FINANCIAL STATEMENT: The 1993-94 assessment as preliminarily approved in the Preliminary Engineer's Report is proposed to be $228.72 per single-family lot and $38.68 per multi-family (condominium) lot (total of$21,351.36 for Amador Lakes). An alternate plan for an increased assessment for landscape work on the interior would be $265.36 per single-family lot. The assessment per multi-family lot would remain at $38.68 since the single-family homes provide 100% of the funding for the interior slopes. DESCRIPTION: This is the second of two required public hearings regarding this assessment district. The Conditions of Approval for development of Tract 4719 required that a homeowners' association be formed to maintain certain common landscaping improvements within the Tract. Landscaping and Lighting Assessment District No. 1983-2 was formed at the request of the developer as an alternative to providing landscaping maintenance through the Amador Lakes and Dublin Hills Estates homeowners' associations. 0/°1 Scope of Work and Assessment Spread `- ITEM NO. 6♦ COPIES TO: Ron Nahas CITY CLERK ell C I 17,14,161-121O1 This District maintains landscaping and irrigation on the slopes along Stagecoach Road and also on the "interior" slopes of the Dublin Hills Estates development on Agate Way and Coral Way. The cost of maintenance of the Stagecoach Road landscaping is spread 60% to the Amador Lakes development, divided among the 552 condominium lots, and 40% to the Dublin Hills Estates development, divided among the 150 single-family lots. The "interior slopes" maintenance is spread among the 150 single-family lots only. Protests Received In accordance with State Law, Staff mailed notices to property owners in this District on Thursday, June 24, 1993 (Exhibit 1). As of the date of writing this Staff Report, 7 single-family protests had been received. Staff estimates that the area of property owned by those protesting is approximately 2.4% of the total assessable property area in this assessment district. State Law provides that a protest consisting of owners of over 50% of the land area of assessable property would cause automatic abandonment of the assessment for 1993-94. Proposed Assessment The District diagram remains the same as last year's. Based on the approved Preliminary Engineer's Report, the proposed assessment for the 1993-94 Fiscal Year is $55,659.36, which is approximately $7,681.92 lower than last year's assessment. This is due to a one-time assessment increase for 1992- 93 to pay for additional landscaping replacement on the interior slopes and to develop a schematic plan for the relandscaping of the Stagecoach Road slopes. This Alternate "A" will provide basic weed removal, fertilizing, and watering. It does not include provision for large scale relandscaping and pruning services. As an alternative to raising the assessments for the Stagecoach Road slopes, a proposal has been made to leave the assessments the same as the 1992-93 assessments for the single-family homes and use the money to further improve the interior slopes on Agate Way and Coral Way. This would increase the proposed assessment from $228.68 to $265.36 per single family home and would raise a net of $5,232. An Alternate "B" Engineer's Report and revised Resolution which reflect these changes have been included for review. Proposed Relandscaping of the Stagecoach Road Slopes (Alternate C) The landscape architectural firm of David Gates and Associates was retained to develop schematic plans (Exhibit 9) for the three large Stagecoach Road slopes to improve the aesthetics of the slopes and to design the landscaping so as to reduce future water and maintenance costs. The chronic District problem has been that the area of landscaping to be maintained in this District is relatively large for the number of property owners who must pay the maintenance costs. The budgets have only allowed for watering, fertilizing, weeding, and a small amount of plant material replacement. This District has been plagued with problems such as drought, ground squirrels, snails, heavy freeze, and a vandalism problem higher than any other part of Dublin. The budgets have not been able to afford the massive renovation needed to keep the landscaping in first-class condition. The new schematic plan developed by David Gates and Associates was reviewed with the homeowners who attended the neighborhood meeting on July 15th (10 people representing 7 homes, plus a representative from the Amador Lakes Apartment development). This plan would accentuate the corner monument areas (15) with colorful perennial flowers and flowering trees, would place a hedgerow at the upper fence line on drip or bubbler irrigation, provide a row of bushes to outline the upper edge of the existing Vinca groundcover on the lower 20 feet of the slopes, provide new tree clusters, and would return the upper middle one-third to one-half of the slopes to non-irrigated native grasses. The estimated cost for these improvements is in the $80- to $100,000 range, and the savings in water and maintenance would be in the $7- to $8,000 range per year. Based upon the testimony received at the July 26th public hearing those property owners present did not support this Alternate C Relandscaping Plan. Page 2 9 � July 26 Public Hearing Following is a synopsis of the individual comments by the nine property owners who spoke at the July 26th public hearing. 