AGENDA STATEMENT
City Council Meeting Date: February 14, 1994
SUBJECT: Authorization to Prepare Engineer's Report
Landscaping and Lighting Maintenance Assessment District 86-1
(Tract 5511)
Report by: Public Works Director Lee Thompson
EXHIBITS ATTACHED: / Resolution directing Staff to prepare the Engineer's Annual
Report for Landscaping and Lighting Maintenance Assessment
District 86-1.
RECOMMENDATION: /\f Adopt resolution
FINANCIAL STATEMENT: The cost to prepare the Engineer's Report is approximately
$1,500. This amount is budgeted in the Engineering Operating
Budget and is paid by the Assessment District.
DESCRIPTION: This assessment district maintains roadside and median
landscaping associated with the Villages at Willow Creek development off Dougherty Road. As part
of the review and approval of the 145-unit single family development (Ridgecreek) and the other,
multifamily Villages, certain landscaping maintenance was made a condition of approval. In lieu of
forming a homeowners' association to perform landscape maintenance, the developer requested
formation of this assessment district. Activities include litter pickup and maintenance of soundwalls
and landscaping along Dougherty Road between Amador Valley Boulevard and Fall Creek Road,
along Amador Valley Boulevard between Dougherty Road and Wildwood Road, and along Wildwood
Road, Fall Creek Road, and Willow Creek Drive. The City Council approved formation of this
District on November 10, 1986, with the initial assessment in the 1987-88 tax year.
The City incurred new, more stringent noticing requirements for Fiscal Year 1993-94, which mandate
that local jurisdictions provide 45 days' notice and two public hearings prior to enacting any new or
increased tax assessments. Staff will continue the practice of mailing detailed notices to property
owners in this assessment district and will hold an informational meeting prior to the public hearing
for the purpose of discussing maintenance activities and costs with the property owners.
This resolution authorizes the City Engineer to begin preparation of the required Engineer's Report
for the Assessment District for FY 1994-95. The procedure for establishing annual maintenance
assessments requires that the City Council first authorize preparation of the report. The preliminary
report is then brought back to the City Council for approval later in the year. Following the City
Council's approval of the preliminary report, two public hearings will be held regarding the proposed
assessment.
Staff recommends that the City Council adopt the resolution.
