1) Conduct Interviews and take appropriate action as follows:
a) If an applicant receives a majority vote, determine whether the new
Councilmember is to be sworn in immediately or at the January 9,
1995 meeting.
b) If no applicant receives a majority vote, direct Staff to prepare
necessary documentation to call special election on June 6, 1995.
c) If direction is given to call a special election, the Council should
determine if an interim appointment should be made until the
election. An urgency Ordinance would have to be introduced and
adopted by the Council on January 9, 1995.
2) If interviews are not completed on December 27, continue this item to
December 28, 1994.
RECOMMENDATION:
FINANCIAL STATEMENT:
None at this time.
DESCRIPTION: On November 28, 1994, the City Council directed Staff to place
ads in local newspapers inviting interested residents of Dublin to apply for the opening on the
City Council created as a result of Guy Houston being elected Mayor midway through his 4-year
Council term of office.
As a result of the ads, a total of 22 individuals requested applications and 14 applications were
returned to the City Clerk by the December 22nd deadline. All of the applicants were
individually notified that the Council would be conducting interviews beginning at 6:30 p.m., on
Tuesday, December 27th and that the meeting would be continued to December 28th if
necessary .
The City Attorney's Memorandum clarifies the procedure for appointment of a Councilmember
to fill the vacancy. '

At the City Council meeting on December 12, 1994, the consensus of the Council was to conduct
interviews on a random selection basis. Therefore, the names will be drawn from an envelope by
the City Clerk.
If an applicant receives a majority vote of the Council, the Council should detennine when the
new Councilmember should be sworn in and seated
If no applicant receives a majority vote, Staff should be directed to proceed with the preparation
of the necessary documents to call a special election on June 6, 1995. The 30-day period that the
Council has to make an appointment will expire on January II, 1995, so this documentation
could be presented to the Council at its regular meeting on January 9, 1995. Staff estimates that
special election costs would be approximately $10,000. If any other local agency within Dublin
places issues on the June ballot, costs would be shared and this amount would be reduced
somewhat.

An additional option would be for the Council to fill the vacancy on a temporary basis only until
a newly elected Councilmember is sworn in and seated on the Council. A Councilmember
elected on June 6, 1995 would likely be seated at the first meeting in July, 1995. A temporary
appointment could be accomplished through the adoption of an urgency Ordinance which could
be prepared and brought to the Council at its next meeting for introduction and adoption.
Staff recommends that the City Council proceed with the interviews and provide appropriate
direction to Staff.

Procedure for Appointment of Councilmember to Fill Vacancy
A vacancy exists on the Council due to the election of
Councilmember Houston as Mayor. One option available to the
Council is to appoint a person to fill the vacancy. The purpose
of this memorandum is to address the procedure for selection of a
person to fill the vacancy if the Council determines to appoint a
person to fill the vacancy rather than the other options
available to the Council.
The Brown Act prohibits any action by secret ballot
(Government Code ~ 54953, subd. (c)). The City's Rules of
Conduct for Council meetings (Resolution No. 28-94) provide that
meetings shall be conducted pursuant to Robert's Rules of Order.
Generally, the following procedure for selection of a person to
fill the vacancy appears to be consistent with provisions of
Robert's Rules of Order and the Brown Act. However, because
Robert's Rules of Order are not completely clear, the Council
may, if it wishes, agree in advance to. a different method of
selecting a person to fill the vacancy.
Council members would make nominations. Nominations would
not need to be seconded. More than one person could be
nominated. Nominations would continue for a reasonable period of
time until a motion to close nominations is made. Once

nominations are closed, the names would be voted upon in the
order nominated until one person receives sufficient votes to be
selected.
Assuming that all four Council members are present and vote,
three affirmative votes will be required to appoint a person to
the vacancy. If two vote in favor of an individual and two vote
against the individual, that person has not received sufficient
votes to be selected. However, if two vote in favor of a
particular individual, one votes against and one abstains (for
reasons unrelated to a conflict of interest), the individual
would have received sufficient votes to be selected. (Drv Creek
Valley Assn., Inc., v. Board of Supervisors (1977) 67 Cal.App.3d
839, 135 Cal.Rptr. 726.) Similarly, if two vote in favor of a
particular individual and two Council members abstain, the
individual would have received sufficient votes to be selected.
(Martin v. Ballenqer (1938) 25 Cal.App.2d 435, 77 P.2d 888i 62
Ops,Atty.Gen. 698 (1979).) The reason for the foregoing is that
the basic parliamentary rule is that where a quorum is present,
the direct approval of more than half of those members actually
votinq for or against the measure becomes the act or choice of
the body. (62 Ops.Atty.Gen. 698, 700.) Only those votes that are
for or against the measure are counted. "Those members who wish
to remain neutral thus acquiesce in the action taken by the
majority of those who vote affirmatively or negatively." (Id.)

