FINANCIAL STATEMENT:
No cost to City.
DESCRIPTION: The storage racks that Mr. Dorazio references do
not violate any building regulations of the City. The Building Code requires permits for
storage racks over 8' high (7' in 1984) and that they be designed to resist seismic forces.
On February 2, 1985, Pac n Save obtained a permit for the racks and they comply with
the code in effect at that time.
The storage racks are about 7' high. Merchandise is stored on top of the racks to up
approximately 14 feet above the floor. In 1985 the Building Official was concerned that
the code did not address the possibility of merchandise falling from the racks and injuring
customers in an earthquake, therefore, he sent a letter to Safeway expressing his concern
("Exhibit 1 "). "Exhibit 2" is the response from Safeway.
The Building Official also expressed his concerns to various organizations in the
engineering community and suggested that the problem be investigated and code
revisions be developed. As of this date, there are no proposals to revise the Building
Code.
"Exhibits 10, 11, & 12" are letters from Mark Dorazio expressing his concerns. The
Building Official met with Mr. Dorazio in early February and reviewed the previous
correspondence ("Exhibits 1 through 8"). The Building Official explained that there is no
building code requirement that addresses his concerns.
"Exhibit 9" is Dougherty Regional Fire Authority's investigation of the matter.

This is to confirm our conversation regarding the concerns I
expressed to you regarding the display of merchandise in your new
Pak I n Save, in Dublin. In some cases merchandise is displayed
in stacks resting on the floor. These stacks sometimes extend
almost to the T-bar ceiling grid, which is almost 14 I high. In
other cases merchandise is displayed on racks. The racks are
about 7 feet high and again merchandise extends almost to the
ceiling grid. Although the racks are designed and anchored to
res ist seismic forces in accordance with the Uniform Building
Code, there is nothing to prevent material from falling from the
racks, or the stacks supported on the floor from falling and
injuring customers in the event of an earthquake.
Unfortunately this problem is not addressed by the present
building code. Therefore, I wish to express my concerns to you
regarding the hazards to your customers in the event of an
earthquake. I suggest that you refer the question to your
structural engineers and to your risk management department.

Dear Mr. Taugher:
Gary Scott of our Real Estate Law Division has asked that I respond to
your letter of February 15, 1985 in which you express concern regarding seismic
safety of merchandise at the Pak-N-Save Market in Dublin, California.
Your concerns are ones that we share. Safeway and Pak-N.Save work hard
to maintain a clean and safe environment for our employees and customers in all
of our various facilities.
After receiving your letter from Mr. Scott, I visited the Dublin store
to gain a better understanding of the practices used at that location.
Some of the techniques used to add stability to palletized merchandise
are not readily discernible. For example, cases of palletized goods on racks are
usually cross-tie stacked. This method of stacking provides intrinsic stability
to palletized product and is standard in the grocery (and other) industry. Some
suppliers use a plastic film to wrap around a pallet of product to provide
additional stability. When possible, at Pak-N-Save, the plastic film is left in
place until the pallet must be broken down. Merchandise at ends of aisles is
provided additional stability by taping cases together.
Stability of palletized product in rack storage is addressed by a study
conducted by John A. Blume & Associates, engineers, for the National Science
Foundation - June 1980. Summary and Conclusions on Page 250 includes the
following: "In all tests of merchandise that was not tied, all merchandise
tested was very stable, and no movement of stored material was observed except
for some of the upper most cartons of paper productsR. and RFor all tests, little
difference in global and local responses was found between the cases in which
merchandise was tied to the rack and those in which merchandise was not tied to
the rack."
Our own experience at our San Francisco Division Richmond Distribution
Center which utilizes rack storage to even greater heights than the Dublin
Pak-N-Sa ve is supportive of the stability of the palletized product. In the past
ten years through whatever earthquakes have struck the area. there has been
little or no falling of product from the racks.

