SUBJECT: Proposed Annexation of Doolan Canyon Area by the City of
Livermore

RECOMMENDATION• Direct Staff to apply to LAFCO to adjust the Dublin
Sphere of Influence to include the upper and lower Doolan
Canyon areas.
FINANCIAL STATEMENT: Undetermined at this time; LAFCO typically requires
an applicant to pay all applicant processing fees.
Dublin would request LAFCO to recirculate the
previously proposed EIR. Dublin could also request
LAFCO to use the draft EIR for the eastern Dublin
studies when it becomes available. LAFCO would
probably require Dublin to pay a standard fee for
processing change to the Sphere of Influence and pay
for any needed revisions to the previous Sphere of
Influence Study.
DESCRIPTION: In response to a request from approximately eighteen
residents in the Doolan Canyon area, the City of Livermore has initiated a
General Plan Amendment, Pre - zoning, and Annexation Program to annex a part of
the lower Doolan Canyon area (See Exhibit A) into the City'of Livermore. On
September 25, 1991, the City of Livermore Planning Department issued a Notice
of the proposed annexation which indicated that a hearing before the Planning
Commission and Livermore City Council were scheduled for October 29, 1991 and
November 25, 1991 respectively. The Notice also indicated that the City of
Livermore is considering a rural residential land use designation with
densities ranging from one dwelling on five acres to one dwelling on ten
acres depending on the slope. In areas exceeding 30% slope, the density
would remain one dwelling unit per 100 acres. Livermore Staff is preparing
an initial study to determine what type of environmental review and
environmental document is needed.
In 1988 the City of Livermore applied to Alameda County LAFCO to adjust
Livermore's Sphere of Influence to include the Doolan Canyon area. During
the Public Hearing on Livermore's application, the City of Dublin presented
testimony that the Doolan Canyon area should be included in Dublin's Sphere
of Influence. LAFCO prepared a detailed study and Environmental Impact
Report on the Doolan Road /Croak Road area. On November 8, 1990, LAFCO found
that the upper and lower portion of Doolan Canyon should be treated as a
single planning unit. LAFCO detached the upper portion of Doolan Canyon from
Dublin's Sphere of Influence and left the upper portion of the Canyon, as
well as the lower portion of the Canyon unallocated.
Staff has been in contact with some of the major property owners in the
proposed Livermore Annexation Area. These property owners have indicated
that they are adamantly opposed to the annexation of their properties by

Livermore with the land use designations that Livermore is presently
considering. These property owners have continued to support the inclusion
of their properties in the City of Dublin's Sphere of Influence and ultimate
City boundaries.
Given that the City of Livermore has commenced this annexation process in
advance of its completion of its North Livermore General Plan Study, it is
Staff's recommendation that the City Council authorize Staff to apply to
LAFCO to adjust Dublin's Sphere of Influence to once again include the upper
Doolan Canyon area and also include lower Doolan Canyon area.

Notice to Property Owners 'and All Interested Parties:
SUBJECT: Proposed Annexation by the City of Livermore of Proper-
ties in the Doolan Canyon Area
The City of Livermore, in response to requests from several prop-
erty owners.in the Doolan Canyon area, has initiated a General
Plan Amendment and Annexation Proaram to consider Citv annexation
of properties in Doolan Canyon.
Annexation is the process by which land is made a part of the
City. The annexation has to be approved by the City and the Local
Agency Formation Commission. That County agency-is required to
assure that all annexations are logical extensions of the City's
boundaries.
If the proposed properties are annexed into the City of Livermore,
all available services of the City can be utilized by the property
owner. These services include police and fire protection, and
potential connection to City sewage and water systems.
As part of its consideration of annexation, the City must consider
new land use designations and zoning to apply to the annexed
properties. Presently, City staff is considering a land use
designation and prezoning the land with a rural residential land
use designation. This would allow densities from one dwelling on
five acres to one dwelling per ten acres depending on
slope /density criteria. Land areas exceeding thirty percent slope
would retain the current County density of one dwelling per one
hundred acres.
Attached is a map of the proposed area being considered for annex-
ation. The Livermore Planning Department is preparing an Initial
Study for the proposed project in accordance with the California
Environmental Quality Act (CEQA). Copies of the Initial Study
will be mailed to property owners in Doolan Canyon, pertinent
agencies and interested parties within 15 days of receiving this
letter. This document will provide additional data and informa-
tion on the proposal being considered.
A public hearing on the proposed annexation and related land use
proposals will be held by the City Planning Commission on October
29, 1991. The Commission will received public comment and forward
recommendations to the'City Council. The City Council will then
consider the proposed annexation at a public hearing on November
25, 1991, to approve or deny the requested prezoning,__and__to

confirm final annexation boundaries. If the application is ap-
proved, the City will request that LAFCO initiate annexation
proceedings, which may culminate in a resolution approving the
annexation.

