in this permit.

The date of the street closure shall be July 4, 1990.
The hours of the street closure shall be 11:00 a.m. to 11:00 p.m.
Sufficient barricades shall be provided by the homeowners. Due %o the
use of barricades after dark, barricades shall be equipped with
flashing safety lights.
Barricades shall be supervised by responsible person(s) in the event
traffic or emergency vehicles need to enter or exit Burton Street.
Noise shall be maintained at an acceptable level.
Responsible person(s) shall insure that any consumption of alcoholic
beverages is limited to adult attendees over age twenty-one. No sales
of Alcoholic Beverages are permitted by this permit.
Barricades shall be removed from the public street at the conclusion
of the event. In no case shall barricades remain in the street after
11:00 p.m.
Permittee shall be responsible for removing all litter and debris from
the public street.
Any use of fireworks shall be limited to authorized "safe and sane"
fireworks. The use of such fireworks shall be supervised by adults
and in accordance with all manufacturers' instructions. Issuance of
permit by City does not imply or assume any responsibility or
liability on behalf of City, arising from use of fireworks.
Applicant shall provide a Certificate of Insurance which names the
City of Dublin as an add£~ional insured for the event. The minimum
acceptable limits of insurance is $1 million per occurrence.
Applicant shall complete Encroachment Permit Application and submit an
acceptable Certificate of Insurance or obtain required insurance no
later than June 30, 1990.

Dear Mr. Heller:
At the regular City Council meeting on June 11, 1990, the City Council
approved your request as outlined in the enclosed permit.
Please note that you are responsible to assure that all conditions of
the permit are followed. The City Council approved your request to
extend the event time to 11:00 p.m. As you explained in our telephone
conversation, this extension over prior years will provide you with
adequate time to clean up the area. You should have already received
your certificate, which was mailed under separate cover.
