FINANCIAL S1 A TEMENT: The proposed Annual Assessment is $110.22 per Single Family Residence receiving Minimum Service. This includes collection of one (1) 32 Gallon Container, weekly curbside Recycling Collection and 4 Special Clean-Ups per year. RECOMMENDATION: 1. ~2. 3. 4. DESCRIPTION: At the City Council meeting on April 26, 1993, Staff presented a report to the City Council on the process required to collect Basic Garbage Services as part of the Property Tax Bill. Staff was directed to prepare the notices of the Public Hearing and documents to implement the program. A complete Chronology of the City Council actions related to Mandatory Garbage Service are attached as Exhibit 1. This document also outlines reasons why the City has undertaken the change. PROPERTY TAX ASSESSMENT The process proposed involves the collection of Minimum Residential Garbage Service Fees on the Property Tax bill. The City Council is authorized under State Law to collect these amounts as a fee for service. The Assessments will only apply to those residential properties which receive individual garbage collection services. Typically larger complexes receive service through large commercial bins and the service is paid for based on the volume used. These accounts will not be affected by the change. Due to the fact that the Tax Roll represents assessments for the Fiscal Year (July-June), it is necessary to impose assessments covering the same period. This process has the following impacts on the calculation of the assessment to be levied: (a) Estimated Tanuary - Tune 1994 Rates Are Used: Typically the City adjusts garbage and recycling fees in January of each year. Since the Assessment information must be provided to the Tax Collector by August, Staff has estimated increases for the second half of Fiscal Year 1993-94. The ITEM NO. 6. 2 COPIES TO: Dan Borges, Livermore Dublin Disposal CITY CLERK FILE ~ ~. . . , factors used include a 4% increase on the Recycling Component and a 6% increase on the Garbage Collection Component. (b) Impact of New Fees Will Need To Be Calculated With Future Assessments: Alameda County was considering a Business License Fee increase, which would increase the rates by approximately 10 cents. The County Board of Supervisors have not determined whether they will impose this fee. Therefore, the cost of this item is not included in the recommended assessment. Also, in the event that Measure D is imposed these fees will need to be accounted for in future Assessments. (c) Carrying Cost For Garbage Company: The City will receive the bulk of the assessments from the County Tax Collector in two payments (December and April). If the Company were receiving quarterly payments from their subscribers they would avoid the additional carrying cost. Staff has included a factor in the Annual Assessment which is anticipated to cover any additional expense incurred by the Company. The actual amount claimed by the Company will be subject to verification in the rate review process. (d) Assessments Are Not Liens and Delinquencies May Occur: Staff has also included a factor to account for any unpaid assessments. Other agencies have found that this typically occurs when a property owner fails to pay any of their property taxes. The proposed ordinance modification would preserve the City Council's authority to collect unpaid assessments as a lien on the property in the future. Any liens collected in future years would help to reduce the cost of the service to residents. (e) Elimination of Some Service Levels: In order to standardize the rates levied, all residential collection will be based upon a standard 32 gallon container. The current ordinance already restricts the volume in any container to no more than 75 pounds. This will impact less than 1 percent of the total customers. Approximately 296 customers use containers larger than the Standard and 85 customers subscribe to the 20 gallon super recycler service. All of these customers will be assessed for the new Minimum Service. Given the small number of customers and the efficiencies obtained through standardizing rates, LDD does not foresee any problems with this change. (f) Customers Receiving Minimum Service Will No Longer Need To Make Ouarterly Payments To Livermore Dublin Disposal: The payment will be made to the County Tax Collector as part of the property owners semi-annual payment of property taxes. (g) City Budget Will Reflect Revenue & Expense For Basic Service: The City budget will reflect the receipt of the assessments and payment to Livermore Dublin Disposal. These monies will be accounted for in a special revenue fund. Any monies remaining at the end of Fiscal Year 1993-94 can be used as a credit towards the amount which will need to be assessed for Fiscal Year 1994-95. CALCULATION OF ANNUAL ASSESSMENT As