FINANCIAL STATEMENT: 1995-96 Sources and Use of Funds Revenues: Total Proposed Assessments Levied: $55,195 Estimated Interest on Reserves: 6,720 Less Estimated Collection Cost and Delinquency (1,330) Net Total Revenues: $60,585 Expenditures: Contract Landscape Maintenance: $46,702 Utilities: 22,850 Administration and Engineering Reports: 1,447 Total Operating Expenses: $70,999 Amount Expenditures Exceed Revenues, To Be Funded From Reserves:: $10,414 As shown above, $55,195 is proposed to be assessed to property owners for the 1995-96 street landscaping maintenance costs. The difference between the estimated cost and assessments is made up by interest revenue on the reserve account and by use of reserve funds. The amount assessed to property owners ($84.72 per single family home and $42.36 per multi-family dwelling) is the same amount as the 1993-94 and 1994-95 assessments. DESCRIPTION: This maintenance assessment district was formed in 1986 as part of the review and approval of the Villages at Willow Creek development. This assessment district funds the maintenance of landscaping, including fencing and soundwalls, along the west side of Dougherty Road from Amador Valley Boulevard to the northerly City Limit, along Amador Valley Boulevard from Dougherty Road to Wildwood Road, along Wildwood Road and Fall Creek Road, and certain landscaped areas within the Ridgecreek single-family home development. Landscaping within the condominium and apartment developments is the responsibility of the property owner or homeowners' association for those individual developments. The landscaping along and within the Alamo Creek channel area is not included in the assessment district as it is the responsibility of Alameda County Flood Control, Zone 7. Assessment Options: For Fiscal Year 1995-96, Staff is not proposing a change with respect to the method of determining the assessments. The District boundary remains the same as last year. For 1995-96, the assessment to the ITEM NO. t9. , Copies to: CITY CLERK FILE IFJ property owners is proposed to be $84.72 per single-family home and $42.36 per multi-family dwelling unit. This is the same as the past two years' assessments, and Staff proposes to utilize $10,414 of the accumulated reserve in this District in order to maintain the assessment at the same level. These reserves started out very high because the developer completed and turned over the landscaping improvements to the City approximately two years after the District was formed and began collecting assessments. Staff has recommended that the reserves subsidize the assessments until the reserves are reduced to a level which is determined adequate to take care of some unanticipated major landscape disaster such as a major freeze or plant disease. Staff feels that$50,000 would be a sufficient reserve for this eventuality. It should be noted that at the present time, the use of reserves is proposed to fund approximately 15% of the District expenses. At such time as these funds are no longer available for annual costs, the assessments would need to be increased significantly in order for District property owners to pay the full cost of District activities. Staff has also completed a preliminary estimate of the fund balance which would be available as of June 30, 1995. It is projected that the amount will be approximately $125,179. The actual amount will differ based upon final posting of all expenses and revenues, including the allocation of interest and delinquent tax collections. The City Council may wish to consider two options for increasing the assessment in this District in future years or make a one-time major reduction in assessments: 1) Increase according to the Consumer Price Index percentage of increase. This increase has averaged approximately 2% over the past three years. If this factor were applied to the current assessment, would increase the single-family rate to $86.42 and the multi-family rate to $43.22. This would raise approximately $662 per year(net after deducting the County collection cost), compounded, and slow the rate of use of the reserve, and the need for a major increase in assessments once the reserve is expended. 2) Increase to meet budgeted maintenance costs without use of reserves. This District has a sizeable reserve, which has been used in the past to offset maintenance cost increases. The reserve provides a certain amount of interest income to the District, which in turn is used to finance a portion of the maintenance cost. Keeping the reserve high does reduce the annual assessment because of the interest earned on the reserve. An increase in the assessment to eliminate the use of reserves would raise the proposed 1995-96 assessment by about 19%. This would increase the single-family rate from $84.72 per year to approximately $101 and the multifamily rate from$42.36 to approximately $50.50. 