Pak-N-Save operated a similar retail facility in San Jose in April 1984
at a time when Morgan Hill was jolted by a pretty good shaker. Only three cases
of product fell off of the racks during that earthquake.
Combined, these independent professional engineering studies, our own
experience, as well as the fact that similar practices are used throughout this
and other industries indicates a good deal of confidence in the stability of
palletized product in rack storage,
Obviously, if an earthquake of unusual magnitude strikes an area, no
technique would guarantee absolute freedom from falling product.
In regards to your concern about merchandise stacked on the floor (most
probably you meant what we would call end displays), I share your concern. I
have communicated that concern to Pak-N.Save personnel. It is my understanding
that they are reevaluating their end display techniques.

Dear IVIr. Taugher:
Thank you for your letter regarding display racks in stores, and the possible hazard
they pose in the event of an earthquake. I passed your letter on to the Applied
Technology Council (A TC) Board in February, who in turn recommended that you transmit
your thoughts on this matter to the Structural Engineers Association of California
(SEAOC) Seismology Committee. Although the Board recognizes the problem, it is not
an area in which ATC is working at this time.

RE: HIGH-PILED STOCK IN PUBLIC AREAS
Attached are copies of correspondence 'that I sent in 1985 relating to the safecy
of high storage and display of merchandise in retail sales areas and responses
from ATC & the owners of the store. I.C.B.O. responded that they did not belieye
this was a building code issue. Structural Engineers Association of Northern
California never did respond,
After the October 17th earthquake, I received a call from a concerned citizen who
was in the store at the time. " According to the manager of the store only 30 to
40 people were in the store and no one was injured. This is not surprising.
Other areas affected by the earthquake attribute the minimal casualties to the
fact the World Series was about to start. It was stated that bottles and cans
fell off the shelves. Three fourths of the contents of a pallet (Nhich are
stored at about the 7' level) consisting of sacks of sugar or flour fell. Each
aisle was reported to be impassible and many of the pallets on the upper portion
of the racks shifted substantially, although no pallets fell.
I have no information as to the ground accellerations in Dublin; .18g was
reported in Hayward which is more than 10 miles from the store in question.
Dublin is expected to experience violent ground shaking in the event of a major
earthquake on the Calavares Fault. Studies on our Civic Center site, which is
1/4 mile from the store, indicate ground accellerations of .62 to .65g will be
experienced in the event of a maximum creditable earthquake on either the
Calavares or Hayward fault. If this occurred when the store was crowded,
casualties would surely result. Since the Structural Engineers Association is
the author of the seismic provisions of the UBC, I think it would be appropriate
for your Seismology Committee to investigate the problem. I do not think it
makes much sense to require seismic design for racks and ignore the problem of
materials shaking off the racks. I am obviously more concerned with life safe:),
but I think protection of property also requires that material remain on the
racks.
I would be happy to meet with your committee on this matter.

The Fire Prevention Division is in receipt of your letter regarding what you feel
constitutes an unsafe condition at Pak and Save in Dublin. As a public supported fire
department, our mission is to enforce the Fire Codes adopted by your elected City Officials. \Ve,
the members of the Dougherty Regional Fire Authority take this mission seriously. In response
to your telephone call, I personally visited Pak and Save to view the conditions as related by you.
I also directed a Fire Inspector to visit the store to see if it violated any of our existing codes.
Inspection fOLLnd that they were in complillilce ",..ith our requirements.
The above information was related back to you in the fonn of a telephone call in which I stated
our position and I advised you to contact the Dublin Building Department to see if they could
help in this matter,
The codes that are enforceable by the Dougherty Regional Fire Authority make reference to
High-Piled Combustible Storage (1991 Unifonn Fire Code Sec. 81.101.). Pak and Save's
storage does not constitute .combustible storage as outlined in this Section.
The Dougherty Regional Fire Authority has no jurisdiction outside the Fire Codes. We vvish you
well in your efforts in pursuing the correction of this condition.