discussed above, several factors have been included in the development of a final annual assessment rate. The calculation which follows is an example for a single family residence. In the case of duplexes the rate would be two times this amount. This adjustment is necessary since the assessments are levied on a per parcel basis. The recommended assessment level is slightly more than the figures shown at the City Council meeting on April 26, 1993. This change is less than $2.00 and reflects updated assumptions for the inflationary increase expected in 1994. If the current rates were adjusted for inflation during the first six months of 1994, the annual cost would be $110.22. After the first year of operation the City shall have actual data on delinquencies and the Company's carrying costs, which will allow for a more accurate comparison. The provision of basic garbage service under this system continues to be extremely cost effective for residents of the City. The services provided include: 1. Weekly backyard collection and disposal of one 32 gallon garbage container. 2. Weekly curbside collection of source separated recyclables. 3. Quarterly curbside Saturday collection of yard debris and other accumulations, subject to certain limitations. Staff has also surveyed other agencies served by Oakland Scavenger Company to compare the City of Dublin's proposed Annual Assessment to the annual costs for comparable service. The amount paid by Dublin rate payer's will be 15.7% less that the average of these communities. The City of Dublin cost would be less than the rate charged to Livermore residents for comparable service. The average number of special clean-ups offered by the agencies surveyed is 1 per year. The City of Dublin level of service is obviously quite high and they will remain cost effective. LEGISLATNE ACTIONS REOUIRED TO IMPLEMENT THE PROGRAM Several City documents and agreements with Livermore Dublin Disposal will be impacted as a result of implementing this program. The following discussion outlines the changes required to each document. URGENCY ORDINANCE AMENDING THE SOLID WASTE MANAGEMENT ORDINANCE TO PROVIDE FOR THE CITY TO COLLECT FEES FOR MINIMUM GARBAGE SERVICE AS PART OF THE PROPERTY TAX BILL (Exhibit 2) This is an urgency ordinance which will repeal several sections related to the Mandatory Garbage Ordinance adopted by the City Council in 1992. Exhibit 2, shows selected portions of the current ordinance and how they will be modified. The Ordinance must be enacted as an urgency ordinance in order to provide the County with the necessary information. The sections which are proposed to be repealed can be found in Exhibit 8, which shows the Solid Waste Management Ordinance in its entirety. RESOLUTION ESTABLISHING A MINIMUM GARBAGE SERVICE FEE TO BE COLLECTED ON THE PROPERTY TAX (EXHIBIT 3) This resolution will provide Staff with the authorization to have the Alameda County Tax Collector, place the assessment on the 1993-94 Property Tax Bill for all residential units (excluding condominiums and apartments which do not receive individual service.) The resolution includes a rate for duplexes which is twice the Single Family rate. The City also has one duplex project on Starward Drive with 12 units. Therefore, the rate for that parcel will be 12 times the single family rate. RESOLUTION APPROVING THE FOURTH AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF DUBLIN AND OAKLAND SCAVENGER COMPANY REGARDING WASTE COLLECTION AND DISPOSAL (EXHIBIT 4) The existing agreement contains certain provisions for the City to collect delinquent accounts which were previously billed by the Garbage Company. Under the proposed program the City will be collecting the amount owed for each residence eligible for Minimum Residential Service. Therefore, language related to the City's collection of delinquent Oakland Scavenger accounts will be deleted. The Amendment will add language to specify the means by which the Company will receive payment for all units subject to the Minimum Residential Service. Twice each year, the Company shall submit an invoice identifying the number of residential accounts offered such service and the City shall pay according to the established monthly rate for a six month period. The minimum rate and . . services to be provided will continue to be established by the City Council, through formal action on the Company's rate application. RESOLUTION APPROVING THE SECOND AMENDMENT TO THE AGREEMENT FOR SINGLE FAMILY RECYCLING SERVICES (EXHffiIT 5) The existing agreement for Single Family Recycling Services provides for Livermore Dublin Disposal(LDD) to collect the fees associated with the service. This amendment will identify that the City shall collect these fees as a property tax assessment and remit them to the LDD as a semi-annual payment to