1) Several favored the alternate for an additional assessment to match last year's assessment ($265.36), which would fund additional plant material for the interior slopes. 2) The new schematic plans on the Stagecoach slopes would intensify landscaping at the corners and along the base of the slopes and return the upper middle portion to native grasses. Most felt that this plan was prepared as directed, but that the plan was not cost-effective, and the residents were not in favor of removing plant material that has finally come back. 3) Some property owners have done their own planting at some of the street corners, and it does not match the rest of the street. 4) The landscaping has done pretty well this last year, but there are still patchy spots. 5) Landscaping lacks proper maintenance and would like to have an independent contractor evaluate the landscape. 6) The District is underfunded. 7) Mr. Ron Nahas, representing Amador Lakes apartments, offered to maintain the planter strip along his frontage (approximately $1,200 savings to the District per year) to help free up money for replanting. He also volunteered to purchase plant material if the homeowners were willing to do the planting. 8) There was some discussion about forming a homeowners' association to take over the maintenance, but there was concern about getting volunteers to administer the association and getting people to pay their annual dues. Recommendation Staff recommends that the City Council conduct a public hearing, deliberate, and adopt Resolution Exhibit 4 approving Engineer's Report Alternate "A" (maintenance and utility costs only - $228.72 per single-family home), unless the City Council hears greater support from District landowners for the higher assessment associated with Alternate "B", interior slope landscape upgrade. If the City Council wishes to approve Engineer's Report Alternate "B" (assessment for maintenance and utility costs plus the interior slope landscape upgrade - $265.36 per single-family home), Resolution Exhibit 8 should be adopted. a:(ad)t83-2183-2ph • Page 3 NOTICE OF ASSE ENT LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2 (STAGECOACH ROAD) This assessment district funds the maintenance of landscaping improvements along Stagecoach Road and on the "interior slopes" of Jade Circle/Agate Way and Topaz Circle/Coral Way. The district was formed as an alternative to utilizing a homeowner's association to maintain the landscaping. The activities funded by this assessment district include irrigation maintenance(including utility costs), weeding,pruning, fertilizing, and other activities associated with maintenance of landscapes. The assessment for this district is spread between the property owners of the Amador Lakes Apartments, who pay 60% of the cost of Stagecoach Road landscape maintenance, and the property owners of the 150 single-family homes of the Dublin Hills Estates development, who pay 40% of the cost of Stagecoach Road landscape maintenance and 100% of the cost of the interior slopes landscape maintenance. The assessment for the 1993-94 tax year is proposed to be as follows: Single-family lots: $228.72 per lot; Amador Lakes apartment lots: $38.68 per apartment The above figures reflect the estimated cost for maintenance in Fiscal Year 1993-94 but do not include funds for revising the existing landscaping. If you are interested in paying an increased assessment in order to fund relandscaping of this assessment district(similar to the increase requested for 1992-93), please let us know either by letter or at the informational meeting. The amount of the assessment must ultimately be approved by the City Council. ENGINEER'S REPORT Copies of the Preliminary Engineer's Report for this assessment district are available at the City Offices, 100 Civic Plaza, Dublin, California 94568. The Engineer's Reports explain the scope of work, a breakdown of the costs that are proposed to be paid by the assessment district, and the method of proportioning the assessments between the single-family and apartment/condominium lots. INFORMATIONAL MEETING An informational meeting will be held on July 15, 1993, at 7:00 p.m. in the Regional Meeting Room of the Dublin Civic Center, 100 Civic Plaza, for the purpose of answering questions and discussing the activities which have