I desire to fill the vacant seat on the Dublin City Council so that the planned growth and
long term goals of the City can be accomplished. I want to see that the City of Dublin
continues to be made attractive to both the residents and the business community of
Dublin, I want to keep the city a safe place for all of us to live and work.
I believe I have the qualities and qualifications to sit on the council. I have listed those
below:
I have been in business as a State Farm Insurance agent for the past 26 years, most of
those years, my office has been in Dublin. I understand what it means to meet a payroll,
hire, evaluate, fire, pay rent, mortgages, payroll taxes as well as conduct the operations of
a personal insurance business to the people I serve. If I were ranked among the 18,000
State Farm Agents, I would be in the top 10%.
One of my strongest attributes is the ability to listen to others before I talk. I have an
open mind and like to hear all side of an issue. I get along with people and look for areas
of common ground to solve problems. I am an organizer, communicator and a people
person.
I moved to the valley in 1968 and have observed the growth, the improvements and the
problems that have occurred since. I have children that grew up in Dublin, went through
the school system and now are adults with children. I know how important the safety
services, education, recreation, shopping and business services are to the citizen.
I not only am buying my home in Dublin, I am also buying my commercial office building
and I also own a rental home as well. I have a lot invested in this city and understand the
importance of keeping our city safe and attractive.
I served on the Board of Directors of the Silvergate HigWands Homeowners Association
where I was elected President of the 258 homeowners. I handled the problems and
complaints that are generated in this type of position.
I am a Past president of the Dublin Chamber of Commerce. While a member of the Board
of Directors, I also acted as treasurer and understand the importance of fiscal
responsibility. - .
I have been elected four times as President of the Dublin Sister City Association and was
the leader in the formation of the association. I understand the importance of promoting
our city within the valley, within the country and internationally. I am presently working
on a project to promote our city within the U.S.A. with the added hope of involving more
citizens of Dublin in the D.S.C.A.
I am not presently involved in a service club but I was a charter member of the Livermore
Amador Valley Exchange Club. I was elected president and formed and chaired the youth
Search for Talent for 6 years. I resigned in good standing after 18 years of membership
due to other commitments. I believe I still hold the recruiting record of over 25 members
brought into the club. This demonstrates my ability to communicate to the individual.
I am an ordained elder in the Presbyterian Church. I currently sing in the choir and have
done so for approximately 15 years. This activity is very important to me. I feel we don't
have total control of what happens and that we are dependent on a source other than
ourselves.
My most recent service to the city of Dublin was chairing the Dublin Business
Development Task Force January through July of94. I reported our findings and
recommendations to the City Council on July II, 94 along with other members of the task
force. I received a letter of thanks from Guy Houston for my participation and efforts.
Dublin is very important to both my wife Sue and myself. We care what happens here
and have decided that we would be willing to have me take the time necessary to serve on
the Dublin City council for the remainder of the two year term if that is the decision of the
of the council members.

Statement of Purpose
I seek appointment to the Dublin City Council solely to serve the people of this fine community.
I am highly qualified to hold this position of trust and to continue to serve with the utmost
integrity. I feel it is a critical time in Dublin's history and that our city should continue to move
forward without interruption. Together, we have developed a promising general plan that should
bring a high quality of life for all. I wish to help implement what I feel is a good plan for our
city's future.
I am an eighteen year resident of Dublin and have served all of those years in community service.
I have served twelve years as an elected official, the last four as a member of this council. I have
worked with all of you and, as you know, I am not a single issue person. I look at all sides of an
issue before voting. I have supported, and voted for, issues that you have supported. I have strong
community support, receiving within 10% of the top vote in a council race that was very nearly a
four-way tie.
My objectives include fostering a healthy local economy though thriving community businesses
producing high sales-tax revenues. I intend to work vigorously with our new Economic
Development Manager. I hope to increase citizen participation in the future development of our
city. Through citizen participation we achieve not only citizen approval of our city's development,
but citizen "buy-in" and pride of our city's growth.
I will continue to support a fiscally sound city government. We should continue our partnership
with the school district to promote education for our children and to obtain optimal use of our
citizen supported facilities. Within the scope of fiscal responsibility, I plan work for a teen center
and programs for our young people. I will continue to support public safety as a top priority.
With the new BART station coming to town, we may face additional challenges in graffiti control
and crime. I believe these challenges should be met head-on, stopping any such problems before
they grow. I intend to keep Dublin a safe place to live, shop and work.

