HomeMy WebLinkAboutItem 4.05 Accept ImprovmtsTr5072 (2) '-' , CITY OF DUBLIN AGENDA STATEMENT CITY COUNCIL MEETING DATE: MARCH 9, 1992 SUBJECT: Acceptance of Improvements Tract 5072 (Bordeaux Estates) (Report by Public Works Director Lee Thompson) EXHIBITS ATTACHED: 1) Resolution 2) Location Map RECOMMENDATION: 1) Adopt Resolution to accept the work completed. ~~~Authorize Staff to accept maintenance bond. \ 3) Authorize Staff to recommend that the County of Alameda release the performance bond once the maintenance bond has been received. FINANCIAL STATEMENT: A maintenance bond in the amount of $109,250 to guarantee against defects will be provided to the City. The City will incur maintenance and sweeping costs for the public streets in this Tract. These costs will be paid from the Street Maintenance operating Budget and Street sweeping Budget. DESCRIPTION: In October of 1985, the City Council approved the Final Map for Tract 5072, one of three tracts in the Bordeaux Estates development. (One of these three tracts has since been developed by Ahmanson Developments as "Images.") The Tract Developer Agreement and bonds were executed between Hatfield/Investec and the County of Alameda, as the property had not been annexed to the City at the time. Hatfield/Investec's interest in the property eventually passed to First Interstate Mortgage Special Assets West, the current owner. At the time the City and Hatfield/Investec executed the contract for the Tract improvements, the subdivider was required to provide performance bonds in the amount of $437,000 to provide the necessary security for the performance of work involved. As the work is now completed, the performance security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code, to an amount necessary to guarantee maintenance of the work for a one-year period following acceptance of the work. The tract improvements were completed several years ago, but the tract could not be accepted because the developer did not provide as-built plans as per conditions of acceptance. These plans were recently provided by FIMSA West. Staff recommends that the City Council adopt the resolution accepting improvements, authorize Staff to accept the maintenance bond at a Iuture date, and authorize Staff to recommend that the County of Alameda release the performance bond once the maintenance bond has been received. a:agenda\5072acpt ITEM NO. ---Jt----------- .5 - - - - - - - - - - - - - - - - - COPIES: FIMSA WEST RESOLUTION NO. -92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN FOR THE ACCEPTANCE OF IMPROVEMENTS TRACT 5072 (BORDEAUX ESTATES) WHEREAS, the owner-subdivider of the aforesaid Tract previously entered into a contract with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the City Engineer, said Tract identified as follows: a) Subdivider: FIMSA West, successor to Hatfield/Investec b) Tract Location: Northwesterly of Tract 4943, Southerly of Tract 5073 c) Tract Size: 26 single-family lots d) Resolution Approving Final Map: No. 115-85 e) City Streets Affected: Rolling Hills Drive, Rothschild Place, Rothschild Court WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of the City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, the subdivider is required to guarantee the improvements and to maintain the completed work for a period of one year following acceptance of the work by the said City of Dublin; and WHEREAS, as the improvements are now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract be, and they are hereby approved and accepted subject to the aforesaid one-year guarantee; and 2. The aforesaid original performance bond security requirement be reduced from the amount of $437,000 to a revised security requirement in the amount of $109,250, upon acceptance by Staff of the replacement maintenance bond in the said amount of $109,250 as security for the aforesaid one-year guarantee period, and the Mayor of this City Council be, and he is hereby authorized and directed to execute the said bond on behalf of the said City of Dublin; and ~:'1[ ~,~ i: ~4 ~ =1'/.\1 i r,,' .":'", ."'..:,<.......,,: ....~ .. Alameda County be notified that the said original performance bond in the amount of $437,000 posted in connection with the work involved in the construction of said Tract be hereby released upon acceptance of said maintenance bond.
