FINANCIAL STATEMENT: The 1991-92 assessment is proposed to be $78.48 per single-
family lot and $39.24 per condominium/townhouse lot. The City's costs for
maintaining landscaping within District boundaries are reimbursed by the District.
DESCRIPTION: As part of the review and approval of the 145-unit single-family
development (Ridgecreek) and the other, multi-family Villages, certain landscaping
maintenance was made a condition of approval. This maintenance assessment
distirct provides funds for this work. The City Council approved formation of the
District on November 10, 1986, with the initial assessment in the 1987-88 tax
year.
The County Assessor collects these monies for the City for the maintenance of
landscaping and irrigation systems, right-of-way fencing, walls, entrance signs,
and trash removal. The District's boundaries include all of Tract 5511.
This year, it is proposed to add maintenance of landscaping at the small area
north of the Crossridge road cul-de-sac, which is now a weed problem, to the scope
of work for this maintenance district.
This year's assessment is proposed to be $78.48 per single-family lot and $39.24
per multi-family lot. This is approximately 65% of last year's assessment. The
cost of water and some other maintenance activities is anticipated to be less than
last year; additionally, it is proposed to utilize $6,000 of the District's
reserve fund to help defray the cost of replanting frost-damaged material when
water restrictions end.
On June 24th, the City Council adopted resolutions approving the Preliminary
Engineer's Report and setting a public hearing date of July 22, 1991. Notice of
the public hearing was published, posted, and mailed to property owners in
accordance with Government Code regulations. Staff additionally mailed a
newsletter to property owners which described events that took place in the
District over the past year. A copy of the newsletter was previously sent to the
City Council and is also attached to this agenda statement.
Staff recommends that the City Council conduct a public hearing, deliberate, and
adopt the resolution approving the engineer's report, confirming the diagram and
assessment, and ordering levy of assessment for the 1991-92 tax year.

ASSESSMENT
WHEREAS, on March 25, 1991, the City Council of the City of Dublin,
California, pursuant to the provisions of the Landscaping and Lighting Act of
1972, adopted its Resolution Directing Preparation of Annual Report for
Maintenance Assessment District for the maintenance of improvements more
particularly therein described; and
WHEREAS, said Resolution directed the undersigned to prepare and file a
report pursuant to Section 22565, et. seq. of said Act;
NOW, THEREFORE, the undersigned, by virtue of the power vested in me
under said Act and the order of the Council of said City, hereby make the
following assessment to cover the portion of the estimated cost of the
maintenance of said improvements and the cost and expenses incidental thereto, to
be paid by said District.

As required by said Act, a diagram is hereto attached showing the
exterior boundaries of said landscaping maintenance assessment district and also
the lines and dimensions of each lot or parcel of land within said landscaping
maintenance assessment district as the same existed at the time of the passage of
said resolution, each of which lots or parcels having been given a separate
number upon said diagram.

I do hereby assess the net amount to be assessed upon all assessable
lots or parcels of land within said landscaping maintenance assessment district
by apportioning that amount among the several lots or parcels in proportion to
the estimated benefits to be received by each such lot or parcel from the
maintenance of said improvements, and more particularly set forth in the list
hereto attached and by reference made a part hereof.
Said assessment is made upon the several lots or parcels of land within
said landscaping maintenance assessment district in proportion to the estimated
benefits to be received by said lots or parcels respectively from the maintenance
of said improvements. The diagram and assessment numbers appearing herein are
the diagram numbers appearing on said diagram, to which reference is hereby made
for a more particular description of said property.
Each lot or parcel of land assessed is described in the assessment list
by reference to its parcel number as shown on the Assessor's Maps of the County
of Alameda for the fiscal year 1991-1992 and includes all of such parcel
excepting those portions thereof within existing public roads or right-of-way to
be acquired in these proceedings for public road purposes. For a more particular
description of said property, reference is hereby made to the deeds and maps on
file and of record in the office of the County Recorder of said County. Because
the names of the several owners are unknown to me, I hereby place the word
"Unknown" opposite the number of each lot or parcel of land assessed, the amount
assessed thereon, and the number of the assessment.

SCOPE OF WORK
The following areas are to be maintained by this Maintenance Assessment District:
1) The median and roadside landscaping along the north side of the street for
the entire length of Willow Creek Drive.
2) Roadside landscaping along Shady Creek Drive within Lots 1, 2, 3, 4, 5, 6,
15, 16, 37, 38, and south of Lot 145, all within Tract 5511.
3) Roadside landscaping, wall, fence, and pathway improvements along the west
side of Dougherty Road between Amador Valley Boulevard and the northerly City
Limit line, and along the north side of Amador Valley Boulevard between Dougherty
Road and Wildwood Road.
4) Roadside landscaping, fence, and pathway improvements along the west side of
Wildwood Road.
5) Roadside landscaping, fence, wall, and pathway improvements along the west
side of Dougherty Road and the south side of Amador Valley Boulevard adjacent to
Lot 150.
6) Roadside landscaping, fence, and pathway improvements along the west and

METHOD OF APPORTIONING
Each single family lot shall be assigned a benefit unit of one, each multifamily
unit assigned a benefit unit of one-half, the commercial lot shall have a benefit
unit of 4, and the open space lots shall have a benefit unit of zero. This gives