the Company. Increases in the cost of this service would continue to be based on changes in the Consumer Price Index. RESOLUTION AMENDING THE SCHEDULE OF SERVICE RATES FOR SOLID WASTE COLLECTION TO REFLECT THE COLLECTION OF MINIMUM SERVICE FEES BY THE CITY ON THE PROPERTY TAX BILL (EXHIBIT 6) As previously discussed certain service level options will no longer be offered. In addition the fee which the Company will be receiving from the City for all Minimum Service Customers, must be identified. RECOMMENDATION: Staff recommends that the City Council conduct a public hearing on the proposed changes to the City's Waste Management System. The proposal will reduce Staff time with reviewing requests for exemptions and processing appeals. Furthermore, Staff will avoid the time and effort involved with preparing for individual hearings on liens for delinquent accounts. Staff has attached a copy of the billing insert which will notify customers of the change in collection methods (Exhibit 7). It is recommended that following the Public Hearing, that the City Council adopt the Resolutions, Waive the reading and adopt the proposed Ordinance amendment on an urgency basis. . . CHRONOLOGY OF DEVELOPMENT OF MANDATORY GARBAGE ORDINANCE INCLUDING REASONS WHY THE CITY HAS UNDERTAKEN THIS CHANGE Prior to the development of this Ordinance, residents were required to dispose of accumulated garbage on a weekly basis. It was only legal to haul waste from a single residence. All other hauling was required to be conducted by the franchised waste hauler, with limited exceptions for items such as landscaping and demolition debris. January 1, 1990 AB 939 became effective. This State Law requires that cities develop plans to reduce the amount of solid waste placed in the landfill. The reductions must equal 25% in 1995 and 50% in the year 2000. Failure to meet these requirements could result in fines levied against the City of up to $10,000 per day. December 10, 1990 City Council approved a Memorandum of Understanding to allow the Waste Management Authority to secure the services of a Consul tant to prepare the Source Reduction Recycling Element (SRRE) for all of the member agencies. Auqust 26, 1991 City Council reviewed the Preliminary Draft SRRE at a City Council meeting. The draft plan identified as a short-term program, the inclusion of all single family homes in the curbside recycling program through the adoption of an ordinance requiring the minimum level of garbage service for all households. This results in an assurance that curbside recycling is extended to each household. No comments were received related to mandatory recycling. October 10, 1991 - City Council conducted a public hearing on the draft SRRE. No change was made to the inclusion of the mandatory program in the SRRE. December 23, 1991 Pursuant to previous direction by the City Council, Staff presented information to the City Council on the issue of mandatory garbage service. Based upon the information, Staff was directed to prepare the necessary ordinances and present them at a public hearing. January 13, 1992 - City Council conducted a public hearing on the proposed Mandatory Garbage Ordinance. The Ordinance was introduced and an amendment to the franchise agreement was approved. Once approved, all non-subscribers would have until March 16, 1992 to subscribe. January 17, 1992 - A total of 418 special notices were mailed to addresses not identified as current LDD customers. The notice advised of a public hearing to obtain input on the proposed Ordinance and explained how the system would work. January 27, 1992 - The City Council conducted a second public hearing. As a result of the special notice, Staff reported that they received 3 -1- EXHIBIT J- . . telephone inquiries. (Two persons took care of their own garbage and one was a garbage company employee.) Three members of the public representing 2 households addressed the City Council on this item. The Ordinance was passed on a majority vote. February 10, 1992 The City Council adopted by resolution an administrative procedure for Requesting an Exemption from Mandatory Garbage. March 23, 1992 - The City Council adopted the Final Source Reduction Recycling Element required under State Law. This document included as a recycling program the extension of garbage service (including curbside recycling) to each household. July 13, 1992 Staff reported that 38 customers requested an exemption, 6 were automatically granted as vacant homes under the Ordinance. Staff was directed to proceed with processing exemption requests under the explicit language of the Ordinance, which only provides for exemptions when no garbage is generated or produced. Auqust 24, 1992 Five of the households which had filed for exemption appealed the Staff denial to the City Council. The Staff