FINANCIAL STATEMENT: Dublin's share of the cost for development of the
program is $7,037.55. Funds have not been budgeted
for this purpose for FY1990-91.
The nonpoint source control management program is new
and is being formulated as the studies evolve.
Alameda County is patterning its process after Santa
Clara County, which is about one year ahead of Alameda
County. The $7,037.55 cost was not anticipated during
development of the FY1990.-91 budget.
DESCRIPTION: In August of 1987, the City Council approved an
agreement for an initial Alameda County study plan regarding evaluation of
nonpoint source of water pollution. Nonpoint source pollution is pollution
which is carried by storm water runoff, as opposed to point source pollution
which comes directly from factories and sewer treatment plants. This program
is the result of requirements set forth by the Environmental Protection
Agency's Clean Water Act. The Regional Water Quality Control Board is locally
responsible for enforcing this program.
In February of 1989, the City Council approved the second phase agreement for
cost-sharing of the Nonpoint Source Pollution Evaluation Plan, which set up
stream monitoring stations on major creeks to determine base year pollutant
loading for various intensities of storms and storm flow in the creeks.
Dublin's total share of the cost of this study was $20,980. Two installments
have been paid, with the third $6,990 installment budgeted to be paid this
fiscal year. Alameda County has assumed the role of coordinator for the
program on a County-wide basis, and the Nonpoint Source Control Task Force
(also called the Urban Runoff Clean Water Program Task Force) is made up of
representatives from the County and the various cities involved.
Upon recommendation by the Task Force, the Alameda County Board of Supervisors
approved and executed extended agreements with Woodward-Clyde Consultants and
with Eisenberg, Olivieri, and Associates, Inc. , on November 13, 1990. These
contracts provide for development of a nonpoint source control management
program permit application by June 30, 1991, in connection with the Regional
Water Quality Control Board's National Pollutant Discharge Elimination System
(NPDES) permit application deadline. The total amount of the two consultant
contracts is not to exceed $300,750. Dublin's share of this amount is
$7,037.55, the determination of this share being pro-rated one-half on
population and one-half on land area.
This program may ultimately require implementation of measures to control
pollution in storm water runoff, such as increased street sweeping, oil
recycling stations, and possibly even low flow treatment of storm waters.
Staff recommends that the City Council adopt the resolution approving the
agreement, authorize the Mayor to execute the agreement, and authorize a
budget transfer in the amount of $7,037.55 from the Contingent Reserve.

WHEREAS, the Regional Water Quality Control Board, in carrying
out the Federal Clean Water Act, has established certain requirements for
local agencies within Alameda County for the preparation of a detailed
evaluation of non-point source pollution by June 30, 1991; and
WHEREAS, the various local agencies propose to prepare a combined
management program with Alameda County as lead agency; and
WHEREAS, the City of Dublin's pro-rata share of the cost of
preparing the program is $7,037.55;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Dublin approves this joint Agreement Regarding Development of a Proposed
Alameda County Nonpoint Source Control Management Program and authorizes the
Mayor to execute the Agreement.

MANAGEMENT PROGRAM
Alameda County Flood Control and Water Conservation District (hereinafter
DISTRICT) , a local public agency of the State of California:
City of Alameda, a municiple corporation;

