FINANCIAL STATEMENT: 1995-96 Sources and Use of Funds Revenues: Gross Amount Assessed: $55,659 Interest Revenue: 1,230 Less Estimated Collection and Delinquency Cost: (1,256) Net Total Revenues $55,633 Expenditures: Contract Maintenance and Utilities: $52,565 Administration and Engineering: 1.500 Total Operating Expenses: $54,065 Estimated revenues are anticipated to exceed expenses, which will increase the amount in reserves: $ 1,568 $55,659 will be assessed to property owners for the 1995-96 street landscaping maintenance costs, which is the same as the 1994-95 assessment ($228.72 per single family home and $38.68 per Amador Lakes unit). It is estimated that this will result in a small appropriation to reserves in this District. DESCRIPTION: In 1983, the City formed Landscaping and Lighting Assessment District No. 83-2 for the purpose of maintaining landscaping within Tract 4719. The District originally included Stagecoach Park and Stagecoach Road north of the City Limit, but now includes only roadway landscaping along Stagecoach Road and on the "interior slopes" (Coral Way and Agate Way) within the Dublin Hills Estates development. The maintenance cost for Stagecoach Park, as well as the undeveloped Dougherty Hills Park, is paid by the City through the Park Maintenance Operating Budget and is not a part of this Assessment District. The cost of maintenance of the Stagecoach Road landscaping is spread 60% to the Amador Lakes development (divided among the 552 condominium lots) and 40% to the Dublin Hills Estates development (divided among 150 single-family lots). All of the "interior slope" maintenance cost is spread evenly to the 150 single-family lots. The estimated June 30, 1995, reserve for this District is projected to be $22,925. The actual reserve will not be known until the City closes its books and accrues the necessary revenues and expenses. In the past, portions of the reserve have been used for landscape renovations, particularly following the disastrous freeze several years ago. In addition, a portion of the reserve has been used in recent years to keep the assessment to property owners as low as possible. The level of service in this District has been 0 / ITEM NO.8.2 Copies to: CITY CLERK FILE IFo e o tailored to the available funds (i.e., low assessment, small reserve) as much as possible rather than requesting to increase the assessment in order to perform additional work. This District has quite a large landscaped area which is supported by relatively few property owners. It is not proposed to use any of the reserve this year in order to keep the assessment at the same level as the 1994-95 assessment. In accordance with City Council direction, Staff has prepared options available related to future assessments for this District. The following options are based upon the current conditions affecting the District, and it will be appropriate to review each year the actual costs, reserves, and delinquency rates. 1) Increase the assessment in accordance with Consumer Price Index (CPI) increases. The CPI increase has averaged approximately 2% over the past three years. If this were the factor applied, it would increase the single-family assessment to $233.30 and the Amador Lakes assessment to $39.46 per unit, or a total of$21,781.92. This would result in approximately $1,106 in additional revenue (net after County collection fees). This would help to keep from using the reserve, assuming that maintenance cost, including utilities, will increase with the CPI. If the City Council wishes to pursue this option for future years, the preliminary Engineer's Report would need to be acted upon in May in order to allow sufficient time for noticing and holding a neighborhood meeting. 2) Recalculate the assessment on an annual basis so as to reflect the actual cost of District maintenance. If this method were used, there would be a very slight decrease in the assessment for FY 1995-96 ($1,568 spread among the 150 single-family lots and 552 apartment units). In future years, the assessment could potentially increase or decrease depending upon actual maintenance activities and utility costs that occur and the interest that is earned on the reserve. For example, this District has been prone to vandalism, and an increased need for repairs would affect the assessment. 3) Freeze the assessment at the current level and utilize the reserve to pay any inflationary maintenance cost increases. It is recommended, however, that the reserve be maintained at or near its 'present level as a contingency for potential landscape disasters such as a freeze. For Fiscal Year 1995-96, no change is recommended with respect to the method of determining the assessments. The District boundary remains the same. At this time, Staff is proposing that the District assessment for FY 1995-96 remain the same as last year's assessment. The assessment to the single- family property owners in the Dublin Hills Estates development is proposed to remain at $228.72 per single-family home. The Amador Lakes Apartments property is proposed to be assessed at a rate of $38.68 per dwelling unit (or $21,351.36 for the entire apartment development), which is also the same as the 1994-95 assessment. In both 1993-94 and 1994-95, oleander bushes have been planted mid-slope on the Stagecoach Road slopes. The installation is part of the master landscape plan that was presented to the City Council three years ago. The landscaping plants, fertilizer, and mulch is being paid for by Amador Lakes and installed by the District. Staff intends continuing the practice of holding an informational meeting with property owners in this assessment district in order to obtain comments and answer questions regarding maintenance costs and practices. This informational meeting is planned prior to the date of the public hearing and will be held at the Civic Center. Staff recommends that the City Council (1) provide direction regarding increased assessments for future years and (2) adopt the resolutions approving the preliminary Engineer's Report and setting a public hearing date of July 25, 1995, for the purpose of hearing protests to the proposed assessment. g:(ad)183-21agstpre Page 2 RESOLUTION NO. -95 -- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING PRELIMINARY ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2 (TRACT 4719) WHEREAS, by its Resolution No. 28-95, a Resolution Directing Preparation of Annual Report for City of Dublin Landscaping and Lighting Maintenance Assessment District No. 83-2 (the "District"), this Council designated the City Engineer as Engineer of Work and ordered said Engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting.Act of 1972; and WHEREAS, said Engineer of Work has made and filed with the City Clerk a preliminary report in writing as called for in said Resolution No. 28-95 and under and pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS, said Council has duly considered said report and finds that each and every part of said report is sufficient; and that said report neither requires nor should be modified in any respect; NOW, THEREFORE, BE IT RESOLVED a) That the Engineer's estimate of the itemized and total costs and expenses of maintaining said improvements and of the incidental expenses in connection therewith, as contained in said report be, and each of them are hereby preliminarily approved and confirmed; b) That the diagram showing the assessment district, description of the improvements to be maintained, and the boundaries and dimensions of the respective lots and parcels of land within said District, as contained in said report be, and it is hereby preliminarily approved and confirmed; c) That the assessment of the total amount of the cost and expenses of the proposed maintenance of said improvements upon the several lots and parcels of land in said District in proportion to the estimated benefits to be received by such lots and parcels, respectively, from said maintenance, and of the expenses incidental thereto, as contained in said report be, and they are hereby preliminarily approved and confirmed. I do hereby assess the net amount to be assessed upon all assessable lots or parcels of land within said landscaping maintenance assessment district by apportioning that amount among the several lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the maintenance of said improvements, and more particularly set forth in the list hereto attached and by reference made a part hereof Said assessment is made upon the several lots or parcels of land within said landscaping maintenance assessment district in proportion to the estimated benefits to be received by said lots or 2 • appearing herein are the diagram numbers appearing on said diagram, to which reference is hereby made for a more particular description of said property. The balance of this annual cost has been divided equally among Lots 1 through 150, inclusive, of Tract 4719. The cost of maintaining the excavated slopes and concrete culverts together with its landscaping on the interior slopes of the single-family area(above Agate Way and Coral Way) shall be evenly spread over Lots 1 through 150 of Tract 4719. Lots 152 and 153, being park and open space, shall have a zero assessment. Lots 154 and 155, being public agency owned, shall have a zero assessment. • 5 • / ti J SCOPE OF WORK The scope of work shall be the maintenance of landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between the limits of Amador Valley Boulevard and the northerly City Limit.
