Federal Aid Urban (FAU) Program Supplement No. 5
San Ramon Road Phase IV Project

RECOMMENDATION:
Adopt resolution approving Program Supplement No. 5 to
the Local Agency - State Agreement for Federal Aid
Projects No. 04-5432 and authorizing Mayor to execute
the Agreement.
FINANCIAL STATEMENT: None.
DESCRIPTION:
The Program Supplement is a project-specific agreement which attaches to the
master City-State Agreement. It binds the City, among other things, to non-
discrimination in contracting for federally-funded projects and maintenance of
the completed work.
This is one of the documents that is required in order for the City to use the
allotted $1,796,325 in FAU funds for this project. The funds are broken down
as follows:

500,000 from Tri-Val]ey allocation
1,216,000 purchased from Foster City
80,325 from leftover FAU monies purchased from
San Luis Obispo for the San Ramon Road
Phase iii project
The attached Program Supplement No. 5 document specifies $1,716,000 in Federal
funds; however, the City is able to add the $80,325 in unused funds from San
Ramon Road Phase III once Ca].trans has completed its closeout of the Phase III
project and the last Federal payment.
If the bids for the San Ramon Road Phase IV project come in sufficiently below
the Engineer's Estimate, and some FAU funds will remain unused, then the City
Council will have the option of transferring FAU funds to the Dublin Boulevard
Widening project or releasing some of the purchased funds back to Foster City.
Staff recommends that the City Council adopt the resolution approving the
Program Supplement and authorizing the Mayor to execute same.

OF THE CITY OF DUBLIN
APPROVING PROGRAM SUPPLEMENT NO. 5 TO LOCAL AGENCY - STATE AGREEMENT
NO. 04-5432 FOR FEDERAL AID PROJECTS
AND AUTHORIZING THE EXECUTION OF THE AGREEMENT
WHEREAS, the City of Dublin has signed a Master Agreement
(Agreement No. 04-5432) with the State for the Federal Aid Program; and
WHEREAS, the City of Dublin intends to undertake a street project
on San Ramon Road from Vomac Road to Si]vergate Drive; and
WHEREAS, the State of California Department of Transportation has
prepared and submitted to the City of Dublin two copies of Program Supplement
No. 5 to Local Agency - State Agreement No. 04-5432; and
WHEREAS, said project wi]] qualify for Federal funds provided
that the City of Dub]in has approved Program Supplement No. 5 to Local Agency
- State Agreement No. 04-5432; and
WHEREAS, it is in the best interest of the City of Dublin to
approve said Program Supplement No. 5 to Local Agency - State Agreement No.
04-5432; and
WHEREAS, said Program Supplement No. 5 to Local Agency - State
Agreement No. 04-5432 is attached hereto and made a part hereof;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Dub]in hereby approves this Agreement and authorizes the Mayor to execute
same.

Project on San Ramon Rd. from Silvergate Dr. to Vomac Blvd..

appropriate officials, and enter the resolution number and date of execution
on the first page. Return both copies of the Supplement together with a
certified copy of the City Council's Resolution approving the Program and
authorizing its execution.
Following our execution of the Supplemental Agreement, we will return a
copy for your files.

This Program Supplement is hereby incorporated into the Local Agency-State
Agreement for Federal Aid which was entered into between the Local Agency and
the State on 12/12/83 and is subject to all the terms and conditions thereof.
This Program Supplement is adopted in accordance with Paragraph 2 of Article
II of the aforementioned Master Agreement under authority of Resolution No.
, approved by the Local Agency on (See copy attached).
The Local Agency further stipulates that as a condition to payment of funds
obligated to this project, it accepts and will comply with the covenants or
remarks setforth on the following pages.

SPECIAL COVENANTS OR REMARKS

Ail maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will be
performed by the Local Agency at regular intervals or as
required for efficient operation of the completed
improvements.
The Local Agency will advertise, award, and administer this
project and will obtain the State's concurrence prior to
either award or rejection of the contract.
The Local Agency agrees the payment of Federal funds will be
limited to the amounts approved by the Federal Highway
Administration in the Federal-Aid Project Agreement (PR-2)/Detail
Estimate, or its modification (PR-2A) or the FNM-76, and accepts
any increases in Local Agency Funds as shown on the Finance or
Bid Letter or its modification as prepared by the Division of
Local Streets and Roads.
In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the 'Nondiscrimination Assurances'
contained in the aforementioned Master Agreement for
Federal-Aid Program.
Whenever the local agency uses Federal or State Funds to pay a
consultant on a cost plus basis, the local agency is required to
submit a post audit report covering the allowability of cost
payments for each individual consultant or sub-contractor incur-
ring over $25,000 on the project. The audit report must state the
applicable cost principles utilized by the auditor in determining
allowable costs as referenced in CFR 48, part 31, Contract Cost
Principles.