City of Dublin, a municiple corporation;
City of Livermore, a municiple corporation;
City of Piedmont, a municiple corporation;
City of Pleasanton, a municiple corporation;
AGREE this day of 1991, as follows:
RECITALS:
A. The San Francisco Bay Regional Water Quality Control Board
requires that local agencies within the County of Alameda, including the
parties to this agreement, develop a proposed Alameda County Nonpoint Source
Control Management Program (hereinafter Program), and that this proposed
Program be complete and suitable for implementation on or before June 30,
1991.
B. To guarantee timely continuance of the preparatory work leading to
the development of an acceptable Program by the June 30, 1991 deadline,
DISTRICT modified and amended existing Agreements with Woodward-Clyde
Consultants, Inc. and Eisenberg, Olivieri, and Associates, Inc. , upon the
recommendation and on behalf of the Alameda County Nonpoint Source Control
Task Force (see "Exhibit A", Task Force Member Agencies) to develop the
proposed Program by completing the tasks specified in "Alameda Nonpoint
Source Control Program NPDES Permit Application" (Exhibit C).
C. These contracts were executed by the Alameda County Board of
Supervisors with the understanding that DISTRICT would be reimbursed the
costs of developing this Program by the Task Force Member Cities/Agencies.
D. This Agreement provides for the allocation of costs to the seven
cities (Alameda, Albany, Berkeley, Dublin, Livermore, Piedmont, Pleasanton)
not in a DISTRICT Zone where benefit assessment fees are paid, and for the
reimbursment of these seven cities' costs to DISTRICT.
E. There are seven cities within Alameda County where DISTRICT
benefit assessment fees are collected. Their costs will be paid from the
appropriate DISTRICT Zone benefit assessment reserves.
AGREEMENT:
1. A task force consisting of representatives of agencies specified
in "Exhibit A" (Alameda County Nonpoint Source Control Task Force Member
Agencies) , attached hereto and made a part hereof, shall oversee and guide
the development, by the consultants so engaged, of the Program mentioned in
Recital B above.
2. The parties shall share the costs of the Program in the
proportions stated In "Exhibit B" (Schedule of Cost Sharing for the
Development of the Alameda County Nonpoint Source Control Management
Program) , attached hereto and made a part hereof. The indicated amounts are
based on populations and runoff contributing areas of the respective
jurisdictions, and are the same proportions as those developed for the
monitoring program currently in progress.
3. DISTRICT is providing a coordinating role in the development of
this Program, and has secured the services of consultants to perform the
services specified in "Exhibit C" ("Alameda Nonpoint Source Control program
NPDES Permit Application") , attached hereto and made a part hereof, in
accordance with DISTRICT procedures on selection of professional
consultants. The DISTRICT's contracts with the consultants contain hold
harmless and indemnity provisions for the benefit of all parties to this
agreement.
4. The total Program costs to be apportioned shall not exceed
$300,750.00
5. This agreement shall be effective upon execution by the Parties.
6. The DISTRICT will invoice each city in March of 1991 for their
share of the Program's costs. Any adjustments to total costs will be made
and invoiced upon completion of work contracted for by the DISTRICT on
behalf of the Task Force.

MODIFICATION OF AGREEMENT
The Alameda County Flood Control and Water 'Conservation District v
(hereinafter referred to as DISTRICT) and Woodward-Clyde Consultants, Inc.
(hereinafter referred to as CONSULTANT) hereby agree as follows: \
1. Recitals and Purposes
A. DISTRICT and CONSULTANT did, on October 25, 1988, by DISTRICT
Contract No. C-88-872, execute an agreement whereby DISTRICT
retained CONSULTANT to provide professional expert services �Q
in the field of nonpoint source pollution. �(
B. DISTRICT desires to receive additional technical assistance V
in the development of a Nonpoint Source Control Management
Program.
2. Modification
A. DISTRICT and CONSULTANT agree that SCOPE OF WORK, EXHIBIT A,
as delineated in the original agreement shall be modified to
add the tasks s ecified in EXHIBIT Al - "MODIFIED SCOPE OF
WORK" (attached.
B. DISTRICT and CONSULTANT agree that the amount specified in
EXHIBIT B "PAYMENT SCHEDULE" in the original agreement will
be increased from $1,100,000 to $1,230,350.
C. It is understood and agreed that all remaining portions of
the agreement number C-88-872 dated October 25, 1988, shall
remain in full force and effect as if fully set forth herein.
D. It is understood and agreed that the termination date of
Agreement C-88-872 shall be extended until December 31, 1991.
3. Additional Conditions Required By The District
A. NON-DISCRIMINATION: CONTRACTOR assures that he/she will
comply with Title VII of the Civil Rights Act of 1964 and
that no person shall , on the grounds of race, creed, color,
disability, sex, sexual orientation or national origin, age,
religion , Vietnam era Veteran ' s status , political
affiliation, or any other non-merit factors be excluded from
participation in, be denied the benefits of, or be otherwise
subjected to discrimination under this agreement.
B. DRUG-FREE WORKPLACE; CONTRACTOR and CONTRACTOR's employees
shall comply with the COUNTY's policy of maintaining a drug-
free workplace. Neither CONTRACTOR nor CONTRACTOR ' s
employees shall unlawfully manufacture, distribute, dispense,
possess or use controlled substances, as defined in 21 U.S.
Code section 812, including marijuana, heroin, cocaine, and
amphetamines , at any COUNTY facility or work site. If
CONTRACTOR or any employee of CONTRACTOR is convicted or
pleads nolo contendere to a criminal drug statute violation
occurring at a COUNTY facility or work site, the CONTRACTOR
within five days thereafter shall notify the head of the
COUNTY department/agency for which the contract services are
performed. Violation of this provision shall constitute a
material breach of this agreement.