taken place in this assessment district during the past year and those activities planned for the future. Property owners are encouraged to attend this informational meeting. If you are unable to attend but wish to provide input, please feel free to call or write the Public Works Department prior to the meeting. PUBLIC HEARINGS Two public hearings will be held for the purpose of hearing protests regarding this assessment. At the first hearing, on July 26, 1993, the City Council will take testimony from the public. At the second hearing, on August 9, 1993, the City Council will again take testimony and then consider and act upon the Engineer's Reports. The public hearings will be held at regular City Council meetings, which begin at 7:30 p.m. These meetings will be held in the Council Chambers of the Dublin Civic Center, 100 Civic Plaza, Dublin. PROTESTS If you wish to protest this assessment, your protest must be made in writing and must be sent to the City of Dublin, 100 Civic Plaza,Dublin, California 94568. Protests must be received no later than the close of the second public hearing as listed above. Your protest should include both the street address of the property and the assessor's parcel number(APN) of the property. The APN is shown on the mailing label for this notice. You may use the form below and/or write a letter which includes the information on the form. The Landscaping and Lighting Act of 1972 provides that a majority protest, which would consist of property owners of over 50% of the land area of the property being assessed, would cause the abandonment of the assessment. I be liable to pay the proposed assessment. ;;y; • 1 � STAGECOACH ROAD(TRACT 4719) LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NEWSLETTER FACTS ABOUT THE ASSESSMENT DISTRICT This assessment district was formed in 1983 for the purpose of maintaining certain landscaping improvements along Stagecoach Road and on the"interior slopes"of the Dublin Hills Estates development(Coral Way and Agate Way). The following areas are being maintained by the City at the present time: • Landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between Amador Valley Boulevard and the northerly City Limit. • Slopes and landscaping and irrigation of the slopes within a public easement for those slope areas to the rear of Lots 80 through 86 and 37 through 48 of Tract 4719. These are the"interior slopes"which face houses on Agate Way and Coral Way. In order to arrive at the annual assessment,estimated maintenance costs for the ensuing year are divided among residents • of the single-family homes of Dublin Hills Estates and the owners of the Amador Lakes Apartments as follows: • • Sixty percent(60%)of the annual cost of maintaining the landscaping within and along Stagecoach Road has been assigned to the 552 apartment/condominium lots of Amador Lakes,distributed on an equal • basis. The remaining 40%of this annual cost has been divided equally among the 150 single-family lots in Dublin Hills Estates. • The cost of maintaining the excavated slopes,concrete culverts,and landscaping on the interior slopes of the single-family area(Agate Way and Coral Way)is divided evenly among the 150 Dublin Hills Estates lots. The monies collected through assessments are accounted for separately from other City funds. These funds can only be used for specified expenses within the boundaries of the Assessment District. LANDSCAPING For Fiscal Year 1992-93,property owners requested and the City Council approved a one-time increase in the assessment in order to fund some plant replacements that were not otherwise funded and also to obtain the services of a landscape architect to prepare a preliminary plan to relandscape the Stagecoach Road slopes. The intent of the plan is to provide a landscape which is less maintenance intensive and also drought tolerant. David Gates and Associates was chosen by a committee of property owners,and he is presently working on the plan. It is hoped that a report on the plan can be made at the July 15th neighborhood meeting. To date,35 trees have been replaced along Stagecoach Road. A volunteer project is planned for June 26th to plant approximately 800 star jasmine plants in the planter strip along the Coral Way and Agate Way interior slopes. IRRIGATION Since last year,the City has experienced a 9%increase in the cost of water from the Dublin San Ramon Services District, and we are anticipating another increase in January of 1994. Unfortunately,vandalism of irrigation heads,while not as bad as in past years,is still a problem. The irrigation systems installed in this District were installed to water erosion control grasses,not permanent landscaping. The result is a less-than-efficient system. The City's maintenance department is appreciative of residents who have called regarding broken sprinklers. Our response to these