On October 10, 1994, the City Council adopted resolutions relating to: the
annexation/detachment application for Eastern Dublin; Planned Development (PD) District prezoning;
the exchange of property tax revenues; the cooperative annexation efforts between the City ofOublin
and DSRSD; and the annexation agreement with the Lin Family. DSRSD adopted the concurrent
resolution between the City and DSRSD, and the Lin Family signed the annexation agreement that
requires them to cover any fiscal shortfalls that may occur with the annexation. On October 24, 1994,
the City Council adopted an ordinance approving and establishing findings and general provisions for
the PD District prezoning for Eastern Dublin.
Under the City Council's direction, Staff submitted the Eastern Dublin annexation/detachment
request to the Alameda County Local Agency Formation Commission (LAFCo) for consideration. On
November 10, 1994, LAFCo held a public hearing, heard and received all oral and written protests and
objections, which were presented or filed, and then approved the Eastern Dublin Reorganization
(annexation and detachment) request through LAFCo Resolution No. 94-21 (see Attachment 1).
On December 9, 1994, David Nesmith, Conservation Director with the Sierra Club, filed a
formal reconsideration request of the Eastern Dublin Reorganization project with LAFCo. On January
12, 1995, LAFCo disapproved the reconsideration request and directed the Executive Officer to notify
the City, as the conducting authority, of the Commission's action to disapprove the request for
reconsideration.
Summarizing the LAFCo Resolution No. 94-21, LAFCo determined that this reorganization
would provide a lDgical and most efficient provision of essential municipal services to the area by the
City of Dublin and DSRSD. The reorganization is also consistent with the orderly, planned and efficient
urban development of the area. Both the City of Dublin and the County of Alameda have reached an
agreement on an exchange of property tax revenues and have adopted resolutions accordingly. LAFCo
found the reorganization proposal consistent with the adopted Eastern Dublin General Plan Amendment
and Specific Plan, Alameda County's adopted East County Area Plan, and DSRSD's adopted policies for
the extension of utility services as set forth in DSRSD's Resolution No. 38-92. LAFCo found the City's
Plan for Services, including DSRSD's Plan for Services for potable and recycled water, wastewater
collection, treatment and disposal services, to be adequate and feasible for the project area. LAFCo also
determined that the provision of city park and recreational services can reasonably and more
appropriately be provided by the City rather than the LARPD. Lastly, LAFCo found the project to be
within the scope of the Final Environmental Impact Report and Addenda for the Eastern Dublin General
Plan Amendment and Specific Plan.
In approving the reorganization request, LAFCo designated the City of Dublin as the Conducting
Authority and authorized the City to proceed with the publication of all legal notices and public hearings
as required by state statute. LAFCo approved and authorized the reorganization subject to the terms and
conditions specified in the draft resolutions, Exhibits A and B. The terms and conditions include the
following: 1) correction of the Final Maps and Description as may be required by the County Surveyor;
2) execution of an agreement by Jennifer Lin (a project proponent) for payment of service costs
satisfactory to the City; 3) incorporation into LAFCo's action by reference, all terms and conditions
specified in DSRSD's Resolution No. 42-94 regarding the project; and 4) execution by Jennifer Lin of an
Area-wide Facility agreement satisfactory to DSRSD. Jennifer Lin has executed an Area-wide Facility
Agreement with DSRSD. The effective date of this reorganization is October 1, 1995, or 9 months after
the date of the election in which a majority vote in favor of the reorganization, whichever is earlier.
At this meeting, the Council shall hear and receive any oral or written protests, objections or
evidence which is made, presented or filed. Property owners and registered voters may file written
protests prior to the conclusion of the public hearing. At the time this agenda report was prepared, no
protests had been filed. Upon conclusion of this hearing, the Council must determine the value of
written protests and then either: 1) terminate the proceedings if a majority protest exists (i.e. 50 percent
or more of the voters residing in the project area protest); 2) order the change of the reorganization
subject to the confIrmation by the registered voters (i.e. calling an election) if at least 25 percent, but less
than 50 percent of the registered voters residing in the affected territory protest, or at least 25 percent of
the number of land owners who also own at least 25 percent of the assessed value of land within the
affected territory protest; or 3) order the reorganIzation without an election ifno protests exist, or if less
than 25 percent of the registered voters or less than 25 percent of the number of land owners owning less
than 25 percent of the assessed value of land, protest.
