Letter dated April 2, 1992 to Thomas Schweser from Robert Brown Receive report None On September 20, 1990, the Alameda County LAFCO Commission detached the Upper poolan Canyon area from Dublin's Sphere of Influence. The Commission also decided that both the City of Dublin and the City of Livermore must revise their general plans for the Doolan Canyon area. After the general plans have been revised, a sphere change decision would be made based on which, if either, city is better able to serve the Doolan Canyon area (Exhibit B). On May 21, 1992, the LAFCO Commission, at the request of the City of Livermore (Exhibit C), agreed that the outside date on which they will hear the sphere of influence application for the Doolan Canyon area will be May 23, 1993 even if only one city is ready to proceed (Exhibit A). In order to hear the sphere of influence application in May 1993, LAFCO is requiring the City to submit the application packet by January 25, 1993. In essence, the City will have seven (7) months to complete its General Plan Amendment for Eastern Dublin and take all necessary steps to submit the sphere of influence application. In addition, the City must complete any other necessary applications and required documents (EIR) and pay applicable LAFCO, County and State fees. Submittal of the packet by the January 25, 1993 date would allow ` LAFCO Staff time to review and analyze the application, prepare a staff report and place a notice in the newspapers 30 days prior to the May LAFCO hearing. Staff anticipates taking the Eastern Dublin General Plan Amendment, Specific Plan, and Draft Environmental Impact Report (DEIR) to the Planning Commission for public hearing after the DEIR is released in mid-August. In September/October, the DEIR public review period would end and the Planning Commission could conclude its public hearing and make its recommendations. In November/December, the City Council would conduct its public hearing and take action. This schedule would then allow Staff to prepare and submit the Sphere of Influence application to LAFCO by the January 25, 1993 deadline. Crystal Hishida has contacted City Staff and indicated that she would like to have a preliminary meeting in July or August with the staffs of both Dubl~in and Livermore to exchange information and resolve questions about the process. In addition, she would like to have a meeting in September to get an update on the general plan amendments of both cities and to resolve any remaining questions. _ / ITEM NO. Box 2340 Dublin, GA 94568 Subject: Doolan Canyon and Potential Sphere of Influence Designation Dear Mayor Brown and Mayor Snyder: This is a follow-up to two letters: (1) my letter (Attachment A) of February 11, 1992 recognizing that both of your respective cities are in the process of updating tY~eir general plan, have a continuing interest on the part of both your cities to annex portions of the Doolan Canyon area, and my confirmation of the Commission's resolution that this issue may come before LAFCO after one year and after both cities have completed a general plan amendment. The second letter, is from Robert Brown, the City of Livermore's Director of Planning (Attachment B). Mr. Brown was concerned about LAFCO's policy which establishes "an indefinite time period during which one city must wait for the other city to complete its general plan amendment program." Mr. Brown recommended that LAFCO establish a reasonable timeframe for both cities to complete their respective programs and after that date allow unilateral application for a sphere of influence change for poolan Canyon. This is to advise your respective cities that on May 21st, the Alameda County LAFCO ~ Commissioners agreed that the outside date in which they will hear the sphere of influence (SOI) application for the Doolan Canyon area will be in May, 1993 even if only one city is ready to proceed. This means that both of your cities will have one full year to complete their general plan amendments and take all the necessary steps to submit the SOI application. LAFCO staff has had preliminary discussions with your respective planning departments and it appears that the fall of this year seems to be a reasonable time in which the general plan amendments will be submitted to your respective councils. In addition, both cities must complete all the necessary application/paperwork and required documents (ie: EIR, Negative Declaration) for an ,_z, . - ---- - -.--- --~ -- - - EDWARD R. Assuming that both cities are in agreement, the SOI applicarion(s) can be either heard prior to or after May, 1993. Further, it should be noted that in order to have this scheduled in May, 1993, LAFCO staff requires sufficient time to review the documents from both cities. It is preferable to receive both packets by early January but no later than January 25, 1993 in order for the packets to be thoroughly reviewed/analyzed for preparation of the LAFCO staff report and for a notice to be placed in the newspapers 30 days prior to the May L.AFCO meeting. Box 2340 Dublin, CA 94568 Dear Mayor Brown and Mayor Snyder: Alameda County Local Agency Formation Commission is aware that both the City of Livermore and City of Dublin are in the process of updating their general plan. In addition, we are aware that there is continuing interest on the part of both cities to annex pordons of the Doolan Canyon area. Both cities have informally discussed this issue with Alameda County LAFCO staff and I wish to reaffirm LAFCO's intent. On September 20, 1990, the Commission passed a resolution excluding the upper portion of Doolan Canyon from Dublin's sphere of influence. The resolution also '~ pr~~~ides that the lozaer po:t:on of Doolan Road is not in any city's sphere of influence and that Croak Road subarea remains in Dublin's sphere of influence. Further, it was understood that this issue may come before LAFCO after one year and after both cities have completed their general plan amendments (GPA's). In accordance with Cortese-Knox, Alameda County LAFCO will not consider an application for annexation of all or part of Doolan Canyon until the portion to be annexed is within the sphere of influence of the anneacing city. This requires the sphere issue to be addressed prior to the annexation. EDWARD R. LAFCO would conduct a public hearing on this matter. I can appreciate LAFCO's intent, however, this policy establishes an ir_definite time period during which one City must wait for the other City to complete its General Plan Amendment Program. I would recommend that LAFCO establish a reasonable timeframe for both cities to complete their respective programs, and after that date, allow unilateral application for a sphere of influence change for poolan Canyon. An end date, such as April 1, 1993, should allow both cities a realistic period to complete their planning programs while providing the assurance that the programs will be able to proceed to completion within a reasonable timeframe.