requests will continue to be immediate so that water won't be wasted. PARK IMPROVEMENTS The cost of park maintenance for the Dougherty Hills Open Space and Stagecoach Park,is paid entirely by the City and is not charged to the assessment district. The City's park masterplans include a number of future improvements for the Dougherty Hills Park(the"hill"to the east of Stagecoach Road). To date,trails have been cut to allow hiking on the hill. Due to the City's present budget constraints,the Five Year Capital Improvement Program currently lists any future plans or improvements for this area as unfunded. The residents of Topaz Circle petitioned the City Council,Zone 7 Flood Control,and the Dublin San Ramon Services District to aid in providing trees and bushes along the faces of the Dougherty Hills slopes which front Topaz Circle: The --- - - City Council allotted$17,000,and DSRSD and Zone 7 have allotted$11,000 to landscape the access to the water reservoir. The neighbors have provided the labor to install the plant materials and irrigation,and this project is nearly complete. The City will be responsible for the maintenance of these new improvements as part of the park maintenance budget. The balance of this annual cost has been divided equally among Lots 1 through 150, inclusive, of Tract 4719. The cost of maintaining the excavated slopes and concrete culverts together with its landscaping on the interior slopes of the single-family area (excluding those slopes and concrete culverts adjacent to Stagecoach Road) shall be evenly spread over Lots 1 through 150 of Tract 4719. Lots 152 and 153, being park and open space, shall have a zero assessment. Lots 154 and 155, being public agency owned, shall have a zero assessment. 5 SCOPE OF WORK The scope of work shall be the maintenance of landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between the limits of Amador Valley Boulevard and the northerly City Limit. I, the City Clerk of the City of Dublin, California, hereby certify that a certified copy of the Assessment and diagram was filed in the office of the County Auditor of the County of Alameda, California, on " , 1993. 8 RESOLUTION NO. -93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT, AND ORDERING LEVY OF ASSESSMENT CITY OF DUBLIN LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2 (STAGECOACH ROAD) WHEREAS, by its Resolution No. 21-93, a Resolution Directing Preparation of Annual Report for City of Dublin Landscaping and Lighting Maintenance Assessment District No. 83-2 (the "District"), this Council designated the City Engineer as Engineer of Work and ordered said Engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, said report was made and fled with the City Clerk and duly considered by this Council and found to be sufficient in every particular, whereupon it was determined that said report should stand as Engineer's Report for all subsequent proceedings under and pursuant to the aforesaid Resolution and that July 26, 1993 and August 9, 1993, at 7:30 p.m. in the Council Chambers, Dublin Civic Center, 100 Civic Plaza, Dublin, California, were appointed as the time and place for a hearing by the Council on the question of the levy of the proposed assessment, notice of which hearing was mailed, published and posted in accordance with Government Code Section 54954.6; and WHEREAS, at the appointed time and place, said hearings were held, and all persons interested desiring to be heard were given an opportunity to be heard, and all matters pertaining to said levy were heard and considered by this Council, and this Council thereby acquired jurisdiction to order said levy and confirmation of diagram and assessment prepared by and made a part of the report of said engineer to pay the cost and expenses thereof; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve that: (a) The property owners owning more than fifty percent of the area of assessable land within the District had not, at the conclusion of said hearing, filed written protests against the said proposed levy, or against the Engineer's Estimate of costs and expenses, or against the maps and description, or against the diagram or the assessment to pay for the costs and expenses thereof; (b) The public interest, convenience, and necessity require that said levy be made; (c) The District benefited by said improvements and to be assessed to pay the costs and expenses thereof, and the exterior boundaries thereof, are as shown by a map thereof filed in the office of the City Clerk, which map is made a part hereof by reference thereto. Last year, an additional assessment of$45.00 was approved for the 1992-93 fiscal year for the purpose of(1) filling in plant material on the Agate Way and Coral Way interior slopes, and(2)hiring a landscape architect to prepare a conceptual plan for relandscaping the Stagecoach Road slopes. The