There are 20 registered voters residing in the proposed reorganization area (see Attachment 2).
The list of land owners within the affected territory and the assessed values of their land is indicated on
Attachment 3. From this information, the Council can determine the value of written protests, if
necessary. Staff prepared two resolutions, one ordering the reorganization finding no written protests,
and one finding that the written protests received do not qualify for an election. If protests are received
and an election must be called, Staff recommends continuing this public hearing item so that Staff can
prepare the resolution calling the election.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ORDERING TERRITORY DESIGNATED AS
"P A 94-030 EASTERN DUBLIN REORGANIZATION (ANNEXATIONIDETACHMENT NO.
10)" ANNEXED TO THE CITY OF DUBLIN AND THE DUBLIN SAN RAMON SERVICES
DISTRICT AND DETACHED FROM THE LIVERMORE AREA RECREATION AND PARK
DISTRICT
WHEREAS, the Local Agency Formation Commission of the County of Alameda adopted its
Resolution No. 94-21 on November 10, 1994, making determinations and approving the proposed
reorganization, consisting of 1) the annexation of 1,538:t acres to the City of Dublin; 2) the annexation
of 1,542:t acres to the Dublin San Ramon Services District; and 3) the detachment of 1,029:t acres from
the Livermore Area Recreation and Park District; and
WHEREAS, the terms and conditions of annexation as approved by the Local Agency
Formation Commission are as follows:
1) The correction of the Final Maps and Description as may be required by the County
Surveyor;
2) The effective date of this reorganization shall be October 1, 1995 or nine months after the
date of the election in which a majority vote in favor of the reorganization, whichever is
earlier;
3) An agreement for payment of service costs satisfactory to the City of Dublin shall be
executed by Jennifer Lin, one of the project proponents;
4) An Area-Wide Facility Agreement satisfactory to the Dublin San Ramon Services
District shall be executed by Jennifer Lin, one of the project proponents; and
5) All terms and conditions specified in Resolution No. 42-94 adopted by the Dublin San
Ramon Services District regarding this proposal are hereby incorporated into this action
by reference:
a. Each owner shall be required to execute an Area-wide Facilities Agreement in a
form acceptable to the District prior to applying for or receiving any District
services, whichever come fust.
b. Each owner, upon execution of the Area-wide Facility Agreement shall be liable
for payment of all costs of annexation including, but not limited to, the processing
fee established by the District to defray the District's costs incurred in processing
the application for annexation including preparation of all documents, maps,
surveys, recordations, and any and all other documents deemed by the District
necessary for this annexation, costs of publication and mailing of notices,
preparation of Facility Agreements and Resolutions and all other costs, fees and
expenses related to the annexation proceedings.
c. Each owner shall comply with the District's requirements set forth in the Major
Infrastructure Policy adopted by the District Board as Resolution No. 29-94 as
that Policy may from time to time be superseded or modified.

d. Each owner shall be liable to fund the preparation of all engineering studies,
phasing studies, plans and similar undertakings required as or by mitigation
measures of the Final Environmental Impact Report and its Addenda for the
Eastern Dublin Specific Plan as adopted by the City of Dublin. The necessary
engineering studies, phasing studies, plans and similar undertakings shall be
prepared in conformance with the Major Infrastructure Policy.
e. Any and all utility facilities for District's services for the development of the
annexing territory shall be installed at the cost and expense of each owner in
accordance with the Major Infrastructure Policy and further subject to District's
codes, rules, standards and specifications pertaining thereto.
f. Each owner, upon annexation, shall be subject to liability, if any, for payment of
all or any part of principal, interest and other amounts which shall become due on
account of any part of any outstanding bonds or other evidences of indebtedness
or obligations of the District, which may become due, or which are authorized and
thereafter may become due within the District.