APPROVING ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT,
AND ORDERING LEVY OF ASSESSMENT
CITY OF DUBLIN LANDSCAPING AND LIGHTING
MAINTENANCE ASSESSMENT DISTRICT NO. 1986-1
WHEREAS, by its Resolution No. 30-91, a resolution directing
preparation of Annual Report for City of Dublin Landscaping and
Lighting Maintenance Assessment District No. 1986-1 (the "District"),
this council designated the city Engineer as Engineer and ordered that
Engineer to make and file a report in writing in accordance with and
pursuant to the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of Work has made and filed with the
city Clerk a preliminary report in writing as called for, which report
was presented to the city council on June 24, 1991; and
WHEREAS, said Engineer of Work has filed with the city Clerk
an Engineer's Report for final consideration; and
WHEREAS, the city council has duly considered said Report
and each and every part thereof and finds that each and every part of
said Report is sufficient; and that said Report nor any part thereof
requires modification in any respect;
NOW, THEREFORE, BE IT RESOLVED as follows:
a) That the Engineer's estimate of the itemized and total
costs and expenses of maintaining said improvements and of the
incidental expenses in connection therewith be; and each of them are
hereby finally approved;
b) That the diagram showing the assessment district,
description of improvements to be maintained; and the boundaries and
dimensions of the respective lots and parcels of land within said
district as contained in said report be, and it is hereby finally
approved;

FACTS ABOUT THE ASSESSMENT DISTRICT
This assessment district was formed in 1986 for the purpose of maintaining
certain landscaping improvements within the Villages at Willow Creek
development. The following areas are being maintained by the City at the
present time:
1) The median and roadside landscaping along the north side of the street
for the entire length of Willow Creek Drive.
2) Roadside landscaping along Shady Creek Drive within Lots 1, 2, 3, 4, 5,
6, 15, 16, 37, 38, and south of Lot 145, and landscaping at the northerly
end of Crossridge Road, all within Tract 5511.
3) Roadside landscaping, wall, fence, and pathway improvements along the
west side of Dougherty Road between Amador Valley Boulevard and the
northerly City Limit line, and along the north side of Amador Valley
Boulevard between Dougherty Road and Wildwood Road.
4) Roadside landscaping, fence, and pathway improvements along the west side
of Wildwood Road.
5) Roadside landscaping, fence, wall, and pathway improvements along the
west side of Dougherty Road and the south side of Amador Valley Boulevard
adjacent to Lot 150.
6) Roadside landscaping, fence, and pathway improvements along the west and
north sides of Fall Creek Road.
Other common landscaping improvements not included in the assessment
district's scope of work are maintained by the homeowners' associations of
individual Villages.
Landscaping within the Alamo Creek area is presently maintained by the
developer, Rafanelli and Nahas. Eventually, the Alameda County Flood Control
and Water Conservation District, Zone 7, will maintain the creek right-of-way
area.
STREET LANDSCAPES
During the past year, the assessment district landscaping has been subjected
to both freezing temperatures and drought conditions. Fortunately, many of
the plant species in this assessment district are California natives and
adapted to the weather conditions without severe damage. Some trees, shrubs,
and groundcovers were lost to frost damage however.
Since the Bay Area has experienced three straight years of damaging frost,
the City's maintenance department has decided that it would be in the
district's best interest to plant in the Spring of 1992 and avoid the
possibility of again damaging newly planted material.

Another factor affecting the replacement of plant material is the drought.
The City has, like all residents, been asked to reduce its normal water use
by 25%. The City has been able to do this to date; however, we would like to
ask residents to help by reporting any damage to the irrigation systems from
vandalism or any other cause. Unfortunately, irrigation systems have been
vandalized throughout the district, but particularly on Wildwood Road, Fall
Creek Road, and Dougherty Road. If you notice a broken or malfunctioning
sprinkler head, please advise the City maintenance department at 833-6630,
and a repair will be made as quickly as possible so that unnecessary waste of
water is avoided. Many of you have called us with information in the past,
and your efforts are sincerely appreciated.
To provide a more consistent control of weeds in the district landscapes, the
City proposes to increase the frequency of chemical pre-emergent control and
to add an additional Work Alternative crew on the weekends for weeding
bedding areas.
It is proposed to add the small area behind the curb at the northern end of
the Crossridge Road cul-de-sac to the District. The City will be adding
plant material and maintaining the landscaping in the future.
PARK IMPROVEMENTS
The cost of park improvements and maintenance is paid by the City and not
charged to the assessment district.
The second phase improvements in Alamo Creek Park were completed during the
past fiscal year. These improvements include restroom facilities, play
equipment, picnic areas, a basketball court, and additional landscaping.
The City's park masterplans include a number of improvements for the
Dougherty Hills Park (the "hill" to the west of the Villages). To date,
trails have been cut to allow hiking on the hill. Proposed future projects
would provide a parking area along Amador Valley Boulevard, day camp and
picnic facilities, restrooms, and naturalized landscaping. The City's Five
Year Capital Improvement Program indicates funding for design development in
the 1994-95 Fiscal Year. Upon completion of the design, the Rotary Club has
expressed an interest in pursuing development of portions of the site.
PUBLIC HEARING
The City is required to hold a public hearing each year in order to offer
property owners an opportunity to protest the proposed assessment for the
upcoming tax year. The attached notice provides information regarding the
date, time, and place that the hearing will be held.
This year, the City proposes to use a portion of the assessment district's
reserve fund that has built up and, accordingly, to reduce the assessment to
property owners. The 1991-92 assessment is proposed to $78.48 per single
family lot (as compared with $120.00 last year) and $36.86 per
condominium/apartment lot (as compared with $60.00 last year).
City Staff will be glad to speak with any property owners who have questions
regarding the assessment or the maintenance activities in the district.