plant material was installed through a volunteer project at the end of June. The conceptual plan prepared by David Gates and Associates was reviewed by the homeowner committee on July 13th and presented at the neighborhood meeting on July 15th. This plan proposes to retain and enhance the existing trees and ground cover along the bottom of the slope at Stagecoach road, provide a strip of shrubbery at the top of the slope along the existing fence, and allow the center portion of the slope to return to native grasses. The existing irrigation would be modified or replaced with more appropriate, water-saving devices. In addition, it is proposed to emphasize the entries at the corners by using colorful plantings. This would result in a more aesthetic view at the street level and save money for irrigation and maintenance(see enclosed sheets). The proposed 1993-94 assessment of$228.72, which is$36.64 less than the 1992-93 assessment, includes funds for maintenance of existing landscaping but does not include funds to implement any of the Stagecoach Road relandscaping plan. At the neighborhood meeting, it was proposed to increase the assessment in order to begin the work in the Spring of 1994. The consensus of the property owners at the neighborhood meeting was to increase the assessment to $300 per single- family home to generate additional monies to begin the implementation of Stagecoach Road relandscaping. Mr. Ron Nahas, who represents the Amador Lakes apartments and who would be responsible for 60% of the increased costs, has objected on the basis that the the estimated long-range maintenance savings would not justify the relandscaping expenditure. The estimated cost of the total slope relandscaping is in the range of$80-to$100,000, and the annual maintenance and water savings is estimated to be in the range of$7-to$8,000 per year. As an alternate to the above increases, it has been suggested that the single-family homes be assessed at the same rate as was assessed in 1992-93 ($265.36). This would generate an additional$5,232 to be used on the upgrading of the two interior slopes(Agate Way and Coral Way). City Staff will be presenting the options at the City Council meetings on July 26th and August 9th. We encourage you to attend this meeting and present your views. If you cannot attend either of the meetings; you may respond in writing prior to the August 9th meeting. No final decisions will be made until the close of the public hearing on August 9th. To refresh your memory,the Amador Lakes apartment development pays 60%of the maintenance cost of the landscaping along Stagecoach Road and its slopes. The 150 single-family homes pay the remaining 40% of the Stagecoach Road landscape maintenance and all of the maintenance costs for the two interior slopes along Agate Way and Coral Way. Following is a synopsis of the individual comments by the nine property owners who spoke at the July 26th public hearing. 1) Several favored the alternate for an additional assessment to match last year's assessment($265.36), which would fund additional plant material for the interior slopes. 2) The new schematic plans on the Stagecoach slopes would intensify landscaping at the corners and along the base of the slopes and return the upper middle portion to native grasses. Most felt that this plan was prepared as directed,but that the plan was not cost-effective,and the residents were not in favor of removing plant material that has finally come back. 3) Some property owners have done their own planting at some of the street corners, and it does not match the rest of the street. 4) The landscaping has done pretty well this last year,but there are still patchy spots. 5) Landscaping lacks proper maintenance and would like to have an independent contractor evaluate the landscape. 6) The District is underfunded. 7) Mr. Ron Nahas,representing Amador Lakes apartments, offered to maintain the planter strip along his frontage (approximately$1,200 savings to the District per year)to help free up money for replanting. He also volunteered to purchase plant material if the homeowners were willing to do the planting. 8) There was some discussion about forming a homeowners'association to take over the maintenance, but there was concern about getting volunteers to administer the association and getting people to pay their annual dues. (over) ;1i.4 g; to �I.ILU TU l�tlQ . . .0 The two alternates that are under discussion for 1993-94 are: 1) Assess the single-family homes at$228.72 each and the multi-family development at$21,351.36. This would provide basic weeding,watering, and fertilizing,but very little plant replacement and pruning. OR 2) Assess the single-family homes at$265.36 each, keeping the multi-family development the same. The additional$5,496 raised would go toward improving the landscape materials along the two interior slopes.