3) Lower or eliminate the assessment on a one- or two-year basis and draw down the reserve to the level needed to cover an unanticipated landscape disaster(say $50,000). The down side of this would be a major increase in assessments after the reduction in order to bring the assessment back up to the prior level and to cover the subsidized portion of the cost and reduction in interest earned. If the City Council wishes to increase the assessment in future years, approval of the Preliminary Engineer's Report should be scheduled on a May agenda to allow time for noticing and holding a neighborhood meeting with residents to discuss the increase. Staff recommends that the City Council (1)provide direction regarding potential increase in the assessment for future years and (2) adopt the resolutions approving the preliminary Engineer's Report and setting a public hearing date of July 25, 1995, for the purpose of hearing protests to the proposed assessment. g:(ad)186-11agsipre Page 2 RESOLUTION NO. -95 A RESOLUTION OF THE CITY COUNCIL. OF THE CITY OF DUBLIN APPROVING PRELIMINARY ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 86-1 (TRACT 5511) WHEREAS, by its Resolution No. 29-95, a Resolution Directing Preparation of Annual Report for City of Dublin Landscaping and Lighting Maintenance Assessment District No. 86-1 (the "District"), this Council designated the City Engineer as Engineer of Work and ordered said Engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, said Engineer of Work has made and filed with the City Clerk a preliminary report in writing as called for in said Resolution No. 29-95 and under and pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS,said Council has duly considered said report and finds that each and every part of said report is sufficient; and that said report neither requires nor should be modified in any respect; NOW, THEREFORE, BE IT RESOLVED a) That the Engineer's estimate of the itemized and total costs and expenses of maintaining said improvements and of the incidental expenses in connection therewith, as contained in said report be, and each of them are hereby preliminarily approved and confirmed; b) That the diagram showing the assessment district, description of the improvements to be maintained, and the boundaries and dimensions of the respective lots and parcels of land within said District, as contained in said report be, and it is hereby preliminarily approved and confirmed; c) That the assessment of the total amount of the cost and expenses of the proposed maintenance of said improvements upon the several lots and parcels of land in said District in proportion to the estimated benefits to be received by such lots and parcels, respectively, from said maintenance, and of the expenses incidental thereto, as contained in said report be, and they are hereby preliminarily approved and confirmed. Assessment Diagram (Preit;w;kal ASSESSMENT WHEREAS, on March 13, 1995, the City Council of the City of Dublin, California, pursuant to the provisions of the Landscaping and Lighting Act of 1972, adopted its Resolution Directing Preparation of Annual Report for Maintenance Assessment District 1986-1 for the maintenance of improvements more particularly therein described; and WHEREAS, said Resolution directed the undersigned to prepare and file a report pursuant to Section 22565, et. seq., of said Act; NOW, THEREFORE, the undersigned, by virtue of the power vested in me under said Act and the order of the Council of said City, hereby make the following assessment to cover the portion of the estimated cost of the maintenance of said improvements and the cost and expenses incidental thereto, to be paid by said District. I do hereby assess the net amount to be assessed upon all assessable lots or parcels of land within said landscaping maintenance assessment district by apportioning that amount among the several lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the maintenance of said improvements, and more particularly set forth in the list hereto attached and by reference made a part hereof. Said assessment is made upon the several lots or parcels of land within said landscaping maintenance assessment district in proportion to the estimated benefits to be received by said lots or 2 appearing herein are the diagram numbers appearing on said diagram, to which reference is hereby made for a more particular description of said property. Each lot or parcel of land assessed is described in the assessment list by reference to its parcel number as shown on the Assessor's Maps of the County of Alameda for the Fiscal Year 1995-96 and includes all of such parcels excepting those portions thereof within existing public roads or rights of way to be acquired in these proceedings for public road purposes. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the County Recorder of said County. Because the names of the several owners are unknown to me, I hereby place the word "unknown" opposite the number of each lot of parcel of land assessed, the amount assessed thereon, and the number of the assessment.
