Acceptance of Improvements - Tract 6052 (Standard Pacific -
Torrey Pines)

RECOMMENDATION: ~ Adopt resolution accepting improvements in Tract 6052, subject
\ to the developer's one-year guarantee period, and authorize Staff
to accept maintenance bond at a future date.
FINANCIAL STATEMENT:
Streets within this Tract are private; the City will incur no
maintenance or street sweeping costs. Maintenance costs for the
landscaping, soundwall, and fencing along Dougherty Road and
Fall Creek Road are paid by Maintenance Assessment District
1986-1.
DESCRIPTION: In February of 1990, the City Council approved the Final Tract
Map for Tract 6052, Torrey Pines. This 135-lot townhouse subdivision is also known as "Village IV"
of the Villages at Willow Creek. The developer is Standard Pacific of Northern California. At the .
time of Final Map approval, Standard Pacific provided the City with a performance bond in the
amount of $532,300 and a labor and materials bond in the amount of $266,150 which guaranteed
construction of the improvements and payment to contractors and suppliers.
The City Engineer has reviewed the improvements constructed within Tract 6052 and determined that.
the work was completed satisfactorily and in accordance with the approved plans. Upon City Council
acceptance of the improvements, and in accordance with the Government Code and the City's Tract
Developer Agreement, Standard Pacific may substitute a maintenance bond which is 1/4 of the
performance bond amount. The maintenance bond serves as a guarantee that the improvements will
remain in satisfactory condition for a period of one year. At the conclusion of the one-year period,
Staff will review the Tract improvements, require the developer to make any repairs that are
necessary, and release the maintenance bond.
Staff recommends that the City Council adopt the resolution accepting the improvements in Tract
6052 and authorize Staff to accept the maintenance bond at a future date.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING IMPROVEMENTS IN TRACT 6052
VILLAGE IV "TORREY PINES"
WHEREAS, the owner-subdivider of the aforesaid Tract previously entered into a
contract with the City of Dublin to improve said Tract in accordance with plans and specifications on
file with the City Engineer, said Tract identified as follows:
Subdivider: Standard Pacific of Northern California
Tract Location: Westerly of Dougherty Road; southerly of Fall Creek Road
Tract Size: 135 condominium lots
Resolution Approving Final Map: 11-90
City Streets Affected: None-
WHEREAS, said improvements have been completed in accordance with said plans
and specifications, and any approved modifications thereof, to the satisfaction of the City Engineer of
the City of Dublin; and
WHEREAS, as a condition of said contract, the subdivider is required to guarantee
the improvements and to maintain the completed work for a period of one year following acceptance
of the work by said City of Dublin; and
WHEREAS, as the improvements are now completed, the original performance bond
security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of
the Government Code of the State of California, to an amount found necessary to guarantee
maintenance of the completed work for the aforesaid one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within said Tract be, and they are hereby
approved and accepted subject to the aforesaid one-year guarantee; and
2. The aforesaid original performance bond security requirement be reduced from
the amount of $532,300 to a revised security requirement in the amount of $133,075, upon acceptance
by Staff of the replacement maintenance bond in the said amount of $133,075, as security for the
aforesaid one-year guarantee period; and the Mayor of this Council be, and he is hereby authorized
and directed to execute said bond on behalf of the said City of Dublin; and

3. The said original performance bond in the amount of $532,300 posted in
connection with the work involved in the construction of said Tract be hereby released upon
acceptance of said maintenance bond.
