HomeMy WebLinkAboutItem 7.1 RowellRnchRodeoBanner (2) . . .. .~ EXHffiIT "A" POLICY OF THE CITY OF DUBLIN REGARDING INSTALLATION OF ADVERTISING BANNERS WITHIN THE PUBLIC RIGHT-OF-WAY INTENT: This policy is to regulate the installation, materials, scheduling, removal, insurance, and other items related to banners placed within the City of Dublin right-of-way. ELIGffiILITY: Nonprofit organizations advertising activities which benefit City of Dublin residents may apply for a permit to erect and maintain a banner. APPROVING AGENCY: The Public Works Director shall be the approving entity for applications wherein all guidelines of this policy are clearly met and shall issue an encroachment permit for same. The City Council shall be the approving entity where exceptions to the policy are requested or where the Public Works Director has denied the permit. If such applications are approved by the City Council, the Public Works Director shall issue the encroachment permit. The banner shall be installed by the City of Dublin maintenance department. FEES: The applicant shall be charged an encroachment permit fee for usage of the banner poles. There shall be no possibility of waiver of the fee. TIME LIMITS: The application for banner installation shall be submitted not later than one month in advance of the desired installation of the banner, and no sooner than one year in advance of the proposed installation. Anyone agency may not erect a banner any more frequently than four times in anyone calendar year. No banner, for any event, may be erected for longer than two weeks and no more than one banner erected for anyone event. LOCATION: Council. The banner shall be erected and displayed at a location approved by the City MATERIALS: The banner shall be designed and made by a company whose business it is to design and construct banners. The design shall be sufficient to handle wind loads as specified in the latest adopted Uniform Building Code. INSURANCE: The applicant shall carry liability insurance in an amount not less than $1,000,000 and shall provide a Certificate of Liability Insurance which names the City, its agents and employees, as additional insureds. OTHER REQUIREMENTS: The City Council and/or Public Works Director may impose additional conditions as necessary to control banner installation, maintenance, and removal. The City Council may waive or change any of the guidelines within this policy as conditions may dictate on any installation; except that the encroachment permit fee shall not be waived in any case. Direct Staff to prepare a revised policy and fee schedule for future banner installations. FINANCIAL STATEMENT: The existing permit fee for banner installation is $50.00. This fee is intended to cover Staff's time to process the permit. The actual cost of banner installation by the City is approximately $400, assuming the banner does not require interim maintenance. If the Rowell Rodeo provides the installation, the City would not incur any costs above the Staff processing time. DESCRIPTION: At the March 27th meeting, the City Council reviewed a request from the Rowell Ranch Rodeo to use the San Ramon Road banner poles to advertise the 1995 Rodeo. The City has not installed any banners for non-profit organizations since July of 1993 due to budget constraints. The Rowell Ranch Rodeo has obtained the services of St. Francis Electric as a potential banner installer. St. Francis Electric has bucket trucks available and is familiar with the type of traffic control that is used for street work. Staff proposes to require that St. Francis Electric submit a certificate of liability insurance and a traffic control plan, which would need to be approved by Statf, prior to issuance of the permit. St. Francis would additionally need to respond in the event that there is a problem with the banner. In the past, some of the banners have tom or come loose from the cables and needed to be removed and/or repaired in order to remain safe. Staffhas discussed these issues with St. Francis Electric. It is further proposed that the standard encroachment permit be issued at the $50.00 fee to cover the cost of processing and that the Rowell Ranch Rodeo also be required to provide a certificate of liability insurance to cover the banner itself On this basis, Staff recommends (1) that the City Council approve issuance of the permit to the Rowell Ranch Rodeo and (2) that the City Council direct Staff to prepare a revision to both the banner policy and fee schedule to accommodate future banner requests. g: \agenmisc\bannr2 -----------.--------~~-------~~-----------~-----------~...----------~-.-----------~_..~______________.w.~____________________ ITEM NO.