determination was that an exemption was not warranted under the language of the Ordinance. The City Council upheld 4 of the denials and approved 1 exemption. December 14, 1992 - Staff presented a report at a public hearing on the establishment of an administrative fee for levying liens. One member of the public spoke at the hearing in objection to the fee and one member spoke in support of a fee. The public hearing was continued to January 11, 1993 to consider issues surrounding the imposition of the Mandatory Garbage Ordinance. January 11, 1993 - Staff presented a report at a public hearing on the establishment of an administrative fee for levying liens and discussing issues relating to the Mandatory Garbage Ordinance. Two members of the public spoke at the hearing objecting to the Mandatory Garbage Ordinance. Staff was directed to prepare documents to place a fee for garbage service on the property tax roll. This fee will be equivalent to the cost of one can service, recycling, the four special clean-ups, county fees, and administrative costs. April 24, 1993 - Staff presented City Council with an informational report detailing options related to the Mandatory Garbage Program. City Council directed Staff to return with the necessary documents to implement a program which collects fees for garbage service through property tax bill. State Law (AB 939) required that the City adopt a plan to reduce the amount of waste placed in the landfill. The City can face $10,000 penalties if it does not meet state requirements. . The adopted Source Reduction Recycling Element identifies that one recycling program to be implemented is the extension of curbside recycling to all residences. This is included as one component in the basic garbage rate for each household. . state Law requires that cities exert greater control over accounting for waste generated in the community. This includes tracking waste by the type of generator (i.e. residential, commercial, etc.). . The entire community benefits from recycling programs; therefore, it is appropriate to share the cost. If recycling programs are not in place, the City may not meet mandated goals and could face penalties. The entire community benefits from the avoided cost of locating and developing new landfills, if the existing ones are filled prematurely. . Weekly garbage service benefits the health, safety and welfare of the entire community. . The agency responsible for enforcement of health laws related to garbage accumulation supported the change. . Prior to establishment of the mandatory ordinances, local laws required residences to dispose of garbage on a weekly basis. There was not any mechanism to assure compliance with this law. . If an individual hauled their own garbage on a weekly basis to the closest licensed facility, they would spend more than $34 per month. The monthly cost of receiving service at their home is proposed to be $8.00 per month or less depending on the level of service. . Availability to regular service should reduce incidents of illegal dumping in commercial dumpsters and avoid increased costs of disposal to local businesses. . The cost of service includes special clean-ups, which occur on a quarterly basis. It is difficult for the collector to identify non-subscribers, who may benefit from the program without contributing any revenue for the service. . For small generators the City developed a Super Recycler rate which offers regular waste collection, curbside recycling, and special clean-ups for $6.90 per month or $1.59 per week (rate proposed in January, 1993). . The Ordinance contains provisions pursuant to State Law which allow for the recovery of delinquencies through a lien process. Without this process, uncollectible accounts are written off as a Company operating expense. This results in delinquencies being paid by those customers who are paying for their service. ORDINANCE - 93 URGENCY ORDINANCE AMENDING SOLID WASTE MANAGEMENT ORDINANCE TO PROVIDE FOR THE COLLECTION OF THE MINIMUM RESIDENTIAL BASIC GARBAGE FEE ON PROPERTY TAX BILL AND PAYMENT FOR SAID SERVICES BY THE CITY CHAPTER 5.32 - DUBLIN MUNICIPAL CODE SECTION 1 Chapter 5.32 of the Dublin Municipal Code shall be amended as follows: A. Section 5.32.094 Payment for Minimum Service shall be added to Chapter 5.32 of the Solid Waste Management Ordinance. Every person in possession or control of property in the City of Dublin which is provided garbage collection service by the collector shall pay such garbage fees as are set forth in Section 5.32.140. Fees and charges for the minimum service level for all residential units not receiving commercial bin service for the period of July I, to and including June 30 of each fiscal year shall be filed by the City with the County Auditor of the County of Alameda prior to August 10, who shall enter