373 - 5200). To assist the City in this analysis we ask you to
notify us of your interest in annexation of your property to the
City of Livermore. Please find enclosed a map of the proposed
area considered for annexation.

Proposed Stratmore Annexation to East Bay Municipal Utility-District
It was moved by Commissioners Karp and seconded by Commissioner Mercer
that the proposed Stratmore Annexation to East Bay Municipal Utility
District be transferred to Contra, Costa County LAFCO.
Motion carried; 4 Ayes
Chairman Schweser wondered how many more of these transfers Alameda
County LAFCO would continue to receive and was concerned that East Bay
Municipal Utility District could accommodate these transfers.

Ogolan Road /Croak Road Spherg gf Influence For clarification,
Commissioner Mercer commented that it was his belief that this
matter has not yet been entirely resolved; that both cities will
now go back and redo their general plans at which time one of
them, if they so wish, may approach LAFCO for a sphere change. It
was further.clarified by LAFCO Counsel that Sphere of Influence
requests do fall within the one —year rule (LAFCO's guidelines for
review also apply -- Government Code 56425(b)).
Commissioner Mercer asked that if one City requests a sphere
change does this automatically mean that the other city must have
its material done at the same time. For example, if Livermore's
comes in before Dublin, do we hold it up and wait for Dublin's to
be done.

Counsel responded that LAFCO has an obligation to look at applications
as they come in, but has latitude to decide whether it is ready to
consider the request or wait until an adjacent city has completed its
General Plan. (LAFCO's SOI guidelines would apply.)
This matter was brought before the Commission today for approval of map
and resolution indicating separation and unallocation of the upper
portion of Doolan Canyon from the City of Dublin's sphere of influence,
per action by the Commission at its September 20, 1990 meeting.

It was moved by Commissioner Karp and seconded by Commissioner Mercer
that the resolution, as revised, setting the Doolan Road /Croak Road
sphere of influence be approved.

• Lmendments to Commission's Fee Application Schedule
On September 20, the Commission received staff's recommendation to
amend the Commission's fee schedule. At the Commission's direction, a
public hearing was set for today, November 8, to receive testimony on
the proposed amendments to the LAFCO fee schedule: $20,000 deposit at-
the time a request is made for State Controller's Office fiscal
analysis /review on incorporations; and a verification per signature
charge by the Registrar of Voters Office (the current charge is .85
cents per verified signature).
Following the hearing, it was moved.by Commissioner Santana and
seconded by Commissioner Mercer that the amendments to the Commission's
application fee schedule as submitted by staff be approved,

Commendations for George Gaekle involving his work on the proposed
Castro Valley Incorporation, and $r_uCe Kern for his work and
contributions as staff to the Local Agency Formation Commission during
the past six years. Chairman Schweser suggested that both Mr. Gaekle
and Bruce be invited to attend our next regularly scheduled meeting in
order to present them with commendations for their efforts.

RESOLUTION NO. 90—_
WHEREAS, Section 56425 of the Cortese /Knox Local Government
Reorganization Act of 1985 mandates the Commission to develop and determine a
Sphere of Influence for each local governmental agency within the.-County; and
WHEREAS, Section 56427 authorizes the Commission to amend or
revise Spheres of Influence after a public hearing for that purpose; and
WHEREAS, this Commission held public hearings on December 7,
1989, March 15, 19 90, and July 26, 1990 to receive testimony on the annexation
and /or unallocation of the Doolan Road /Croak Road study area to /from the
Spheres of Influence of the Cities of Livermore and Dublin; and
WHEREAS, at these hearings, the Local Agency Formation
Commission heard and received all oral and written protests, objections and
evidence which were made, presented or filed, and all persons present were
given an opportunity to appear and be heard with respect to the annexation
and /or unallocation of the Doolan Road /Croak Road study area to /from the
Spheres of Influence of the Cities of Livermore and Dublin; and
WHEREAS, notice of public hearing was given as required by law;
and
WHEREAS, an Environmental Impact Report was prepared for the
sphere consideration in accordance with the provisions of the California
Environmental Quality Act, and said Environmental Impact Report:
1. has been circulated for public comment;
2. has been reviewed and considered by this Commission;
3. is hereby certified by this Commission to comply with the requirements of
the California Environmental Quality Act and all applicable State and
LAFCO guidelines;
4. is hereby adopted by the Environmental Impact Report for the action taken
by this Commission to unallocate the upper portion of Doolan Canyon from
the City of Dublin's Sphere of Influence, and retain the Croak Road
subarea within the City of Dublin's Sphere of Influence; and !

