HomeMy WebLinkAboutItem 4.8 QuitclaimDeedTR5900 (2)GITY OF DUBLIN AGENDA STATEMENT SUBJECT: City Council Meeting Date: June 8, 1992 Quitclaim Deed Tract 5900 Report by Public Works Director Lee Thompson EXHIBITS ATTACHED: 1) 2) 3) Resolution Quitclaim Deed Reduced Tract Maps Tract 5900 and Tract 4978 for comparison purposes RECOMMENDATION: FINANCIAL STATEMENT: Adopt resolution None DESCRIPTION: The original dedication from Jim Geldermann on Tract 4978 dedicated Sierra Lane (east of Dougherty Road) to the City of Dublin as a fee right-of-way. When the City Council recently approved the Final Map for Tract 5900, the Sierra Lane right-of-way was intentionally not shown and was thereby abandoned as a public street. Since the original dedication was a fee dedication instead of just a street right-of-way dedication, the City still has some land rights on the old street. This quitclaim action will transfer the City's rights back to the developer, BJ Dublin Commercial, as intended. The City no longer has a need for the Sierra Lane right-of-way as it has been replaced by the Dublin Boulevard Extension. Staff recommends that the City Council adopt the resolution. a:(corres)\june\aEstquit ITEM NO.~ COPIES TO: John Moore, BJ Dublin Commercial RESOLUTION NO. -92 A RESOLUTION OF THE CITY COUNCIL OF THE GITY OF DUBLIN APPROVING QUITCLAIM DEED FOR FEE TITLE FOR SIERRA LANE WITHIN TRACT 5900 TO BJ DUBLIN COMMERCIAL WHEREAS, the Final Map for Tract 4978 dedicated Sierra Lane as a fee right-of-way to the City of Dublin; and WHEREAS, the City Council approved and accepted said fee dedication of Sierra Lane on May 29, 1984; and WHEREAS, the City Council approved the Final Map for Tract 5900 on April 27, 1992, and thereby approved abandonment of said Sierra Lane right-of-way as a public street; and WHEREAS, the City no longer requires said property for any purpose; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approves quitclaim of fee title to said Sierra Lane within Tract 5900 to the property owner, BJ Dublin Commercial. BE IT FURTHER RESOLVED that the Mayor is authorized to execute the quitclaim deed. PASSED, APPROVED, AND ADOPTED this 8th day of June, 1992.