such fees and charges as an assessment on the tax roll and against the respective premises. The imposition of these assessments shall be in accordance with a Resolution duly adopted by the City Council. The Resolution levying the assessment may include the administrative costs associated with the cost of providing the service. Said assessments shall be collected at the same time and in the same manner as ad valorem taxes and other charges as are otherwise collectible by the County and shall be subject to the same penalties and the same procedures and sale in the case of delinquencies as proved for such taxes. All laws applicable to the levying, collection and enforcement of ad valorem taxes shall be applicable to such assessments as provided herein. All other fees and charges not assigned for collection to the County Auditor shall be billed and collected by the collector. B. Section 5.32.100 Responsibilities of Collector The collector shall collect all solid waste delivered to such places of collection and at such intervals as set fourth herein and shall transfer the contents of all solid waste receptacles into the vehicles provided therefor. The collector shall clean up any solid waste spilled during the collection and shall completely empty the receptacles and replace lids. The collector shall continue to provide uninterrupted minimum refuse collection service as identified in Section 5.32.140 to all residences. c. Section 5.32.110 Submission of Invoices and Receipts The collector shall, at least quarterly submit to every regular customer within the City a written, dated invoice for sums due and payable to be collected. Amounts due under this section shall exclude charges for the minimum service level. In the event the collector submits an invoice in advance of or at the beginning of a particular quarter, the sums due for such quarter shall not be deemed delinquent until the expiration of the second month of such EXHIBtT J- . . quarter. The collector also shall, if requested by any customer, render a written, dated receipt for any money received by the collector from such customer on account of solid waste collection services rendered or to be rendered. D. Section 5.32.115 City entitled to Payment for Minimum Residential Service The Collector City shall be entitled to payment from the owner as described in this chapter. Any assessments as described in Section 5.32.094 which remain unpaid may be collected thereafter by the City as provided herein. A. As scheduled and deemed appropriate by City, and i:n no case less that once per year, the City Council shall consider a report of delinquent accounts. Such report shaH pravidc fl record of all information requested in the written complaint. B. The City shall determine the name or names of the owner of the real property for which the service was provided, as identified in the latest equalized assessment roll of the County Assessor. The City shall identify the total amount due, including reasonable administrative charges as established by the City. The City Counci1shall fix a time, date and place for hearing any objections or protests thereto. C. The Director shall cause a notice of the hearing to be mailed to owners listed on the report not less than ten (10) days prior to the date of the hearing. D. At the hearing, the City Council shall hear any objections or protest of owners liable to be assessed for delinquent fees and administrative charges. The City Council may make revisions or corrections to the report as it deems just, after which, by resolutions, the report shall be confirmed. E. The delinquent fees and charges set forth in the report as confirmed shall constitute a special assessment against the respective parcel of land and shall be a lien on the property for the amount of such delinquent fees and charges. F. A certified copy of the confirmed report shall thereafter be filed with he appropriate County Official for the amounts of the respective assessments against the current assessment roll. The lien created attaches upon recordation, in the office of the County Recorder of the Count of Alameda, of a certified copy of the resolution of confirmation. The assessment may be collected at the same time and in the same manner as ordinary county ad valorem property taxes are collected, and shall be subject to the same penalties and the same procedure and sale in the case of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of County ad valorem property taxes shall be applicable to such assessment, except that if any real property to which such lien would attach has been transferred or conveyed to a bona fide purchaser for value has been created and attaches thereon, prior to the date in which the first installment of such taxes would become delinquent, then the lien which would otherwise be imposed