g. Each owner shall pay all charges, fees, costs and other expenses pertaining to the
installation, construction, connection to, and use of District's utility facilities in
accordance with the Major Infrastructure Policy, the District's Code, Rules, and
Regulations, as the same now exist or may from time to time be amended, with
respect to development and improvement of the annexing territory.
h. Each owner shall be liable for and shall pay any annexation fee established for the
acquisition, transfer, use or right of use of all or any part of the existing real or
personal property of the District which may exist at the time of or subsequent to
the time of annexation, which fee may be enacted within 24 months subsequent to
the date of adoption of the LAFCo resolution. If an annexation fee program is
adopted by the District within 24 months subsequent to the date of adoption of the
LAFCo resolution, the fee shall be payable no later than upon approval by the
District of an application for the connection to any District services or facilities;
the amount of the fee shall be that fee in effect as of the date of payment. In the
event that an application is approved prior to the adoption of the annexation fee
program, the applicant shall pay the annexation fee upon adoption of the
annexation fee program and in the amount of the annexation fee in effect upon
adoption of the annexation fee.
1. Services to be provided by the District shall include such potable and recycled
water, wastewater collection, treatment and disposal services, if any, as the
District may, in its discretion, extend to the annexing territory pursuant to its
authority ,
J. The parcel known as Assessor's Parcel No. 946-500-2-2, currently owned by
Adams, Walker and Koller, shall be excluded from the potable water service area
of the District, unless and until the Board of Directors by its action determines to
include said parcel within the potable water service area of the District; and
WHEREAS, the reason for this annexation is to provide for consistent and orderly development
to insure that essential municipal services are provided; and
WHEREAS, this resolution is adopted pursuant to the Cortese Knox Act, Government Code
Section 56000 et.seq.; and
WHEREAS, the regular County assessment roll is utilized by the City; and

WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness of
the City; and
WHEREAS, the Local Agency Formation Commission has designated the City of Dublin as the
Conducting Authority and has authorized the City Council to proceed with the publication of all legal
notices and public hearings as required by statute; and
WHEREAS, on December 9, 1994, a reconsideration request of the Eastern Dublin
Reorganization was filed with LAFCo; and
WHEREAS, on December 12, 1994, the Dublin City Council continued the public hearing for
PA 94-030 Eastern Dublin Reorganization to the January 23, 1995 meeting; and
WHEREAS, on January 12, 1995, LAFCo disapproved a reconsideration request and directed
the Executive Officer to notify the City of Dublin, as the conducting authority, of the Commission's
action to disapprove the request for reconsideration; and
WHEREAS, all legal notices have been given as required by statute; and
WHEREAS, no written protests were received.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby
orders the territory described in Attachment A-I annexed to the City of Dublin, the territory described in
Attachment A-2 annexed to the Dublin San Ramon Services District, and the territory described in
Attachment A-3 detached from the Livermore Area Recreation and Park District, and directs the City
Clerk to transmit a certified copy of this resolution with applicable fees required by Section 54902.5 of
the Government Code to the Executive Officer of the Local Agency Formation Commission of Alameda
County, pursuant to the provisions of Division 3 Cortese-Knox Local Government Reorganization Act
of 1985 Government Code 56000 et seq.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ORDERING TERRITORY DESIGNATED AS
"P A 94-030 EASTERN DUBLIN REORGANIZATION (ANNEXATION/DET ACHMENT NO.
