SUBJECT: Acceptance of Improvements - Tract 5388 (Kildara)

RECOMMENDATION: n/ Adopt resolution accepting improvements and
maintenance bonds
FINANCIAL STATEMENT: The developer has provided maintenance bonds in the
total amount of $327,550 to guarantee against defects
for a period of one year from date of acceptance.
Streets within Tract 5388 are private; the City will
not incur any maintenance or sweeping costs.
DESCRIPTION: The Final Map for Tract 5388, which is located at the
westerly end of Amador Valley Boulevard behind the Stroud's Plaza shopping center,
was approved in October of 1985. In December of 1987, the original developer,
Morrison Homes, sold the project to Kildara Properties and a new developer agreement
and bonds were approved.
Improvements within Tract 5388 have been determined to be complete and in accordance
with approved plans. Staff recommends that the City Council adopt the resolution
accepting improvements and the maintenance bonds.

RESOLUTION NO. -91
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING IMPROVEMENTS IN TRACT 5388
(KILDARA)
WHEREAS, the owner-subdivider of the aforesaid Tract previously entered
into a contract with the City of Dublin to improve said Tract in accordance with
plans and specifications on file with the City Engineer, said Tract identified as
follows:
Subdivider: Kildara Properties
Tract Location: Westerly End of Amador Valley Boulevard
Tract Size: 174 Condominium/Townhouse Lots
Resolution Approving Final Map: No. 111-85
City Streets Affected: None
WHEREAS, said improvements have been completed in accordance with said
plans and specifications, and any approved modifications thereof, to the
satisfaction of the City Engineer of the City of Dublin; and
WHEREAS, as a condition of said contract, the subdivider is required to
guarantee the improvements and to maintain the completed work for a period of one
year following acceptance of work by the City of Dublin; and
WHEREAS, as the improvements are now completed, the original
performance bond security requirement can be reduced, in accordance with the
authority contained in Section 66499.7 of the Government Code of the State of
California, to an amount found necessary to guarantee maintenance of the completed
work for the aforesaid one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within said Tract be, and they are hereby
approved and accepted subject to the aforesaid one-year guarantee; and
2. The aforesaid original performance bond security requirement be reduced
from the amount of $1,310,200 to a revised security agreement in the amount of
$327,550 upon acceptance by Staff of the replacement maintenance bonds in the said
amount of $327,550 as security for the aforesaid one-year guarantee period, and the
Mayor of this City Council be, and he is hereby authorized and directed to execute
the said bonds on behalf of the said City of Dublin; and

3. The said original performance bonds in the amount of $1,615,000 posted
in connection with the work involved in the construction of said Tract be hereby
released upon acceptance of said maintenance bonds.
PASSED, APPROVED AND ADOPTED this 28th day of October, 1991.
