FINANCIAL STATEMENT: The proposed District cost estimate for Fiscal Year 1992-93 is $351,489, including an accumulated reserve for future pole replacement. An estimated $145,388 will be carried over from 1992-93 in the form of reserves. $191,621 is proposed to be assessed to property owners for the 1993-94 street lighting costs. DESCRIPTION: This is the second of two required public hearings regarding this proposed assessment. In 1983, the City Council formed a Citywide Street Lighting Assessment District to replace the County of Alameda Lighting Service Area. On August 13, 1984, the City Council approved the annual Engineer's Report and ordered levy of assessments for the first time. The District expenditures for the last three years and the budget for 1993-94 are detailed on Exhibit 1. Scope of Work • This assessment district funds the maintenance and repair cost of street lighting in the City of Dublin. By far, the greatest portion (over 90%) of the cost is the energy bill the City receives from PG&E. The rates paid to PG&E include electricity (unmetered service) and the cost of the specific street lighting maintenance which PG&E performs under each rate. Residential area street lights and some of the older arterial street lights are owned and maintained entirely by PG&E. The arterial street lights which were installed as part of City projects are owned by the City, and the rate paid to PG&E for those lights is proportionally lower. PG&E maintains bulbs, photocells, and lenses under the rate charged for the City-owned street lights. The City is responsible for other repairs and maintenance, including head replacement, fuses and other parts, accident damage repair, and so forth. This work is performed by contractors who are selected according to both expertise and price quoted. A very small portion of the cost funded by the assessment district is administrative in nature. This includes preparation of the Engineer's Report, the cost of collection charged by the County Assessor, a small delinquency percentage, and some ongoing Staff time to monitor maintenance of the street s lighting system. ITEM NO. • COPIES TO: CITY I C L E R KK FILE I The 1972 Act Assessment Districts are "benefit" districts; in other words, a benefit is provided to property owners in return for assessments levied. Residential property owners receive the benefit of lighting on their specific streets and also the benefit of lighting on arterial and collector streets which are used to access their homes. Commercial property owners receive the benefit of lighting on the arterial streets on which their businesses are located and on the streets used to access those streets. Street lighting is primarily considered to be "safety lighting" and reduces the City's liability exposure in relation to traffic safety and, to some extent, crime prevention. New Assessment District Regulations State Law previously required that one annual public hearing be held for 1972 Act Lighting and Landscaping Assessment Districts, and that a 10-day notice of the hearing be published in a local newspaper and posted in the City's three posting places. The noticing and hearing requirements changed in 1993 to require that notices also be mailed to all property owners affected by the assessment district (in this case, the entire City) and that two public hearings be held. The first public hearing is for the purpose of taking testimony only; no action is to be taken by the City Council until the second public hearing. Protests Received In accordance with State Law, Staff mailed notices to property owners owning in excess of 7,600 parcels in the City. The notices were mailed on Thursday, June 24, 1993. Although the notice did state that this assessment district was formed in 1983 to replace the old County Service Area, Staff received a number of telephone calls asking whether this is a new assessment. Staff will attempt to reduce these questions for Fiscal Year 1994-95 by emphasizing that this assessment has been in place for a number of years. A few of the protests received included correspondence which either indicated a misunderstanding of the assessment district or asked specific questions. For example, one property owner thought that the assessment district was paying off the initial cost of the street lights rather than ongoing energy and maintenance. Two other property owners thought they were being assessed for specific lights near their property. Staff has responded in writing to all questions and misunderstandings. As of the date of writing this Staff Report, 324 residential property protests and 30 commercial property protests had been received. Staff estimates that the area of property owned by those protesting is approximately 4.4% of the total assessable property area in the City. State Law provides that a protest consisting of owners of over 50% of the land area of assessable property would cause automatic abandonment of the assessment for 1993-94. Proposed Assessment Last year's assessment for a single-family house was $18.62. The estimated single-family assessment for 1993-94 is expected to be approximately one dollar higher per single family home. The actual assessments will be calculated once Staff has received the updated tax rolls from the Assessor's Office. It was brought to Staff's attention this year that the owners of duplexes are being assessed at a factor rate of 3, which means that the assessment is three times that of a single-family home. At the time the assessment