10)" ANNEXED TO THE CITY OF DUBLIN AND THE DUBLIN SAN RAMON SERVICES
DISTRICT AND DETACHED FROM THE LIVERMORE AREA RECREATION AND PARK
DISTRICT
WHEREAS, the Local Agency Formation Commission of the County of Alameda adopted its
Resolution No. 94-21 on November 10, 1994, making determinations and approving the proposed
reorganization, cQnsisting of 1) the annexation of 1 ,538:t acres to the City of Dublin; 2) the annexation
of 1,542:t acres to the Dublin San Ramon Services District; and 3) the detachment of 1,029:t acres from
the Livermore Area Recreation and Park District; and
WHEREAS, the terms and conditions of annexation as approved by the Local Agency
Formation Commission are as follows:
1) The correction of the Final Maps and Description as may be required by the County
Surveyor;
2) The effective date of this reorganization shall be October 1, 1995 or nine months after the
date of the election in which a majority vote in favor of the reorganization, whichever is
earlier;
3) An agreement for payment of service costs satisfactory to the City of Dublin shall be
executed by Jennifer Lin, one of the project proponents;
4) An Area-Wide Facility Agreement satisfactory to the Dublin San Ramon Services
District shall be executed by Jennifer Lin, one of the project proponents; and
5) All terms and conditions specified in Resolution No. 42-94 adopted by the Dublin San
Ramon Services District regarding this proposal are hereby incorporated into this action
by reference:
a. Each owner shall be required to execute an Area-wide Facilities Agreement in a
form acceptable to the District prior to applying for or receiving any District
services, whichever come first.
b. Each owner, upon execution of the Area-wide Facility Agreement shall be liable
for payment of all costs of annexation including, but not limited to, the processing
fee established by the District to defray the District's costs incurred in processing
the application for annexation including preparation of all documents, maps,
surveys, recordations, and any and all other documents deemed by the District
necessary for this annexation, costs of publication and mailing of notices,
preparation of Facility Agreements and Resolutions and all other costs, fees and
expenses related to the annexation proceedings.
c. Each owner shall comply with the District's requirements set forth in the Major
Infrastructure Policy adopted by the District Board as Resolution No. 29-94 as
that Policy may from time to time be superseded or modified.

d. Each owner shall be liable to fund the preparation of all engineering studies,
phasing studies, plans and similar undertakings required as or by mitigation
measures of the Final Environmental Impact Report and its Addenda for the
Eastern Dublin Specific Plan as adopted by the City of Dublin. The necessary
engineering studies, phasing studies, plans and similar undertakings shall be
prepared in conformance with the Major Infrastructure Policy.
e. Any and all utility facilities for District's services for the development of the
annexing territory shall be installed at the cost and expense of each owner in
accordance with the Major Infrastructure Policy and further subject to District's
codes, rules, standards and specifications pertaining thereto.
f. Each owner, upon annexation, shall be subject to liability, if any, for payment of
all or any part of principal, interest and other amounts which shall become due on
account of any part of any outstanding bonds or other evidences of indebtedness
or obligations of the District, which may become due, or which are authorized and
thereafter may become due within the District.
g. Each owner shall pay all charges, fees, costs and other expenses pertaining to the
installation, construction, connection to, and use of District's utility facilities in
accordance with the Major Infrastructure Policy, the District's Code, Rules, and
Regulations, as the same now exist or may from time to time be amended, with
respect to development and improvement of the annexing territory.
h. Each owner shall be liable for and shall pay any annexation fee established for the
acquisition, transfer, use or right of use of all or any part of the existing real or
personal property of the District which may exist at the time of or subsequent to
the time of annexation, which fee may be enacted within 24 months subsequent to
the date of adoption of the LAFCo resolution. If an annexation fee program is
adopted by the District within 24 months subsequent to the date of adoption of the
LAFCo resolution, the fee shall be payable no later than upon approval by the
District of an application for the connection to any District services or facilities;
the amount of the fee shall be that fee in effect as of the date of payment. In the
event that an application is approved prior to the adoption of the annexation fee
program, the applicant shall pay the annexation fee upon adoption of the
annexation fee program and in the amount of the annexation fee in effect upon
adoption of the annexation fee.
