RECOMMENDATION: Approve and authorize the execution of
the Second Amendment to the Agreement.
FINANCIAL STATEMENT: Funding in the Amount of $1 , 500 has been requested
and was included as part of the Proposed 1991-92
Budget.
DESCRIPTION: As part of the 1990-91 Budget deliberations, the City
Council considered a request for funding from the Livermore Amador Valley
Transit Authority. (LAVTA) The request was approved by the City Council
and LAVTA has made a similar request for Fiscal Year 1991-92.
LAVTA provides Dial-A-Ride services to elderly and handicapped residents.
LAVTA began providing the service to Dublin residents on July 1 , 1988. The
original agreement between the City and LAVTA provided for a City
contribution for Fiscal Year 1988-89 only. As part of Budget deliberations
last year, the City Council approved an appropriation of $1 ,500. These
funds were used to assist LAVTA in meeting requirements for fare box
recovery. The Transit Authority has determined that funds will also be
required in Fiscal Year 1991-92 to meet current service levels. Exhibit 3
is a letter from the LAVTA General Manager identifying alternatives, which
were evaluated. In addition to contributions from the Cities of Dublin and
Livermore, LAVTA will utilize a combination of special transportation
funds.
Staff has prepared a proposed amendment to the original agreement. Staff
recommends that the City Council approve the amendment and authorize its
execution.

This Agreement is entered into this day of June, 1991 by and
between the Livermore/Amador Valley Transit Authority (Hereinafter
referred to as "AUTHORITY" ) and the City of Dublin, a municipal
corporation (hereinafter referred to as "CITY" ) .
WHEREAS, the AUTHORITY and the CITY entered into an agreement dated
March 28, 1988, whereby the AUTHORITY assumed operation of City' s Dial-
A-Ride Paratransit Service for special transportation of elderly and
handicapped persons; and
WHEREAS, Section 2 of Said Agreement limited the City of Dublin' s
obligation to provide funding to a contribution for Fiscal Year 1988-89
only; and
WHEREAS, in an amendment dated August 13, 1990, the City of Dublin
agreed to make a contribution for Fiscal Year 1990-91 ; and
WHEREAS, PUC 99268. 5 and MTC Resolution Number 1209 set a fare local
match ratio of 10 percent for operators qualifying as "Special Transit
Service" claimants; and
WHEREAS, the AUTHORITY cannot meet the 10 percent fare local match ratio
through passenger fares alone; and
WHEREAS, the Dublin City Council appropriated a contribution to the
AUTHORITY of $1 , 500 in the approved Fiscal Year 1991 -92 Budget.
NOW, THEREFORE, the parties agree as follows:
A. Section 2 of the agreement dated March 28, 1988 shall be
amended to read as follows:
Section 2 . The CITY shall provide a contribution to AUTHORITY
for Fiscal Year 1991-92 in an amount of One Thousand Five
Hundred Dollars ($1 , 500) . This funding shall be used by
AUTHORITY to conform to the PUC mandated fare local match
ratio of 10 percent for the Dublin Dial-A-Ride Service.

Dear Richard:
The LAVTA Board of Director's voted yesterday to request the
cities of Dublin and Livermore to support Dial-A-Ride services
in their cities by contributing $1,500 and $6,000 respectively.
This contribution is equal to the amount contributed last year
by each of the cities.
Background
Dial-A-Ride services in the cities of Livermore and Dublin is
funded through a combination of California Transportation
Development Act (TDA) Article 4.5 funds, Measure B funds and
passenger fares. For fiscal FY1991-92, LAVTA anticipates that
these funds will fall $20,000 short of the amount needed to
provide last year's level of Dial-A-Ride service.
Alternatives
The alternatives to city contributions would be:
1. A fare increase
Originally, a committee of our Board of Directors
recommended this solution. However, a preliminary
interpretation of the American's with Disabilities Act
indicates that Dial-A-Ride fares cannot exceed twice
the fixed route fare including discounts. Since our
current fixed route fare for elderly and disabled
passengers is $.25, our Dial-A-Ride fare cannot exceed
its current rate of $.50.
2. Reduce service
LAVTA sees this option as unacceptable and would onl)(/
reduce service as a last resort.

3. Fund the deficit out of fixed route funds
Even with city contributions of $7,500 LAVTA will be
forced to make the bulk of the deficit out of fixed
route funds.