Dear Sirs and Madam:
Attached you will find my application and resume for appointment to
fill the existing city Council position.
The city of Dublin is in transition, and what occurs within the
city the next few years will have a far-reaching affect on its
citizens. A B.A.R.T. station will soon be located within the
downtown district of Dublin, and the eastern extension promises to
provide jobs and other benefits, but there exists opposition to
Dublin's growth and expansion. If Dublin is to compete with its
neighbors, the City of Dublin must continue to grow. An effective
voice within the region is essential for that continued growth.
For the most part, that voice comes from the city Council.
I have lived in Dublin since 1984, at the same residence since
1985. It is my sincere desire to be a part of this process.
I believe I am the best candidate for the position for the
following reasons:
1. Dublin is no longer the sleepy, bedroom community it once was,
and I believe my experience in law enforcement would enable me
to objectively examine the law enforcement problems Dublin
will encounter in the future, as well as the potential
solutions.
2. The City of Dublin is not without conflict, both from within
and without its boundaries. I have spent over twenty (20)
years of my life resolving disputes, as a pOlice officer,
attorney, judge, mediator and arbitrator.
3. since I have drafted, negotiated, interpreted and reviewed
hundreds of contracts, my experience in this area would be
useful when the Council is required to decide upon contracts
involving the City.

4. since I have eleven (11) years of successful litigation
experience, my ability to evaluate the merit of claims brought
against the city would be useful.
5. Since I have been involved in the legislative process at the
state and local level, I understand the relationship between
municipal, county and state government, and how each works

6. As president of the Dublin Chamber of commerce, I worked with
the public at large, business people and city officials. I
was a member of the Mayor I s Business License cOIomi ttee, ,and
helped draft the ordinance now in effect. I have the ability
to work with the public, business people, and city officials

with the continued growth of the Tri-Valley Area and the entry of BART
into this area, I have been watching carefully the decisions of the
various City Council in this area and how they are or will be dealing
with the influx of residents and businesses into this community. My
law practice has only recently allowed me the time and opportunity to
participate in the community development and I desire to be involved in
the decision making processes at this time. I have lived in this area
for approximately 16 years and my adult son was raised in this community
and went through the Dublin School System. In the past I have represented
individuals and business before Zoning and before City Council on various
land and property issues that has given me great insight into the
functions of City Council in various communities.
I also am associated
in my real estate practice/land development practice with a retired
Zoning Administrator that I have gained tremendous knowledge from in the
areas of community development. I believe Dublin is faced with development
projects that have to be viewed with an.eye toward managed growth that

Dear Council Members,
I have chosen to submit an application for the vacant City Council because I bring
a different perspective to the City Council, a perspective shared by many concerned
Dublin residents.
I am a thirty four year resident of Southern Alameda County. I was raised,
educated, and have spent my entire adult life in this area. I have lived in Dublin for
just over ten years and have been actively involved in local and regional planning
issues. I own a home in Dublin and I am the part owner of a small busuness in
P1easanton.
In the recent Dublin San Ramon Services District election, I received the second
highest number of votes from Dublin residents. The issues I raised during the
campaign are very similar to many of the important issues the council will face in the
next two years. My involvement in regional issues has given me good working
relationships with members of other local governments based on mutual respect. Those
issues of concern to me include encouraging long term economic development and
insuring that new growth provides a net gain to City finances and quality of life. It is
my belief that we should set policy for the new Economic Development Director to place
an emphasis on attracting employers of skilled workers equal to the emphasis on
attracting sales tax generators.
I recently completed a certificate program in Land Use and Environmental
Planning at UC Davis which contained a strong public finance component. Combined
with my ten years experience in local issues, this training provides me with the ability
to accurately assess economic and financial impacts of new development. I am committed
to finding ways to provide housing priced for young families in all new development. I
also believe that to provide the best quality of life for its citizens a City has to provide
outlets for energies of its young' adults and teens in ways that encourage their positive
participation.
My background in CEQA compliance and conflict resolution will provide the City
Council with a new viewpoint which seeks to find innovative solutions and avoid legal
complications and challenges. I believe that wen planned mitigation can serve multiple
uses and be a cost effective method of providing public improvements. I am willing to
take extra time above and beyond required meetings to assist differing factions in
finding compromises which anow everyone to have a stake in a successful outcome. I
will actively seek the involvement of Dublin residents who haven't taken part in public
affai rs .
I will give the City Council greater depth in considering planning and public
finance issues. I can provide the City Council with fresh viewpoints which will
invigorate decision-making The concerns I raise will give a voice to many who have felt