INTRODUCTION AND PROJECT ORGANIZATION
The Alameda County Nonpoint Source Control Program is preparing to submit a NPDES permit
application for storm sewer discharges from Alameda County and its municipalities to San
Francisco Bay. Tasks necessary to complete the NPDES permit application have been detailed in
the Draft Preliminary Workplan submitted jointly by Woodward-Clyde Consultants (WCC) and
Eisenberg, Olivieri, and Associates, Inc. (EOA) to the Alameda County Task Force on August 24,
1990.
This Scope of Work represents Woodward-Clyde's and EOA's approach to meeting permit
application requirements of the San Francisco Bay Regional Water Quality Control Board. It is
subdivided by tasks with a numbering system consistent with the Draft Preliminary Workplan.
For reference, we have included a listing of the firm performing each task
The Alameda County Flood Control and Water Conservation District provides overall
administrative management for the Alameda County Nonpoint Source Control Program. Assisting
in program administration is the Task Force committee, which consists of representatives from
municipalities in Alameda County, the Technical Advisory Committee, and EOA who conducts
program review.
This Scope of Work provides a detailed description of the tasks that Woodward Clyde will
perform, a time schedule for the deliverables, and an estimate of the budget for each task. The
tasks are scheduled to be completed in a time frame which allows for the permit application to be
submitted to the Regional Board by July 1, 1991. A summary of the budget is provided in Figure
2 at the end of Section 2.0.
The Woodward-Clyde Project team assembled to complete this Scope of Work will be under the
leadership of Dr. Peter Mangarella, Responsible Professional and Mr. Michael Drennan,Project
Manager. The project will be managed under four major tasks, each of which will be assigned a
task leader: Public Information and Participation, Source Identification and Elimination,
Stormwater Conveyance and Storage, and Monitoring. All of these tasks contribute to the
development of a report entitled the "Management Program to Control Pollutants from Storm
Sewers in Alameda County" to the maximum extent practicable. This Management Program will
be the cornerstone of the pen-nit application prepared for submittal to the Regional Board.

WORKPLAN
1. Prepare agreement for Co-Applicants of NPDES Permit
EOA to perform this task.

4. Develop a Proposed Management Program to Control Pollutants from Municipal
Storm Sewers to the Maximum Extent Practicable.
WCC to perform this task. Budget $22,610
The purpose of this task is to prepare a report entitled the "Proposed Management Program to
Control Pollutants from Storrn Sewers" which combines the various Program Components defined
in detail below. The program will identify and describe potential source and structural control
measures, describe which control measures will be implemented, and describe the planning
process which will be used to evaluate and possibly incorporate additional control measures.
Preparation of the report will include coordination of all Program Components listed below,
presentation of the draft report to the Task Force, and individual cities as needed, and revision of
the draft to incorporate comments prior to July 1, 1991.
For each of the proposed program components listed below the following information will be
provided: a description of major tasks necessary to implement the program component,
identification of whom will implement the various tasks within the program component,
development of a time schedule, and a final budget for implementation.

4a. Prepare proposed public information and participation program component.
WCC to perform this task. Budget $17,418
A necessary element of a management program to control pollutants in storm sewers is a Public
Information and Participation Program. This Program Component will outline the strategy to
inform the public about the Proposed Management Program to Control Pollutants from Storm
Sewers in Alameda County, and to involve the public in participating in the Program. A plan will
be prepared which will describe all the major tasks required to implement a public information and
participation program. The plan will also include a description of who will be responsible for
implementing the various tasks, a time schedule for implementation, and a final budget for
implementation.
4b. Prepare proposed source identification and elimination program component.
There are five program elements that make up the source identification and elimination program
component. A description of each program element and its corresponding budget are presented
below.
4b.1) Illicit connections and illegal dumping identification and elimination
program element.
WCC to perform this task. Budget $24,560
a. Identify the programs and activities the cities and county currently have in place to identify
illicit connections and illegal dumping.
b. Based on the preceding information, develop a detailed plan for supplementing the current
programs to identify and to eliminate unknown or intended cross connections which result
in industrial or sanitary wastes being discharged to the municipal storm sewer systems and
to identify and prevent the illegal dumping of solid and liquid wastes into municipal storm
sewers or areas which drain to municipal storm sewers. The plan will describe all the
major tasks required to implement the illicit connections and illegal dumping elimination
programs. The plan will also include a description of who will be responsible for
implementing the various tasks, a time schedule for implementation, and a final budget for
implementation. The plan will be coordinated with the activities conducted as part of the
industrial dischargers runoff identification and control program to minimize duplication of
efforts.
C. Prepare a plan to conduct field screening to detect illicit discharges and illegal dumping
during the summer of 1991. The plan will describe in detail the activities which will be
undertaken, the roles and responsibilities of the participants, a time schedule, and a final
cost estimate.