by this section shall not attach to such real property and the delinquent fees, as confirmed, relating to such property shall be transferred to the unsecured roll for collection. C. The collector may charge the City, at the established collection rates, for those O.ffiers who arc delinquent. Such charges shall cover the pcriad duri:ng which the collector provided collection and di3posalservke it: for the delinquent owner. The amount af such charges shall be paid to the collector as provided f-or in the franchise agreement between the calledor and the City. . . Section 2. - Repeal of Specific Sections of Chapter 5.32 Chapter 5.32 oof the Dublin Municipal Code shall be amended by the repeal of the following sections: A. B. C. B. Section 5.32.111 Section 5.32.112 Section 5.32.113 Section 5.32.114 Failure to initiate service Complaint of non-payment Filing a written complaint by collector Continuation of Service Section 3: Urgency Ordinance: The provisions of this ordinance shall take effect on July I, 1993, pursuant to Government Code Section 36937 as an urgency ordinance. The urgency is based on the fact that the County's tax year begins July 1, and all assessments must coincide with this time frame for equity and continuity. Section 4: Posting of Ordinance: The City Clerk of the City of Dublin shall cause this Ordinance to be posted in at least three (3) public places in the City of Dublin i accordance with Section 36933 of the Government Code of the State of California. RESOLUTION NO. - 93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN **************** APPROVING AND ESTABLISHING THE COLLECTION OF MINIMUM RESIDENTIAL GARBAGE AND RECYCLING SERVICE FEES BY THE CITY ON THE PROPERTY TAX BILL WHEREAS, the City of Dublin is mandated by the State of California, under AB 939, to reduce the amount of Solid Waste going into the landfill; and WHEREAS, through the Mandatory Garbage Ordinance and other means, the City of Dublin is taking a proactive stance to meet the State Mandated Goals; and WHEREAS, the goal of the Mandatory Garbage Ordinance is to protect the health and welfare of the community, to provide recycling services to all single family residences and to equally share the costs of these programs by mandating that every residence contributes toward the cost of the service; and WHEREAS, it is the intent of the City Council to provide solid waste management services as effectively and inexpensively as possible; and WHEREAS, the collection of the charges for these services is best completed by charging every resident for the minimum service on the property tax bill; and WHEREAS, minimum service includes the weekly backyard pickup and disposal of one 32 gallon container, a curbside recycling program, and four special cleanup days; and WHEREAS, the City Council has considered this action as part of a noticed public hearing on May 24, 1993. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve and establish the collection of minimum residential service fees by the City on the property tax bill as shown in the attached Exhibit ^' attached hereto and by reference made a part hereof. BE IT FURTHER RESOLVED, that the City Staff are hereby authorized to undertake all administrative tasks to implement the assessments, including but not limited to an agreement with Alameda County for collection which may provide payment to Alameda County of its reasonable costs of collection not to exceed 1.7% of the total amount collected. EXHIBIT A CITY OF DUBLIN CALCULATION OF ASSESSMENT FOR MINIMUM RESIDENTIAL GARBAGE SERVICE Purpose of Fee: The purpose of this fee is to provide for minimum garbage and recycling services to all residences which receive individual garbage service. This includes certain programs and services necessary to comply with the California Integrated Waste Management Act of 1989 (AB939). Provision of the basic service level on a Citywide basis, protects the health, safety and welfare of the community. Allocation: The cost of the program and method of allocating the cost among all residential properties offered such services shall be as is set forth herein. Use of Fees: The use of fees collected pursuant to this program shall be used to pay for minimum residential garbage collection and recycling services, and administrative costs associated with the program. Limitations: The amount to be raised through the collection of the Minimum Garbage Service Fee for Fiscal Year 1993-94 does not exceed the estimated total cost of the Services and related expenses as described in the Staff Report presented at the May 24, 1993 Public Hearing before the Dublin City Council. Method To Be Used To Calculate Minimum Garbaqe Service Fees For Different Land Uses General: The fee shall only apply to residential properties which receive individual garbage collection and