REGULAR MEETING - June 13. 1994 A regular meeting of the city council of the city of Dublin was held on Monday, June 13, 1994, in the Council Chambers of the Dublin civic Center. The meeting was called to order at 7:35 p.m., by Mayor Snyder. * * * * ROLL CALL PRESENT: Councilmembers Burton, Houston, Howard, Moffatt and Mayor Snyder. ABSENT: None. * * * * PLEDGE OF ALLEGIANCE Mayor Snyder led the Council, Staff and those present in the pledge of allegiance to the flag. * * * * Missinq Person Reoort (150-50) Cm. Burton stated he had just received word that a young lady who is a graduate of Valley Christian High School here in Dublin has been missing for 24 hours. She lives in Livermore. She drives a 1991 Ford Tempo with a bumper sticker on it advertising Mary Kay Cosmetics and another which says Ski Bear. She is a Christian and has been placed on the prayer chain hotline. Everyone is praying that this situation will resolve itself soon. * * * * CONSENT CALENDAR On motion of Cm. Moffatt, seconded by Cm. Howard, and by unanimous vote, the Council took the following actions: Approved Minutes of Regular Meeting of May 23, 1994; Adopted RESOLUTION NO. 40 - 94 AUTHORIZING THE MAYOR TO EXECUTE AGREEMENT FOR SUPPLEMENT NO. 004 (CYCLE 4) SB 300 STATE-LOCAL PARTNERSHIP FUNDS (600-50) Adopted RESOLUTION NO. 41 - 94 ADOPTING AMENDMENTS TO THE CONGESTION MANAGEMENT AGENCY JOINT POWERS AGREEMENT (600-40) Received a Report and authorized the Mayor to execute a Budget Change Form for ClP Project #9690 Dublin Boulevard Extension (670-20); *@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@ CM - VOL 13 - 152 Regular Meeting June 13, 1994 ---------------------------------------------------------------------- ITEM NO. Received a Report related to McDonald's McSOCCERFEST being held at the Dublin Sports Grounds on June 17-19, 1994 (950-40); Approved Warrant Register in the amount of $589,488.16 (300-40). Cm. Houston requested that the Investment Report be pulled from the Consent Calendar. He complimented staff for diversifying from LAIF and asked if we have one person or entity that we are buying from. Mr. Rankin stated Staff typically only deals with California brokers and there are 3 that we have dealt with. Most of the trades recently have been new issues. We deal with Shearson, Dean Witter and B of A Securities. On motion of Cm. Houston, seconded by em. Burton, and by unanimous vote, the Council received the city Treasurer's Investment Report as of May 31, 1994 (320-30). Cm. Houston requested that the item appropriating revenues to reserves be pulled from the Consent Calendar as he did not understand exactly , what this was all about. He asked what the projects were that will take more than one year to complete. Mr. Ambrose explained that this requirement came about as a result of the Gann Initiative relative to the appropriations limit. This action would preclude the need for the Council to take any further action to account for differences between the estimates and the actual final revenues and expenditures for FY 1993-94. Mr. Rankin pointed out that this is being done as a result of the direction of the Council at the March budget study session. As an example, in the current year, we did not anticipate any Measure D monies so the money now needs to be appropriated to reserves so that it can be used in the future. Cm. Moffatt asked if options like library funding would be included in this. Mr. Ambrose responded that General Fund reserves certainly could be used for this purpose. On motion of Cm. Houston, seconded by Cm. Moffatt, and by unanimous vote, the Council authorized Staff to appropriate any revenues in excess of budgeted expenditures as of June 30, 1994 to reserves (330-20) . Cm. Houston requested that the 3 Assessment District reports be pulled from the Consent Calendar for discussion. He stated he was happy to see we aren't recommending an increase to the assessments, but questioned why the reserve amounts are so high. The citywide Street Lighting District, 4.8 has $148,133, District 86-1, 4.9 (Tract 5511) has $131,393, and District 83-2, 4.10 (Tract 4719) has $19,155 in reserves. Mr. Thompson stated with regard to the Villages @ Alamo Creek (Tract 5511), they didn't get their landscaping in for quite some time so the reserves grew. Each year we use a little bit of the reserves to keep the assessments fairly constant. It could handle replacement plants in the event of a big freeze or something of this nature. Mr. Rankin stated we are awaiting some information with regard to the street lights from the independent appraisal being done. We will have a better feel when this information is available. em. Houston questioned whether a 25% reserve amount was reasonable. Mr. Thompson stated we will be getting a report from the appraiser which should give us a better handle on the street light situation. We have in excess of 1600 street lights and will be spending about $400,000. A lot of the street lights are old and date back to the first Volk-McLain development. On motion of Cm. Houston, seconded by em. Howard, and by unanimous vote (Cm. Burton abstained from voting on Resolutions No. 46 and 47 due to a conflict of interest. * * * * REQUEST FOR eITY COUNCIL SUPPORT OF THE PLACEMENT OF A SPECIAL TAX FOR LIBRARY SERVIeES ON THE NOVEMBER 1994 BALLOT (660-30/940-30) Recreation Director Lowart presented the staff Report and advised that Alameda County Librarian Linda Wood has requested council support related to a special tax which would restore funding to Alameda County Libraries that was lost as a result of the recent tax shift from city and county governments to the state. The amount of the tax per year ranges from $10 to $30 and will require a 2/3 vote. It is estimated that this special tax will generate at least $4.15 million annually for 5 years. If the measure passes, County funded hours at the Dublin Library would increase from 17 hours to 34 hours per week. Linda Wood, County Librarian, representing the Library Advisory commission gave background information and stated they lost a lot of their funding last year. They looked at ways of recovering resources. A scientifically valid study was done in January. The survey indicated that 67% of Dublin voters were satisfied with library services in