4b.2). Industrial discharger identification, certification, and runoff control
program element.
EOA will perform parts (a) and (b) of this task, WCC will perform parts (c), (d), and (e).
WCC Budget $20,294
a. Develop a priority list of the type of industries of potential concern for discharging
pollutants to the storm sewer and develop a phased approach to identifying and
characterizing these potential sources using SIC codes or other criteria.
b. For the highest priority industries develop a data base which inventories potential sources
of pollutant and which contains the following information. The name, address, location,
and a description of each significant facility which may discharge water associated with
industrial activity to the municipal storm sewer system and of operating or closed landfills.
The location of known discharges to the storm sewer system which have NPDES permits
will be updated since the May 1988 report by EOA,Inc. The sources of information will
include SARA Title III reports,pretreatment information,Alameda County's Hazardous
Materials Management Program, and the Regional Board records.
C. Develop a survey form and a plan to conduct a survey of the highest priority industries
identified in Task 4b(2a). The purpose of the form will be: to deterrrrune whether
stormwater runoff or other waters discharge to storm sewers or discharge directly to waters
of the State; to determine whether the industry has an NPDES permit and/or an industrial
wastewater permit to discharge to a sanitary sewer and, if so, obtain a copy of the permit;
to determine list of pollutants in permit and effluent guidelines; to determine existing
stormwater and wastewater management practices; to identify any areas or activities that
may release pollutants to storm sewers; and to obtain discharge characteristics, topographic
map, and description of material management practices. The plan developed will include a
detailed description of who will conduct the survey, a time schedule, and a final budget.
d. Notify industries identified in Task 4b(2a). about this new regulatory program, the survey
that will be conducted, and the need for them to identify control measures to reduce
pollutants in stormwater to the maximum extent practicable and to certify that only
stormwater is discharged to municipal storm sewers.
e. Develop a plan for certifying that industries only discharge stormwater to municipal storm
sewers and that industries have taken measures needed to reduce the discharge of pollutants
in stormwater tributary to the municipal sanitary sewers to the maximum extent practicable.
In addition the plan will describe the activities that will be undertaken, such as inspections
and monitoring,roles and responsibilities, a time schedule, and financial resources that will
be needed.
4b.3). Prepare a construction site control program element

Identify the status of current programs and policies to control nonpoint source pollution from new
development or significant redevelopment, both in the planning process of new development and
the implementation process. Develop a plan to improve the control program including a description
of major tasks,responsibilities of participants, a time schedule, and a final cost estimate.
4b.5). Prepare a municipal public works operations and maintenance program
element.

Identify existing municipal operations, maintenance, and other programs that affect or control

Identify current activities by the cities, the county, and others to operate and maintain stormwater
conveyance systems in a manner which controls nonpoint source pollution. Develop a plan to
improve the existing activities including a description of major tasks such as pilot studies,
responsibilities of participants, a time schedule, and a final cost estimate.
4d. Prepare a proposed monitoring program component to identify sources,
pollutants, toxicity, and evaluate effectiveness of control measures.

Each of the following elements of the proposed monitoring program element will include a
definition of roles and responsibilities, a time schedule for implementation, and a final cost
estimate.
1. Develop a proposed routine monitoring program to continue to develop a long-term and
general characterization of pollutant and toxicity concentrations and loadings.
2. Develop a proposed monitoring program to identify and to characterize sources of
pollutants to the storm sewer system.
3. Develop a proposed monitoring program to assess the effectiveness of the control measures
being implemented and to identify improvements in the effectiveness of the controls being
implemented or considered for implementation.

b. Identify potential sources of revenue to support the Management Program and other related
activities and identify any legal restrictions on the use of such funds.
c. Select the methods that will be used to generate revenue for the Management Program.

The purpose of this subtask is to provide the project team with a reserve of funds in the event of
unforeseen problems occur such as the need for additional meetings with City or County
personnel.