1. Services to be provided by the District shall include such potable and recycled
water, wastewater collection, treatment and disposal services, if any, as the
District may, in its discretion, extend to the annexing territory pursuant to its
authority,
J. The parcel known as Assessor's Parcel No. 946-500-2-2, currently owned by
Adams, Walker and Koller, shall be excluded from the potable water service area
of the District, unless and until the Board of Directors by its action determines to
include said parcel within the potable water service area of the District; and
WHEREAS, the reason for this annexation is to provide for consistent and orderly development
to insure that essential municipal services are provided; and
WHEREAS, this resolution is adopted pursuant to the Cortese Knox Act, Government Code
Section 56000 et.seq.; and
WHEREAS, the regular County assessment roll is utilized by the City; and

WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness of
the City; and
WHEREAS, the Local Agency Formation Commission has designated the City of Dublin as the
Conducting Authority and has authorized the City Council to proceed with the publication of all legal
notices and public hearings as required by statute; and
WHEREAS, on December 9, 1994, a reconsideration request of the Eastern Dublin
Reorganization was filed with LAFCo; and
WHEREAS, on December 12, 1994, the Dublin City Council continued the public hearing for
PA 94-030 Eastern Dublin Reorganization to the January 23, 1995 meeting; and
WHEREAS, on January 12, 1995, LAFCo disapproved a reconsideration request and directed
the Executive Officer to notify the City of Dublin, as the conducting authority, of the Commission's
action to disapprove the request for reconsideration; and
WHEREAS, all legal notices have been given as required by statute; and
WHEREAS, the City Council conducted a public hearing on January 23, 1995, and at the
conclusion of the hearing determined that written protests were filed and not withdrawn by less than 25
percent of the registered voters and less than 25 percent of the number of owners of land owning less
than 25 percent of the assessed value ofland within the affected territory.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby
orders the territory described in Attachment A-I annexed to the City of Dublin, the territory described in
Attachment A-2 annexed to the Dublin San Ramon Services District, and the territory described in
Attachment A-3 detached from the Livermore Area Recreation and Park District, and directs the City
Clerk to transmit a certified copy of this resolution with applicable fees required by Section 54902.5 of
the Government Code to the Executive Officer of the Local Agency Formation Commission of Alameda
County, pursuant to the provisions of Division 3 Cortese-Knox Local Government Reorganization Act
of 1985 Government Code 56000 et seq.

CITY OF DUBLIN
"PA 94-030 EASTERN DUBLIN REORGANIZATION"
WHEREAS, a resolution application No. 105-94 dated October 10, 1994 from the
City of Dublin was heretofore filed with the Executive Officer of the Alameda County
Local Agency Formation Commission by the City Council of the City of Dublin;
WHEREAS, said lesolution application shall be referred to as PA 94-030
EASTERN DUBLIN REORGANIZATION;
WHEREAS, said reorganization shall include the following components:
1) the annexation of 1,538+ acres to the City of Dublin;
2) the annexation of 1,542.:t. acres to the Dublin San Ramon Services District; and
3) the detachment of 1,029+ acres from the Livermore Area Recreation and Parks District;
WHEREAS, said Executive Officer has reviewed the application and prepared a
report, including his recommendations thereon, noting that the City of Dublin, as lead
agency, considered and certified a Final Environmental Impact Report and Addendum
in May, 1993 and that said application and environmental documentation has been
reviewed and found to be adequate for consideration by the Commission;
WHEREAS, in the form and manner prescribed by law, the Executive Officer has
given notice of public hearing by this Commission upon, said application;
WHEREAS, the purpose of this reorganization is the provision of municipal
services to the area by the City of Dublin and the Dublin San Ramon Services District;
WHEREAS, the territory is within the Spheres of Influence of the City of Dublin
and the Dublin San Ramon Services District;
WHEREAS, the territory is inhabited;
WHERE, the City of Dublin and the County of Alameda have reach agreement
on an exchange of property tax revenues in accordance with Revenue and Taxation Code
Section 99;

WHEREAS, at a public hearing held on November 10, 1994, the Alameda County
Local Agency Formation Commission heard and received all oral and written protests,
objections and evidence which were made, presented or filed, and all persons present
were given an opportunity to appear and be heard with respect to any matter pertaining
to said application; and
WHEREAS, the Commission did make the following determinations:
1. That the proposed reorganization is consistent with the procedures and policies
approved by the Commission;
