RECOMMENDATIONS: ( 1) Approve exemption from competitive bid process A (Purchase Ordinance, Section #5, paragraph (b) . �r (2) Authorize staff to purchase one (1) Mobil traffic zone radar speed trailer from MOBIL TRAFFIC ZONE INC. ( 3) Authorize a budget transfer from the Contingent Reserve in the amount of $88.00 FINANCIAL STATEMENT: Estimated purchase price of trailer is $7587.94 . Budget amount is $7 ,500.00; transfer of $88.00 from the Contingent Reserve to Police Departments Capital Outlay Fund. DESCRIPTION: At the October 8, 1990, City Council meeting, staff was directed to pursue the purchase of a special radar trailer and associated equipment. The Council approved the transfer of $7500 .00 from the Contingent Reserve to the Police Department's Capital Outlay Account for the purchase of the trailer. Nine police agencies were contacted to determine if they had a radar trailer and if they did, who they purchased it from. The agencies contacted were: Livermore, Pleasanton, Oakland, Berkeley, Alameda, Stockton, Albany, Manteca and Tracy police departments. Of the agencies contacted, Livermore, Stockton, Berkeley and Alameda police departments have mobil radar trailers. The other agencies had either a sign board, a unit made from spare parts, or they had no unit at all . All the agencies that had a mobil radar trailer purchased their trailer from MOBIL TRAFFIC ZONE INC. Staff was advised that MOBIL TRAFFIC ZONE INC. is the sole provider of the unit. Staff was also advised that each agency received bid exemption from their city in order to purchase the trailer. Staff received a letter in early November from the attorney for MOBIL TRAFFIC ZONE INC. The letter states that MOBIL TRAFFIC ZONE INC. has a patent pending for the concept of a portable radar speed monitoring device and the city of Dublin could possibly breach proprietary rights by asking for bids with specification information gained through contact with MOBIL TRAFFIC ZONE INC. It was determined that one other company from southern California, DYCO TRAILER, does manufacture a similar trailer. In order for DYCO TRAILER to build the radar trailer, they require the agency to supply all of the individual parts. DYCO then puts together a unit from the parts supplied by the city. It is possible that this would enter the city into litigation as DYCO is currently in litigation with MOBIL TRAFFIC ZONE INC. However, Section 5(b) of the ordinance does provide an exception to the competitive bid process "Where the City's requirements can be met solely by a single patented article or process" . RECOMMENDATION: It is Staff's opinion that MOBIL TRAFFIC ZONE, INC. is the sole provider of the radar trailer. Therefore, it is recommended that the City Council approve an exemption from the competitive bid process as outlined in the Purchasing Ordinance. Authorize purchase of the Mobil radar traffic trailer at a total cost of $7,587.94 , from Mobile Traffic Zone, Inc. I understand that the purpose of putting this information out to the public is to solicit competitive bids. However, you will note, my client's literature includes an indication that a patent is pending for the concept of a portable radar speed monitoring device (copy enclosed). Disclosure by the Dublin Police Department of any information obtained through contact with my client or its radar unit would be a breach of my client's proprietary rights and trade secrets. If anyone other than Mobile Traffic Zone should construct a similar radar trailer, it is possible they would be committing patent infringement. The Dublin Police Department should not be soliciting acts which would subject the solicited party to possible legal liability for patent infringement. We are conscious of the Police Department's need to protect its interest in minimizing the cost of items it purchases. In this regard my client would be willing to disclose his expenses regarding the materials, construction and labor in building the units, in order that the Dublin Police Department can be assured that undue profits are not being made in this regard. The Giant Display is manufactured by Mobile Traffic Zone, Inc. The trailer is fully self-contained and is designed to be an independent unit.The solar panel recharges the batteries and only needs to be turned on to activate the entire unit. The solar panel and controller are on Models#5900 and #5901 only. No one needs to remain with ®® the trailer.