disposal; and are not serviced by centralized commercial dumpsters. Minimum Service shall include: Weekly collection and disposal of one 32 gallon container pursuant to the terms of this Agreement; and special clean-ups as designated in the Resolution identified in Section 7.8 of the Agreement. B. CITY shall submit fees owed to COMPANY in the following manner: 1. On or about December 1st, LDD shall submit an invoice covering the six month period from July 1st through December 31st. 2. On or about April 1st, LDD shall submit an invoice covering the six month period from January 1st through June 30th. 3. Invoices noted, in numbers 1 and 2 of this section shall identify the total number of units eligible for single family service. Said calculations shall be subject to verification by the CITY. 4. Each Semi-Annual invoice shall be computed based upon: [the number of eligible units] x [the current monthly rate shown in the City Council resolution establishing solid waste rates, less (-) any component associated with curbside recycling]. The following example is provided for descriptive purposes only. Example: Semi Annual Invoice # of eligible households = 5300 Current Monthly Rate per household = $8.00 (less recycling component of $1.34) = $6.66 Months Covered = 6 (July 1 - December 31) 5300 x 6.66 = $35,298 x 6 months = $211,788 Total amount to remitted by the City for Six Months of Services = $211,788 5. Provided CITY has received Invoices and verified calculations stated in numbers 1 and 2 above, payment shall be made in 45 days. C. Recitals A. On April 23, 1990, the Dublin City Council approved a comprehensive curbside recycling program for the CITY, and B. It is the intent of the CITY to amend the agreement to reflect a new billing practice to be put in place in conjunction with the Mandatory Garbage Program. C. The new billing process involves the collection of Recycling Fees by CITY on the property tax bill and making payments to LDD. D. Pursuant to the Agreement the monthly cost for Recycling services is currently $1.34 per household per month. Now, Therefore, CITY, OSC, and LDD do hereby agree that the Agreement regarding recycling in the City of Dublin shall be amended as follows: Section VI. Compensation for Services shall be deleted and restated as follows: A. LDD is authorized to receive fees for the single family residential curbside recycling program, as one component of the fee approved by the City Council Resolution for Minimum Residential Garbage Service. Said fees are levied by action of the City Council and shall be collected on the City's behalf as part of the Property Tax bill by the Alameda County Tax Collector. B. CITY shall disburse to LDD in two semi annual payments, fees owed in accordance with the following schedule. 1. LDD shall make a reasonable effort to coordinate any recycling rate adjustments considered by the CITY for residential garbage service. CITY shall be provided with a preliminary notice of adjustment including the calculation used, at least 60 days prior to its effective date. CITY shall incorporate adjusted fee as one component of the approved fee for minimum Residential Garbage Service. LDD shall provide written notification of any adjustment to all customers. The Curbside Residential Recycling Program requires that containers be placed in location which can be easily seen and readily accessible, within five feet from the curb. IV. ADDITIONAL SERVICES PROVIDED IN RATES The above rates shall include four (4) annual residential cleanups. Dates of said cleanups shall be at the discretion of the City upon reasonable notice to the Company. The rules regulating the special cleanup shall be approved by the Contractor and the Director. The Contractor shall separately account for costs associated with this service and report information as requested by the City. V. COMMERCIAL AND MULTIFAMILY BIN SERVICE A. The following rates include collection, disposal, and bin rental at commercial establishments and multifamily projects serviced by centralized bins. The rates shown are for a monthly period. This law was in response to State Mandates requiring cities to take greater control over the management of waste generated within the City. There was also a desire to assure that all residents who benefit from garbage and recycling services also contribute towards the basic cost. IF YOU ARE A TENANT YOU SHOULD NOTIFY THE PROPERTY OWNER OF THESE CHANGES. Effective July I, 1993 the Minimum Service Level shall include the following services: Weekly collection and disposal of one 32 gallon container. (Container shall not weigh more than 75 pounds.) This is provided as back yard service, provided the container is accessible to the Collector. Quarterly Special Saturday Cleanups, limited to three cubic yards and subject to other limitations.