Thank you for the opportunity to apply for the vacant Dublin City Council position. My
name is Tony Oravetz. I first moved to Dublin, with my Father, Mother and 7 siblings, in
1971. I am a 1973 graduate of Dublin High School. After getting mamed in 1976 my
wife Terri and I purchased our first home in Livennore. After our son Greg was born in
1983 we decided to move to a more "family" setting and needed to look no farther than
Dublin. Terri is also a graduate of Dublin High School. We purchased our home on
Squirrel Creek Circle, a new sub-division in Dublin in 1988. We have lived their since
and have become involved in many of the local school and youth sports interest.
Their are a variety of reasons that I am interested in the vacant council position. The first
is my feelings regarding civic pride. I enjoy living in Dublin and I would like others to
have that same pride in their city. I am willing to spend the extra time and effort to make
Dublin a community that all of us can be proud of. I also believe that every citizen, in
some part, should do volunteer work in their community. By giving of my time I have
had many rewards such as making many new friends and helping improve organizations
in Dublin. My resume refers to the different volunteer work that I have completed in the
past years. Serving on the City Council for the next two years would be "my"
outstanding contribution to the City of Dublin.
I feel I can bring some unique talents to the city council. My assignment at the Lawrence
Livermore National Laboratory has led me to supervising 3 technical groups since 1982.
I have been involved in managing budgets, up to 500K, every year since. I was promoted
to the position of Senior Supervisor in 1993. I have enjoyed an excellent career at the
Lab (20 years) and believe I can use my technical and management skills to work with
the existing council members. I have always prided myself on my ability to pull a team
of people together to solve complex technical and managerial concerns. I have built a
solid reputation at the Lab by getting along with co-workers and solving problems. This
attribute will make me a positive addition to the council.
I believe my 20 years at the Laboratory, my volunteer work in youth sports (which

I would like to express my interest in the vacant City Council seat. As a responsible citizen, I
would like to volunteer my time and abilities to try to maintain and improve the quality of our
city, and make the city government a responsive, dynamic body. I believe that I would bring an
educated, unbiased, and effective approach to helping run our city.
I bring several qualities that would be beneficial to the Council and the City of Dublin. Among
my strongest attributes are my ability to work in a team environment, my willingness to take on
responsibility, my technical background, my communication skills, and my personal integrity.
These traits have served me well in my employment and are vital for a municipal official to have.
On the technical side, I am a registered professional engineer (civil) and have worked extensively
in the earthquake engineering area. This is an area that affects our community in many ways and

Thank_you for the opportunity to apply to serve the City of Dublin.
I grew up in Richmond and Eureka-CA. I recently moved to Dublin from
Richmond. I bring fresh ideas and experience in creating and implementing
policy to the city. As a Human Resources professional, I develop and
implement policy on a daily basis. ~am an experienced policy maker who
listens to all sides of a debate and makes a decision.
I do not know all of the specific challenges that Dublin faces because I am
new to the community. I have been successful at implementing policy in the
ORGANIZATIONS I have worked. Specifically, I always solicit comments and
hold focus groups. This process yields the relevant arguments, experiences,
practices and history that shapes our expectations. I have demonstrated
that the way to implement change is~o change ones expectation through
increased communications.
I am the youngest member elected to the Northern California Human Resources
Council Board of Directors. My peers, most of whom have more experience than
me, elected me to represent them in mov~ng the organization forward while
staying within a very tight budget.

My years of living in Dublin has for the most part been 28 years of
activity in the community. Ranging from manager or coach in Dublin
Youth Soccer, Dublin Little League, Dublin Youth Basketball, CYO
Basketball to treasurer of the Dublin Boosters Club and Auditor for
the Nielsen PTA. My service to the City of Dublin began 12 years
ago as Chairman of the Parks and Recreation Advisory Committee
where we recommended that a permanent Parks and Recreation
Commission be established. After some lively debate our suggestion
was adopted. From 1983 through 1987 I served as Chairman and
member of the Dublin Parks and Recreation Commission. During that
period we redesigned all the parks in Dublin and began as
aggressive program to rebuild Dublin's parks and establish a
recreation program. For the last seven years I have been serving
as a member or chairman of the Dublin Planning Commission where we
held extensive hearings on both West and East Dublin expansions. We
recommended City Council approve both plans. The East Dublin plan
will help Dublin grow into a more competitive position in the
valley and significantly increase our tax base. This is planned to
be completed over a period of several years at no cost to the
current residents of Dublin