WHEREAS, the Environmental Impact Report analyzed a range of
alternatives, including a "partial unallocation" alternative in which LAFCO
could reverse the prior allocation of the upper portion of Doolan Road from
the City of Dublin's Sphere of Influence, but retain Croak Road within
Dublin's Sphere; and
WHEREAS, none of the alternatives analyzed in the EIR would
result in any direct, or primary environmental impacts; however, alternatives
allocating the Doolan Road /Croak Road Study Area to a city would-be
growth— inducing and that growth inducement would be a significant secondary
impact which could not be mitigated to a level of insignificance; and

WHEREAS, the effect of the "partial unallocation" alternative
would be similar to that of the "no project /no action" alternative, and that
deferring action, either by no action or by unallocation, would leave the
Doolan Road /Croak Road Study Area essentially the same as the status quo, and
no growth inducement or any other potentially significant environmental impact
would result from approval of either alternative; and
WHEREAS, the California Environmental Quality Act and State and
LAFCO CEQA Guidelines require this Commission to make findings where the
Environmental Impact Report identifies one or more significant effects which
would or would likely result from this action; and
WHEREAS, no significant environmental impact would result from
the Commission's approval of the "partial unallocation" alternative, and
therefore no findings pursuant to CEQA must be made by this Commission; and
WHEREAS, in adopting this resolution, it is the understanding of
the Commission that future use of the Environmental Impact Report for purposes
other than for the action taken to unallocate the upper portion of Doolan
Canyon from the City of Dublin's Sphere of Influence would be preceded by
recirculation of the EIR for public comment as to its adequacy for those
purposes, reconsideration and recertification by this Commission, and filing
of a new Notice of Determination; and
WHEREAS, the Commission finds that in order to avoid conflicts
over watershed, drainage, viewshed, access and traffic, the upper and lower
portions of Doolan Canyon should be treated as a single planning unit; and
WHEREAS, the Commission further finds that there is not a
present and probable need for public facilities and services in Doolan Canyon;
and
WHEREAS, the Croak and Doolan Road subareas are geographically
distinct: the Croak Road subareas has a separate watershed and viewshed from
Doolan Canyon and has - -or can be readily provided with -- separate access to the
I -580 corridor;
NOW, THEREFORE
BE IT RESOLVED THAT this Commission amend the Sphere of influence
of the City of Dublin to detach the upper portion of Doolan Canyon; and
BE IT FURTHER RESOLVED that the lower portion of Doolan Road
remain unallocated to any sphere of influence and the Croak Road subarea
remain within the Sphere of Influence of the City of Dublin.

Following staff's report, it was moved by Commissioner Karp and
seconded by Commissioner Santana that Annexation No. 137 (Staples
Ranch — Alameda County) be approved in.accordance with staff report.

IV. DISTRICT ANNEXATION REQUESTS

Following confirmation that this area is in the Alameda County Water
District, it was moved by Commissioner Mercer and seconded by
Commissioner Karp that Union Sanitary District Annexation No- 246 be
approved as recommended by staff.
Motion approved: 5 Ayes
V. SPHERE OF INFLUENCE CHANGES
e Doolan Road /Croak Road Sphere of Influence — Chairman Schweser
advised that the public hearing on the Doolan /Croak Road Sphere of
Influence was closed on July 26, and no further public testimony will
be heard today.
Staff's comments: Bruce Kern advised that on July 26, the Commission
considered his recommendation to retain Croak Road within the sphere
of influence of the City of Dublin and to designate the Doolan Canyon
area as a single planning unit. Presently the area is split - -the
northern portion is in Dublin's sphere of infuence and the lower
portion is unallocated. At that time, staff also requested before a
final decision was made by the Commision, that there was a need for
supplemental information from both cities. The Commission authorized
staff to work with both cities to secure responses to the
supplemental information requested. There were six questions to
which staff has received responses. The Commission set this date to
receive required supplemental information along with staff's
recommendation.