2. That the proposal is consistent with the spheres of influence boundary lines of the
City of Dublin and the Dublin San Ramon Services District
3. That the proposed reorganization will permit the logical and most efficient
provision of essential municipal type services to the territory by the City of
Dublin and the Dublin San Ramon Services District;
4. That all of the local age'ncies have given their written assurance as to their ability
to provide said municipal services;
5. That the subject territory is inhabited pursuant to the Cortese-Knox Act;
6. That, in accordance with the provisions of Revenue and Taxation Code Section
99, the City of Dublin by Resolution adopted May 10, 1993 and the County of
Alameda by Resolution adopted May 4, 1993 have reached agreement on an
exchange of property tax revenues;
7. That since the development purposes have not been' made known to the City of
Dublin, the annexation was reviewed on the basis of the adopted plans and
policies of the annexing city;
8. That the reorganization proposal is consistent with the adopted General Plan
Amendment and Specific Plan of the City of Dublin and with the East County
Area Plan adopted by the Board of Supervisors;
9. That the City of Dublin has prezoned the territory in conformity with
Commission policy;
10. That the factors as set forth in Government Code Section 56841 have been
considered by the Commission;

11. That the City- of Dublin Plan For Service contains all of the requisite information
as required by Government Code Section 56653 and has been considered and
found feasible by this Commission and is incorporated herein by this reference;
12. That the Dublin San Ramon Services District Plan For Services for potable and
recycled water, wastewater collection, treatment and disposal services has been
considered and found feasible by this Commission and is incorporated herein by
this reference;
13. That the proposed reorganization is consistent with the orderly, planned and
efficient urban development of the area;
14. That while this proposal can reasonably be expected to lead to the conversion of
existing open space pursuant to Government Code Section 56377, it's preservation
would not promote the planned, orderly, efficient development of the area;
15. That less than 100% of the property owners in the proposed territory have given
their consent to this annexation;
16. That the boundaries of the proposed territory are consistent and appropriate and
that no islands or corridors of unincorporated territory are created;
17. That the proposal is consistent with the adopted policies of the Dublin San Ramon
Services District for the extension of utility services as set forth in Resolution No.
38-92;
18. That the provision of municipal park and recreational services can reasonably and
more appropriately be provided by the City of Dublin rather than the Livermore
Area Recreation and Park District;
19. That the policies, findings and mitigation measures as set forth in the adopted
Eastern Dublin General Plan Amendment and Specific Plan are herein
incorporated by reference;
20. That an Environmental Impact Report and Addendum for the Eastern Dublin
Specific Plan and General Plan Amendment was prepared and certified by the
City of Dublin, as lead agency, and the annexation of areas within the Eastern
Dublin Specific Plan to the City and District are within the scope of the Final EIR;
and
21. That the City of Dublin has adopted findings pursuant to the California
Environmental Quality Act (Public Resources Code Section 21000 et seq.) and has
adopted two Addenda to the Final EIR, which have been reviewed and
considered by this Commission prior to action on this proposal.

NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED:
1. That the reorganization application of the City of Dublin, referenced as P A 94-030
Eastern Dublin Reorganization, which includes 1) the annexation of 1,538+
acres to the City of Dublin; 2) the annexation of 1,542+ acres to the Dublin San
Ramon Services District; and the detachment of 1,029+ acres from the
Livermore Area Recreation and Park District, is hereby approved and authorized
subj~ct to the following terms and conditions:
A. The correction of the Final Maps and Description as may be required by
the County Surveyor;
B. The effective date of this reorganization shall be October 1, 1995, or 9
months after the date of the election in which a majority vote in favor of
the reorganization, whichever is earlier;
C. An agreement for payment of service costs satisfactory to the City of
Dublin shall be executed by Jennifer Un, one of the project proponents;
D. An Area-wide Facility agreement satisfactory to the Dublin San Ramon
Services District shall be executed by Jennifer Lin, one of the project
proponents; and
E. All terms and conditions specified in Resolution No. 42-94 adopted by the
Dublin San Ramon Services District regarding this proposal are hereby
incorporated into this action by reference:
· Each owner shall be required to execute an Area-wide Facilities
Agreement in a form acceptable to the District prior to applying for
or receivin5! any District services, whichever come first.

