DESCRIPTION: On July 13, 1992, the City Council declared Ordinance No. 11-92, an Ordinance providing for the direct election of the Mayor by a vote of the people, to be effective on July 23 , 1992 . Government Code Section 36516. 1 provides that the Mayor may be compensated in addition to that compensation which he/she receives as a Councilmember. The City Council on July 13th, directed Staff to survey other cities with regard to compensation for directly elected mayors. A survey was done of cities similar in size to Dublin in the Greater Bay Area which have a directly elected Mayor. In the Tri-Valley Area, only Pleasanton and Livermore directly elect their Mayors. Both cities have populations of more than 50, 000. The City Attorney has reviewed the applicable Government Code Sections and has provided this information. It should be pointed out that the only duty a directly elected Mayor has that is different from a Council appointed Mayor is that a directly elected Mayor makes all appointments to boards, commissions and committees, with the approval of the Council. ---------------------------------------------------------------------- COPIES TO: ITEM NO. ♦ CITY CLERK FLE o d ORDINANCE NO. - 92 AN ORDINANCE OF THE CITY OF DUBLIN ADDING SECTION 2.08•.040 TO THE DUBLIN MUNICIPAL CODE PROVIDING FOR A MONTHLY SALARY FOR THE ELECTED OFFICE OF MAYOR THE CITY COUNCIL OF THE CITY OF DUBLIN DOES ORDAIN AS FOLLOWS: Section 1. PURPOSE Government Code Section 36516. 1 provides that a directly elected Mayor may be compensated in addition to that compensation received as a Councilmember. Section 2 : AMENDMENT TO CHAPTER 2 . 08 Dublin Municipal Code Chapter 2 . 08 is hereby amended to add Section 2 . 08. 040, to read as follows: "The Mayor shall receive a monthly salary of $ , in addition to that which he/she receives as a Councilmember. " Section 3 : EFFECTIVE DATE This salary shall become effective at such time that a directly elected Mayor is sworn into office. Section 4 : EFFECTIVE DATE AND POSTING OF ORDINANCE This Ordinance shall take effect and be in force thirty (30) days from and after the date of its passage. The City Clerk of the City of Dublin shall cause this Ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California. (Government code section 36802. ) The Mayor may make or second a motion. (Government Code section 36803. ) The Mayor votes on motions. The Mayor signs all contracts, conveyances and instruments requiring the City seal.. (Government code section 40602 . ) The Mayor signs ordinances and resolutions. (Government Code section 36932 . ) The Mayor signs warrants. (Government Code sections 37203 , 40602 . ) The Mayor may administer oaths and affirmations. (Government Code section 40603 . ) The Mayor may acknowledge the execution of all instruments executed by the City.