district was formed, there was only one assessor's "use code" for multiples of two to four units, and the factor rate of "3" was applied as an average. There is now a separate use code for duplexes, and Staff recommends that the Engineer's Report be amended to assess duplexes at a factor rate of "2" and triplexes and fourplexes at factor rates of 3 and 4 respectively. There are 40 duplex lots in Dublin (no triplexes or fourplexes at this time), and this action would not appreciably reduce the total funds to be collected or increase the cost to other property owners. July 26th Public Hearing Three members of the public spoke at the first public hearing on July 26th. The first speaker asked a question regarding whether the State was able to take a part of the funds collected. The response was that the funds collected for this assessment district are utilized entirely by the District and are not used for any other purpose than District expenses. The second speaker spoke against several different assessments or fees and had thought the street light assessment was a new one just starting in Fiscal Year 1993-94. The third speaker, Mr. John Griffin, is the owner of several duplex properties. Mr. Griffin felt that the assessment for duplexes should be calculated on the basis of the lot's front footage rather than the proposed method of twice the single-family assessment (see letter, Exhibit 4). Staff responded that it. Page 2 would not be feasible to calculate the assessment on the basis of lot size and would also not be fair to owners of large-lot single-family homes versus those with smaller lots. The assessments in this district pay for the costs of maintenance of street lighting on public streets throughout the City of Dublin, including energy and repair costs. The estimated street lighting assessment per single-family home, townhouse, or condominium for Fiscal Year 1993-94 is $19.70. Other properties are proposed to be assessed as follows: two- to four-unit multiples, $59.10; apartment buildings, $118.20; other commercial properties, $108.35 per acre; vacant property, $9.85; exempt, cemetery, and common open space parcels, zero. ENGINEER'S REPORT Copies of the Preliminary Engineer's Report for this assessment district are available at the City Offices, 100 Civic Plaza, Dublin, California 94568. The Engineer's Report explains the scope of work, a breakdown of the costs that are proposed to be paid by the assessment district, and the method of proportioning the assessments between residential and commercial properties. PUBLIC HEARINGS Two public hearings will be held for the purpose of hearing protests regarding this assessment. At the first hearing, on July 26, 1993, the City Council will take testimony from the public. At the second hearing, on August 9, 1993, the City Council will again take testimony and then consider and act upon the Engineer's Reports. The public hearings will be held at regular City Council meetings, which begin at 7:30 p.m. These meetings will be held in the Council Chambers of the Dublin Civic Center, 100 Civic Plaza, Dublin. PROTESTS If you wish to protest this assessment, your protest must be made in writing and must be sent to the City of Dublin, 100 Civic Plaza, Dublin, California 94568. Protests must be received no later than the close of the second public hearing as listed above. Your protest should include both the street address of the property and the assessor's parcel number (APN) of the property. The APN for your property is indicated on the mailing label for this notice. You may use the form below and/or write a letter which includes the information on the form. The Landscaping and Lighting Act of 1972 provides that a majority protest, which would consist of property owners of over 50% of the land area of the property being assessed, would cause the abandonment of the assessment. So, I think it fair to assume that there may be other "assessments" down the road and what you do now may well set the precedent for future assessment allocations. So it's potentially very important to "get it right" the first time. Some facts to consider: there are 43 duplexes on Kimball, Beverly, Glen Oaks and Sovereign. (I know of no others in the city, although there may be a few scattered ones . ) Their standard lot is 60 front feet. The normal way to allocate assessment district expenses is by the benefit received. Most assessments for roads and utilities are allocated based on frontage: the wider the property, the more benefit received. Street . lighting is normally a roadway improvement, so it stands to reason to assess it on a front foot basis. That may be an administrative nightmare for you here, but it should be taken into account if it can be done without too much effort. The following is a suggested method. Surprisingly, the duplex lots are 60 f.f. , while nearby single family lots are 70 f.f. So it makes no sense at all to assess duplex lots three times as much as their SF neighbors. Using the SF assessment as the benchmark, the assessment of $19 .70 per 70 f.f. SF home is $0.2814 per f.f. Therefore, by that same standard, a duplex lot assessment should be ($0.2814 x 60 f.f.-) $16.89, or $8.45, say $9 per unit. I wouldn't argue if you even bumped it to, say $10 per unit ($20 per lot) . Don't you agree, the proposed $29.55 per unit for duplexes, is quite unfair? Even charging duplexes the same per unit as SF homes, $19 .70, if the assessment is to be based on the benefit each property receives, does not seem fair.