. Each owner, upon execution of the ~de Facility Agreement
shall be liable for payment of all costs of annexation including, but
not limited to, the processing fee established by the District to
defray the District's costs incurred in processing the application for
annexation including preparation of all documents, maps, surveys,
recordations, and any and all other documents deemed by the
District necessary for this annexation, costs of publication and
mailing of notices, preparation of Facility Agreements and
Resolutions and all other costs, fees and expenses related to the
annexation proceedings.

· Each owner shall. comply with the District's requirements set f9rth
in the Major Infrastructure Policy adopted by the District Board as
Resolution No. 29-94 as that Policy may from time to time be
superseded or modified.
· Each owner shall be liable to fund the preparation of all engineering
studies, phasing studies, plans and similar undertakings required as
or by mitigation measures of the Final Environmental Impact Report
and its Addenda for the Eastern Dublin Specific Plan as adopted by
the City of Dublin. The necessary engineering studies, phasing
studies, plans and similar undertakings shall be prepared in
conformance with the Major Infrastructure Policy.
· Any and all utility facilities for District's services for the
development of the annexing territory shall be installed at the cost
and expense of each owner in accordance with the Major
Infrastructure Policy and further subject to District's Codes, Rules,
standards and specifications pertaining thereto.
· Each owner, upon annexation, shall be subject to liability, if any, for
payment of all or any part of principal, interest and other amounts
which shall become due on account of any part of any outstanding
bonds or other evidences of indebtedness or obligations of the
District, which may become due, or which are authorized and
thereafter may become due within the District.
· Each owner shall pay all charges, fees, costs and other expenses
pertaining to the installation, construction, connection to, and use of
District's utility facilities in accordance with the Major Infrastructure
Policy, the District's Code, Rules, and Regulations, as the same now
exist or may from nine to time be amended, with respect to
development and improvement of the annexing territory.
· Each owner shall be liable for and shall pay any annexation fee
established for the acquisition, transfer, use or right of use of all or
any part of the existing real or personal property of the District
which may exist at the time of or subsequent to the time of
annexation, which fee may be enacted within 24 months subsequent
to the date of adoption of this resolution. If an annexation fee
program is adopted by the District within 24 months subsequent to
the date of adoption of this resolution, the fee shall be payable no
later than upon approval by the District of an application for the

connection to any District services or facilities; the amount of the fee
shall be that fee in effect as of the date of payment. In the event
that an application is approved prior to the .adoption of the
annexation fee program, the applicant shall pay the annexation fee
upon adoption of the annexation fee program and in the amount of
the annexation fee in effect upon adoption of the annexation fee.

Services to be provided by the District shall include such potable
and recycled water, wastewater collection, treatment and disposal
services, if any, as the District may, in its discretion, extend to the
annexing territory pursuant to its authority.
.
The parcel known as Assessor's Parcel No. 946-500-2-2, currently
owned by Adams, Walker and Koller, shall be excluded from the
potable water service area of the District, unless and until the Board
of Directors by its action determines to include said parcel within
the potable water service area of the District.
2. The City of Dublin is hereby designated as the Conducting Authority pursuant
to Government Code Section 57000 et seq. and the City is authorized to proceed
with the publication of all legal notices and public hearings as required by statute;
3. The Resolution entitled "Findings, Explanation, and Statement of Overriding
Considerations of the Alameda County Local Agency Formation Commission
Pursuant to CEQA Regarding the Proposed P A 94-030 Eastern Dublin
Reorganization" pursuant to CEQA and CEQA Guidelines has been adopted by
the Commission; and
4. The Executive Officer has been authorized to file a Notice of Determination
pursuant to Section 15096 of the California Code of Regulations with respect to
the environmental findings adopted hereby and reorganization proposed hereby.
