FINANCIAL STATEMENT:
The Ordinance will have no financial impacts.
DESCRIPTION:
Ordinance 7-90, establishes the right-of-way lines for the two
lane access road connecting to the Hacienda Interchange and
parallel to Interstate 580. The City Council adopted the
ordinance on May 29, 1990 . Since that action staff determined
that the legal description needs to be revised.
Staff recommends that the City Council waive the reading and
introduce the ordinance amending Ordinance No. 7-90.

AN ORDINANCE OF THE CITY OF DUBLIN
AMENDING ORDINANCE NO. 7-90
ESTABLISHING RIGHT-OF-WAY LINES FOR THE TWO-LANE ACCESS ROAD
CONNECTING TO THE HACIENDA INTERCHANGE AND
PARALLEL TO I-580, PA 90-033
The City Council of the City of Dublin does ordain as follows:
Section 1. Ordinance No. 7-90, adopted on May 29, 1990, is
hereby amended by substituting the attached legal description, marked
Exhibit A, in place of the legal description attached to said
Ordinance.
Section 2 . Effective Date and Posting of Ordinance
This Ordinance shall take effect and be in force thirty (30) days
from and after the date of its passage. The City Clerk of the City of
Dublin shall cause this Ordinance to be posted in at least three (3)
public places in the City of Dublin in accordance with Section 36933
of the Government Code of the State of California.

lying 65 feet southerly of, and 45 feet northerly of the following.described line:

recorded June 5, 1984, in Book 144 of Maps, at Pages 3 th'ru 5, Office of the Recorder,
County of Alameda, said point also being on the south.westerly'right-of-way line of a
50'strip belonging to Southern Pacific Transportation Con pany,thence northwesterly
along the southwesterly side line of said 50' foot strip, and the easterly line of said

AN ORDINANCE OF THE CITY OF DUBLIN
ESTABLISHING RIGHT-OF-WAY LINES FOR`•THE TWO LANE ACCESS ROAD
CONNECTING TO THE HACIENDA INTERCHANGE
AND PARALLEL TO INTERSTATE 580, PA 90-033
The City Council of the City of Dublin does ordain as follows :
WHEREAS, the City Council adopted a Resolution calling for a public
hearing to consider future right-of-way lines for the two lane access road
connecting the Hacienda interchange and parallel to Interstate 580 (Resolution
No. 50-90) and set a public hearing for May 14, 1990 at 7:30 p.m. to hear
objections to the establishment of said right-of-way lines; and
WHEREAS, proper notice of said public hearing was duly given; and
WHEREAS, no protests were made either in writing or orally to the
establishment of said right-of-way lines.
NOW, THEREFORE, the City Council finds and ordains that:
Section 1. Right-of-way lines are hereby established for the two lane
access road connecting the Hacienda interchange and parallel to Interstate 580
as follows:
All that certain real property situate in City of Dublin, State of
California, described as follows:
A strip of land of the- uniform width of 110 feet measured at right
angles , and lying 65 feet southerly of, and 45 feet northerly of the
following described line:
Commencing at the southeasterly corner of Tract 4978, as said Tract
was recorded June 5, 1984, in Book 144 of Maps, at Pages 3 through
5, Office of the Recorder, County of Alameda, said point also being
on the southwesterly right-of-way line of a 50 foot strip belonging
to Southern Pacific Transportation Company, thence northwesterly
along the southwesterly side line of said 50 foot strip, and the
easterly line of said Tract 4978 , North 46° 29' 26" west, 49 .77
feet; to the True Point of Beginning; thence, leaving said -
sidelines, South 88 47' 37" East, at 74.29 past the northeasterly
right-of-way line of said 50 foot strip, also being the
southwesterly line of that certain parcel of land described as

to terminate on the West at the northeasterly sideline of said Arnold
Road as it now exists, and on the East at the westerly sideline of
Tassajara Road as it exists now.
Section 2. The effect of said right-of-way lines shall be governed by
the provisions of Dublin Ordinance No. 44-87 .