In summarizing his recommendation, Mr. Kern ind

With regard to the information provided on Doolan Canyon, his
conclusion is that it is premature to place the subject area in
either the City of Dublin's or Livermore's Sphere of Influence.
While both cities have made every effort to respond to staff's
questions, it is clear that they are still uncertain as to land use
and infrastructure requirements since they have not completed their
General Plan for the subject area.
He indicated that land holdings do not precipitate urban development,
and there is not ample information for staff to recommend that an
allocation be made to either city at this time. He believes that
each city should complete their planning process and for the
Commission to reassess-the need for urban services within the Canyon
after this process has been completed. Therefore he is
recommendating that the area be unallocated which will require the
Commission to detach the upper portion of the sphere of influence
from the the City of Dublin. Further, it is recommended that the
Commission certify the EIR. Should the Commission approve this
recommendation, a final map will be prepared along with findings for
final action at the November meeting of the Commission
Commissioner Snyder asked that a September 20, 1990, letter signed by
Larry Tong relative to the adequacy of the EIR and the position of
the City of Dublin b'e entered into the record (attached). He
indicated he decided to refrain from making the comments he had
planned to make relative to Livermore's response on how the Doolan
Canyon area could be served by them at this time. Relative to Mr.
Karp's comment that nothing has appeared in any general plans
regarding the upper Doolan Canyon area, he said that Dublin's General
Plan addresses the area. He indicated that if it is the pleasure of
the Commission to remove that area from Dublin's sphere of influence,
he still believes the City will continue as part of its planning
efforts to plan for the Doolan Canyon area, and feels personally
well- assured that the Commission will once again address this issue
in the not too distant future.
Commissioner Santana said he also goes reluctantly along with Staff's
recommendation. Feels that the General Plan should have been looked
at a year ago prior to any action by the Commission.
Although Mr. Schweser_ does not concur wholly with staff's
recommendation, he does believe it is a reasonable recommendation at
this point in time. He hopes that in the near future when both
cities finish their General Plans, they will come back to LAFCO for, a

review of their sphere in the Doolan Canyon area and the Commission
would receive them happily.
Following the above coareents, it was moved by Commissioner Karp and
seconded by Commissioner Mercer that the EIR prepared by Thomas Reid
Associates is complete and the Commission so certifies.
Motion approved: 5 Ayes
The Commission reaffirms retaining the Croak Property in Dublin's
sphere of influence.
It was moved by Comissioner Mercer and seconded by Commissioner
Karp that the upper portion of Doolan Canyon by detached from the
sphere of influence of the City of Dublin's.

that the additional expenses incurred by George Gaekle as chair of the
Castro Valley Study Committee in the amount of $572.36 be approved.
Motion approved: 5 Ayes
It was also the wish of the Commission that a resolution commending
George Gaekle for his work on the Castro Valley Study Committee be
prepared.
• Application Fees for,Incor opor lion Petition—
Mr. Kern indicated that he was recommending that the Commission amend its
fee schedule to include a deposit of $20,000 at the time a request for
State Controller's Office review is received. Further, he recommends
that a verification per signature cost at the time of a filing for
Incorporation, annexation or reorganization be included in the
Commission's fee schedule (presently the cost is .85 cents per signature`.
It Was moved by Commissioner Mercer and seconded by Commissioner Santana
that the recommended amendments as proposed by staff to the Commission's
application fee schedule be prepared and set up for public hearing.
Motion carried.

IX. CORRESPONDENCE
Letter from the Livermore Airport concerning the Croak Road /Doolan
Canyon Spphere of Influence.
In closing this meeting, Hr. Kern advised the Commission that this would
be his last official meeting; he will be assuming the full -time duties
for economic development for the County. He indicated it was with mixed
emotions that he would be leaving. Over the last six years that he has
held this position, it has been an enjoyable association. The high
points have outweighed the low. He feels that the Commission has set a
high standard in the state in discharging is responsibilities in
accordance with the Cortese /Knox Act.
He thanked the Commission for its support, guidance and counsel.
