REPORT PREPARED BY: Maureen O'Halloran, Senior Planner EXHIBITS ATTACHED: Exhibit A: Draft Ordinance Amending the Zoning RECOMMENDATION: 1) Open Public Hearing and hear Staff presentation 2) Take testimony from Applicant and Public (2/ Op_ 3) Question Staff, Applicant and Public / 4) Close Public Hearing and deliberate `M,01 5) Staff recommends the City Council waive the second reading and adopt Ordinance (Exhibit A) FINANCIAL STATEMENT: None DESCRIPTION: At the June 25, 1990 City Council Meeting, the Council introduced an ordinance amending the zoning and adopted resolutions approving 1) the Negative Declaration; 2) the General Provisions for the Planned Development Prezoning; 3) the Tentative Map; 4) the Property Tax Exchange; and 5) the Annexation application to LAFCO. The Planned Development Prezoning Ordinance amending the zoning would allow for 10+ acres of single family residential custom lots (17 lots) , 16+ acres of multi-family residential (300 condominium/apartments) and 170+ acres open space/parkland. The proposed zoning is consistent with the City' s General Plan land use designation and policies affecting the site. Staff recommends the City Council waive the second reading and adopt the ordinance, prezoning the site Planned Development PA 89-125 Donlan Canyon. COPIES TO: Applicant Owner ITEM NO. 641 PA 89-125 Project Planner Agenda File -1- ORDINANCE NO. - 90 AN ORDINANCE OF THE CITY OF DUBLIN AMENDING THE ZONING ORDINANCE TO PERMIT THE PREZONING OF REAL PROPERTY LOCATED NORTH OF THE WESTERN TERMINUS OF DUBLIN BOULEVARD The City Council of the City of Dublin does ordain as follows: Section 1. Chapter 2 of Title 8 of the Dublin Municipal Code is hereby amended in the following manner: Approximately 196+ acres consisting of lands fronting along the north side of Dublin Boulevard, more specifically described as Assessor's Parcel Number 941-18-3 and 941-18-4, is prezoned to a PD Planned Development District, PA 89-125 Donlan Canyon, as shown on Exhibit B (Negative Declaration of Environmental Significance), Exhibit C (Approval, Findings and General Provisions of the PD, Planned Development Prezoning), and Exhibit D (Tentative Map Approval) on file with the City of Dublin Planning Department, are hereby adopted as regulations for the future use, improvement, and maintenance of the property within this District. This Ordinance shall take effect and be enforced thirty (30) days from and after its passage. Before the expiration of fifteen (15) days after its passage, it shall be published once, with the names of the Councilmembers voting for and against the same, in a local newspaper published in Alameda County and available in the City of Dublin.