general and 32% were dissatisfied. The main area of dissatisfaction was the limited hours. This was no surprise to them. After hearing the ballot arguments, 73% of the Dublin people indicated they would vote for a special tax. This will go to the Board of Supervisors on June 21st and they will have until August 12th to consider placing it on the ballot. Cm. They would also purchase reference materials and restore children's programming, as well as services for young adults. In terms of the State taking away more money, this could happen at any time. They don't believe, however, that there is a strong likelihood that they will take more. There is a bill going through the legislature now that says there will be no more property tax take-away from libraries. The bill is now in the Assembly. Burton stated it is conceivable that somebody could say you are getting this so you don't need that. This could come about in some form that could require reduced hours. Ms. Wood stated they are trying to protect themselves from this and discussed the concept of maintenance of effort. Cm. Moffatt discussed the possibility of the money going for not only capital expenditures but also maintenance, buying buildings, buying supplies, sweeping floors, salaries, etc. He asked if there was any direction with regard to what this money goes for. Ms. Wood stated it isn't specified that it could be used for capital funds. It can't be used to build buildings or remodel buildings. Cm. Moffatt commented that it appears there is a good grassroots group to support this. On motion of em. Burton, seconded by Cm. Moffatt, and by unanimous vote, the Council agreed to support this measure being placed on the ballot to provide citizens an opportunity to vote on the special Library Tax. * * * * PUBLIC HEARING - ZONING ORDINANCE AMENDMENT TO THE PLANNED DEVELOPMENT DISTRICT PROVISIONS PA 94-015 (450-20) Mayor Snyder opened the pUblic hearing. Planning Director Tong presented the Staff Report and advised that an Ordinance was introduced at the May 23, 1994 City council meeting providing for revisions to the Planned Development District provisions of the Zoning Ordinance which would clarify that prezoning or rezoning of property to the PD District may take place independent of the approval of a Land Use and Development Plan and that PD Districts can be applied to any residential or non-residential districts. No testimony was given by any member of the public relative to this issue. Mayor Snyder closed the public hearing. On motion of Cm. Burton, seconded by Cm. Houston, and by unanimous vote, the Council waived the reading and adopted ORDINANeE NO. 4 - 94 REPEALING CERTAIN PROVISIONS OF CHAPTER 2 TITLE 8 OF THE DUBLIN ZONING ORDINANCE REGARDING PLANNED DEVELOPMENT (PD) DISTRICT REGULATIONS AND ADOPTING ARTICLE 2 AND ARTICLE 4 OF CHAPTER 2 OF TITLE 8 OF THE DUBLIN ZONING ORDINANCE WHICH MODIFIES THE CITY OF DUBLIN PD DISTRICT REGULATIONS * * * * *@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@ eM - VOL 13 - 156 Regular Meeting June 13, 1994 . . OTHER BUSINESS Livermore Valley Leadership Group Meetinq (610-05) Mr. Ambrose reminded everyone of the Livermore Valley Leadership Group meeting on Wednesday, June 15th at 5:00 p.m. The topic will be a status report on the fire service consortium currently underway. * * * * CTV Channel 30 Call-In Show (1050-50) Ms. Keck advised that CTV Channel 30 would like to broadcast another live call-in show with the city Council responding to telephone questions. The Council agreed to a date of Tuesday, July 26th. Mayor Snyder requested that Ms. silver research the new Brown Act regulations to determine how this type of an event would be noticed. * * * * Tri-Vallev Transportation Council (1060-40) Cm. Moffatt advised that he had the Tri-Valley Transportation Council's issue paper #2, Alternate Solutions and would be happy to make copies for anyone interested. * * * * East Bav Division Meetinq (140-25) Cm. Moffatt reported that the League's East Bay Division Directors met last week and a resolution was passed in support of AB 1877 which sanctifies the Pleasanton/Hayward/Alameda County agreement related to the Pleasanton ridge. He thought it passed by a 10/3 vote. * * * * Siqn Ordinance (400-30) Cm. Houston questioned the status of the Sign Ordinance revisions. Mr. Ambrose advised that it is going to the Planning commission on June 20th. Business Develooment Task Force (470-50) Cm. Houston asked when the Business Task Force will be making their recommendations to the Council. Mr. Ambrose advised that a draft report had been prepared and it depends on how much the Task Force modifies the report. They will be reviewing the report at their next meeting. It will come to the Council at either their next meeting or in July. * * * * Pleasanton Parade (610-85) Cm. Burton directed everyone's attention to the sign "NO DIRT IN DUBLIN" which was displayed that will be one of two signs on the truck that carries the council in Pleasanton's 100th anniversary celebration parade on saturday, June 18th. Burton advised that Roger Woodward had expressed concern with groups of people washing cars that the NPDES is not catChing on yet. Education is the answer. Cm. Burton suggested that we send out notices stating water from washing cars should not go down the storm drains. Mayor Snyder stated he wasn't sure that car washing is a violation of the NPDES permit. As long as you are using biodegradable products, this should not be harmful. Mr. Ambrose advised that Staff will look into this. * * * * Traffic on Altamont Pass (1060-10) Mayor Snyder advised that MTC recently held an all day seminar here at the civic Center relative to the 580/680 corridor situation. There was a major discussion on how to deal with the Altamont Pass. Affordable Housinq (430-80) Mayor Snyder advised that he had spent the day on a field trip looking at affordable housing in Sui sun and also Laguna West in Sacramento County. He saw some very interesting concepts, plus some blatant failures. Laguna West is an obvious disaster. The trip was beneficial and he encouraged anyone who-has an opportunity to go and see these developments. The Council questioned the price range. Mayor Snyder stated the lowest was $110,000 and the highest was $180,000.
